This Is the Portion of Obamacare That the House Voted to Repeal

On Wednesday, the Republican-led House of Representatives took a major swipe at President Obama’s health care law, as it voted to repeal the Community Living Assistance Services and Support program (known as the CLASS Act). CLASS is, by all accounts, a financially-troubled and complex portion of the controversial overhaul; it deals with providing affordable, long-term care insurance to Americans in need.
This provision in the health care law has been troublesome for some time now. Back in October, Health and Human Services Secretary Kathleen Sebelius said she wasn’t able to find a way to make the voluntary program financially solvent. But the White House, despite these challenges, hasn’t yet been supportive of repealing it.
Under the program, workers would pay a monthly premium during their careers and collect a daily cash benefit if they become disabled later in life. The White House describes the program as follows:
The Act provides Americans with a new option to finance long-term services and care in the event of a disability.
It is a self-funded and voluntary long-term care insurance choice. Workers will pay in premiums in order to receive a daily cash benefit if they develop a disability. Need will be based on difficulty in performing basic activities such as bathing or dressing. The benefit is flexible: it could be used for a range of community support services, from respite care to home care.
No taxpayer funds will be used to pay benefits under this provision. The program will actually reduce Medicaid spending, as people are able to continue working and living in their homes and not enter nursing homes. Safeguards will be put in place to ensure its premiums are enough to cover its costs.
The Associated Press further explains the plan:
The CLASS Act was supposed to address the crisis in long-term care coverage. Currently some 10 million Americans need long-term care, and that number is expected to hit 15 million by 2020. But only about 8 percent of people buy private long-term care insurance.
…monthly premiums would be used to finance benefits of at least $50 a day for those needing long-term care. The money would go for services at home or to help with nursing home bills.
But government actuaries determined that unless a large number of healthy people signed up, premiums would have to soar to unaffordable levels to meet the growing needs of the disabled.
“House Republicans voted to repeal the entire Affordable Care Act last year, but Democrats stood behind the president in defense of their landmark bill. Now, Republicans are trying to take it apart, piece by piece,” ABC News reported.
The vote to strike down the act ended with 267 for and 159 against, as 28 Democrats joined in favor and all 239 voting Republicans showed their support for it.
Republicans have targeted the program as part of their overall goal of dismantling the health care overhaul law. Action on the bill in the Democratic-controlled Senate is uncertain. One of the few changes Congress has been able to bring about concerned a requirement for small businesses to file more health care paperwork.
“Republicans are committed to repealing and defunding it, piece by piece if necessary,” House Speaker John Boehner, R-Ohio, said of the health care bill after the CLASS Act vote.
Experts have concluded, said Rep. Phil Gingrey, R-Ga., that “the CLASS program can’t be operated without mandatory participation so as to ensure its solvency.” Unless it is terminated, he said, “it poses a clear danger to the fiscal health of our budget and to the American taxpayer.”
The administration finally has come to the conclusion “that we knew even before the bill passed, that this was unsustainable, it was unworkable, it was fatally flawed,” said the bill’s sponsor, Rep. Charles Boustany, R-La.
But Rep. Henry Waxman, D-Calif., said the Republican goal was to “tear down and dismantle programs that provide health care in the United States.“ He said ”the solution is to amend the program to make it work, not just repeal it and leave nothing in its place.”
Waxman isn’t alone in his criticism. Sen. Jay Rockefeller (D-WV) penned an op-ed for Politico that railed against the Republican action:
In the past, lawmakers would have worked together to amend existing law to address a serious national crisis like long-term care. But in our charged partisan environment, too many people would rather score political points than solve problems. They view repealing CLASS as a tactical step toward undermining health care reform – without putting forward any real alternatives for families who have nowhere to turn.
Repealing CLASS won’t do anything to solve our nation’s long-term care crisis. Legislation rarely starts out perfectly – indeed, the Republicans’ own Medicare prescription drug bill left a huge coverage gap, forcing seniors to pay thousands of dollars out of pocket. It is only because Democrats rejected the “throw out the baby with the bathwater” approach to legislating, and figured out a solution, that this gap will finally be closed and seniors can save millions on prescription drugs.
More evidence that the battle over the American health care system is far from over.

I was a collegiate national qualifying athlete – probably in better shape than 99% of Americans. As healthy as healthy can be.
In my junior year of competition, I was denied coverage by my insurance company for rehabilitation on a shoulder impingement – a sad side effect of my active lifestyle. Why was I denied coverage? “Pre-Existing condition”… really? A Sports-related injury to the shoulder joint is a pre-existing condition?
Thankfully my school’s athletic training department was top notch and was able to help me through the rehabilitation process. Had they not been there for me, we would have been left high and dry. We paid thousands of dollars into it over the course of my life and when we needed it most it wasn’t there.
“You should have sued them!”. HA! My middle class parents were in no position to take on the multi-billion dollar company in court – the legal fees alone would have crippled us.
When your end goal is to make a profit, it is pretty easy to turn a blind eye to your obligations in the name of financial reward.
THAT is why this health care reform is needed. It will keep the private companies accountable because it permits their customers an alternative.

I agree that pre-existing condition legislation and a lot of other things were needed but that abortion of a healthcare law is nothing but rubbish covered over with a few things that actually needed to be taken care of. The president doesn‘t know what all this bill actually entails and as we all know Nanny Pelosi sure doesn’t we just have to pass the bill to see what is in it. Anything that is passed that way is bad news and will only result in a neverending government money vacuum.

This is not a story about poor us. It was our honor and blessing to have her live with us. This is a story of Medicare and what we as taxpayer pay.
She was not eligible for Medicare covered inpatient hospice. She was eligible for home visit hospice service. Anyone who has been a care giver knows the phrase “two-person”assist. Literally, 2 people had to lift her from bed to wheelchair to dining room to bathroom to living room along with the hygiene cleaning needed. Most of the lifting was done multiple times during the day. Home healthcare came 2 per week to shower her and a nurse visited once a month. Toward the end the nurse came twice per week and a social worker came to help my wife through the life ending and grieving process. We honored my mother-in-law’s request to be at home. Many of you know this is a common request of seniors.
The home healthcare company is tied to a local hospital and rehab/hospice center. They charged Medicare the same cost as an inpatient even though she was not qualified for inpatient. Medicare paid at the inpatient rate. To be absolutely clear, the labor hours my wife and I put in as caregivers was treated the same as labor hours for a nursing assistant at the inpatient facility. Taxpayers are getting ripped off. If Medicare could be made efficient and effective we might save some money.

It would be nice once to actually find some people who could discuss healthcare and healthcare insurance who had a minimal understanding of the industry dynamics and the economics reality surrounding health insurance. Since we have laws and a social expectation that everyone who needs care should received care….it would follow that everyone should contribute to funding that care level. And let’s be clear that the vast majority of individuals cannot cover a serious medical event. The health care industry will be the next one to fail because of an old economic model that does not work anymore. That is private insurance subsidizing the uninsured and under insured. Don’t criticize the plan on the table unless you have a better plan to fix the problems in the current model…..the problems that are actually causing your premiums to go up.

You know why it will fail? Because this was another liberal idea that an employer should provide health insurance thus putting an interested party between patient and doctor. Employee benefit plans proliferated in the 1940’s and 1950’s. Strong unions bargained for better benefit packages, including tax-free, employer-sponsored health insurance. Government programs to cover health care costs began to expand during the 1950s and 1960s. Disability benefits were included in social security coverage for the first time in 1954. When the government created Medicare and Medicaid programs in 1965.

We don’t spend twice as much per capita as the next highest country on health care, not insurance, because we have employer based health insurance. Here is a tip if you really want to become informed about any issue or problem. Follow the money. Bush signed the prescription drug benefit for Medicare. Was it because he cared health care cost for the elderly. Hardly, it was because the fhe contributions and lobbying of the drug companies. Follow the money champ it will show you who has really caused the problems and syphoned wealth through the federal government. We have the best politicians money can buy on both sides of the isle. And who do you think can afford to buy them….. certainly not the poor on Medicaid. It’s who makes the money off Medicaid, not who is getting it that keeps it going. The main lobby for the food stamp program was the food and agricultural industry…. Please do your own research and get informed.

If the funding is inadequate than it has to be adjusted. You might want to focus on the fact we spend twice per capita on health care then the second most expensive country. Perhaps the drug companies, medical equipment companies and physicians are making too much off the system as those are the things that more directly contribute to the cost delineation. Really not that hard to research this.

Teachers are a profession and performa a service for which they are paid. The fact that it makes sense to fund schools through a public funding mechanism does not make their efforts worth any less than a cable TV installer. And clearly their educational level and importance to society is a tad higher than the cable TV private sector employee. I worked in several hospitals in NYC that had unions. Unions aren’t the problem, bad management and individuals who sign unaffordable contracts are. The public sector unions agreed to Walker’s cost reductions. The issue wasn’t cost it was cowardice and anti-democratric and unethical politics. Do yourself a favor and stop filtering and analyzing issues through a ideological filter. You probably limit yourself to Fox news, Rush and GB. All biased and rarely appealing to those who actually think for themselves.
