‘Told That We Had Nothing to Worry About’: Parents Sue for ‘Wrongful Birth’ After Daughter Born With Down Syndrome

The parents of a child born with Down syndrome are suing a Portland, Ore. health center for “wrongful birth,” saying they would have aborted their daughter had they known she had a chromosomal abnormality.
Deborah and Ariel Levy filed suit against Legacy Health, blaming their maternity center and lab for allegedly botching the prenatal test that should have revealed that their daughter, Kalanit, has an extra 21st chromosome, the Oregonian reported.

The couple, who also have two young sons, are suing for the expected lifetime costs of caring for their now-4-year-old daughter — an estimated $3 million. A jury began deliberating their case Thursday.
According to the Oregonian, hospital staff told the Levys when their daughter was born in 2007 that it looked like she had Down syndrome. When a doctor asked Deborah Levy — who at 34 years old was at an increased risk for having a baby with a genetic disorder — whether she had undergone prenatal testing she said yes, and that the results had been normal. However, a subsequent blood test performed just after Kalanit was born confirmed the diagnosis.
The Levys’ lawyer contended the doctor who performed the prenatal test — called a chorionic villus sampling, or CVS — erred in taking a sample of maternal tissue, rather than fetal tissue, the newspaper reported. Meanwhile, Legacy’s attorney held that all proper procedures were followed, and said Kalanit‘s form of Down syndrome means a significant number of her cells don’t have an extra chromosome.
“We were told that we had nothing to worry about,” Ariel Levy told jurors of receiving the initial test results, according to the Oregonian.

But when the baby’s blood test results came back with the news, Deborah Levy said, “It was devastating.”
The parents, whose sons are both healthy, said they worry about Kalanit‘s future medical problems and the extra care she’ll need all her life. They‘ve been told she likely won’t ever be able to live on her own or support herself.
A previous Oregonian report said the Levys were initially seeking $14 million to cover the cost of raising their daughter, including for education, medical care and other therapies.
The Levys’ lawyer said the couple have received death threats and the judge overseeing the case has banned courtroom photos of them for safety reasons.
The subject of prenatal testing has at times been a heated one during the presidential campaign. As The Blaze previously reported, GOP contender Rick Santorum, the father of a child with a genetic disorder, got into an emotional debate on the topic with CBS’s Bob Schieffer last month.

They have been living in a dream world if they believe that their lives are supposed to be perfect – no problems or challenges. I pray God softens their hearts. I cannot be hateful to them either because no one knows what that is like and we should all be praying for such people.
I also have to reiterate what Rick Santorum has said about Obamacare covering prenatal testing like this as “care”. It is only used to detect birth defects so people like the Levy’s can conveniently abort a child. We should never allow anything to further abortion.

A mistaken test? God is in charge of life and death. Perhaps, just perhaps, He knew YOU needed this child to make you better people. If you have to blame someone, blame yourself for you genes. I guess they are comfortable that she will never understand that they wish she would have been aborted, or perhaps don’t care. Great example for the two “regular” kids. No shame anymore although I am sure they can weave an intricate story of why they are justified. Right or wrong, of course, no longer apply.

i have met many children(some grown) with down syndrome and while many were smart they were “labled” dummies. but everyone i have met has a gigantic heart. in fact one young lady (7 years old at the time) came over to my apartment with her mom holding a boquet of fresh picked flowers when she heard my cat had died(which she adored) the sadness in her eyes as she stared into my sad eyes and tear stained cheeks broke my heart. but at the same time lifted me up knowing that the beautiful child labled a “dummy” by others showed me more compassion then neighbors who lived next to me for years ever did

It is because of people like them that more and more people will become used to the fact and say that…. well…., you know,…we don’t know what they are going through….and the child might even want this itself…. I mean,… look at her, she has no quality of life…. she will not suffer anymore….does she even know that she is alive?….it breaks my heart to see her so…
With the last one, , both parties benefit. The child will not suffer anymore and I get to feel good because I spoke out for her. The nurses and the doctors who will do this are all good samaritans.
I mean really, it must be very hard on them to have to do this. We should not make them feel bad, it is hard enough on them to HAVE to do this.
And now we have new victims. The heroic doctor and nurse. And of course the courageous parents.
PS. I know most doctors and nurses would find this practice repulsive.

I don’t care if she has Down Syndrome, she still needs affection. How else do you say “we don’t love you unconditionally“ than by saying ”you wouldn’t have been born”? We’ve cured some otherwise fatal genetic disorders in the past or at least developed treatments. How are we supposed to do that again if we keep aborting the condition. Aborting Down Syndrome children doesn’t do anything to cure Down Syndrome, a condition that likely predates Sickle-Cell, and will outlive AIDS.

Adoption is the answer; we are being given false choices: Abort a baby because the mother is too young, abortion should be legal due to “rape and incest.” In reality how many abortions are due to rape and incest? How many families are waiting to adopt? Probably 100 babies were adopted last year in Georgia- how many were aborted?

If I were the kind of disgusting person that would consider aborthion if there were something wrong with my baby, I think I would have the test done more than once, hell I would have them do it at least 3 times. I pity these people.. when we get children with disabilities.. its because God is trying to teach us something.. I have two disabled kids.. now in their 40′s.. and I am often told from my family that they could never have done so well if it had been handed it to them.. and my response is Bull Hockey.. we adjust we learn and we get them raised.. the best we can.. If you’re suing them then you are alleging they withheld information that would have caused you to take some different action, namely something different than having the baby.

No Tom, what you did was set the keg and light the fuse by implying abortion…….then wonder why there’s an explosion when people answer you the way they do. It’s not you making a rational argument, is you try to make a case for justified personal irresponsibility as it relates to an unborn being.

Please get the word out: there are LOVING families willing and able to adopt who will not be able to find an American baby. We are a family who is not able to have any more children (I have two young daughters). We are looking into adoption. The wait times are 2 years because THERE ARE SO FEW BABIES! America- wake up!! Adoption IS the answer- not abortion!! I would adopt this girl; no need to abort, no need to sue.
