Top Gov. Lawyers: U.S. Citizens Can Be Military Targets Without Trial

(The Blaze/AP)– U.S. citizens are legitimate military targets when they take up arms with al-Qaida, top national security lawyers in the Obama administration said Thursday.
The lawyers were asked at a national security conference about the CIA killing of Anwar al-Awlaki, a U.S. citizen and leading al-Qaida figure. He died in a Sept. 30 U.S. drone strike in the mountains ofYemen.
The government lawyers, CIA counsel Stephen Preston and Pentagon counsel Jeh Johnson, did not directly address the al-Awlaki case. But they said U.S. citizens do not have immunity when they are at war with the United States.
Johnson said only the executive branch, not the courts, is equipped to make military battlefield targeting decisions about who qualifies as an enemy.
The courts in habeas cases, such as those involving whether a detainee should be released from the Guantanamo Bay detention facility in Cuba, make the determination of who can be considered an enemy combatant.
Late last year, a judge threw out a lawsuit filed by al-Awlaki’s father, saying that the courts do not have the authority to review military decisions by the president aimed at protecting the country from terrorists. The cleric’s father, Nasser al-Awlaki of Yemen, was suing to prevent the U.S. from targeting his son.

It was stated, even then, by libertarians that it was a nightmare and would grow worse over time. As I recall, we were derided and called all kinds of nasty names by conservatives, who have now suddenly realized that all this stuff is bad. As soon as a GOP’er is back in the WH though, watch the anger magically disappear, just like the anti-war movement disappeared when Obama took office.

As a libertarian, i remember warning people about the patriot act and being told by republicans that “if ya ain‘t got nothin’ to hide, then you ain‘t got nothin’ to worry about”. These are the same people who are now running around with Gadsden flags, screaming about the constitution and the founding fathers. Sadly I was one of those people. However, I have woken up over the past three years, brushed up on history and have read over the Constitution more and more. It is sad to see what what we have lost over the years while sleeping. We no longer own anything outright.. if you don’t pay the tax or fee it can be confiscated. Gun rights threatened, corrupt judges, PC-ism, loss of free speech, Our freedom is hanging from a thread.
BTW, I really wish I took the “blue pill”.

Mostly because the POTUS was a (half) black man and they didn’t want to suffer the slings and arrows of claims of racism. It’s FAR easier to abstain than to to stand for right and truth.
IMHBLO, there is not one single congress person that is worthy of their office. I don’t care how pompous or arrogant or uppity or dismissive they are of questions of their fealty to the ideals of our government.
Actions speak VOLUMES more than words. (a picture, which is ‘action’, is worth a 1000 of them) and these people (all of them) have demonstrated a decided lack of principle, honor and integrity to the oath of their office, to say the bare minimum about their character.
We don’t see or hear a serious challenge to the attack (yes, IMHBLO, it “IS” an attack) on our culture. Every single one of them should be denied further privilege of serving Americans and this nation.

People like you are very helpful even though you might not know it. Between my own research and the research of others like you, GB’s team will find out about it and broadcast it in some manner. I don’t take any credit and do not want any. I don’t tell them who the information comes from so they can look at it objectively. There are several very good posters on The Blaze that I follow every day. 10th Amendment is another one; too many to list right now. Keep up the good work and when you see or hear something on The Blaze, the radio program or GBTV that you have been posting about for “days”, know that it just might have been YOUR post that led to that story being available for everyone in a more expanded manner. Don’t give up or get discouraged. You are more helpful than you know.

In 1950, Gandhi and Nehru sent a 26 year old man to the USA to find out about the American Industrial Revolution and to find out if it was something India might want to consider. I studied with that man for about 6 years from 1989 to 1995. This means that between you and Gandhi (Nehru also) there is only a separation of 2 people linking you directly with them both. What I know about Gandhi and Nehru I have heard first hand from the only person they trusted to go to America and report back to them. I know 100′s of stories from all three of them. Report Post »Liberals weren’t against the patriot act as much as they were against Bush and republicans in general. It was all political. Just like how they were anti-war until Obama got elected. Now you don’t hear a peep from the anti-war left even though Obama has doubled the size of the war in Afghanistan and, as a result, troops deaths in Afghanistan have doubled under his watch. He has also launched more drones into Pakistan in two years than Bush launched in 8 years.
The plain truth is that Obama extended the patriot act without a peep from the liberals. The patriot act is now Obama’s patriot act. Where is the outrage from the left. Obama has also doubled the size of the domestic spy program. Again, without a peep. The outrage from the left during the Bush years was nothing but politics of the lowest kind.
The libertarians have remained true to their values. They were anti-interventionism when Bush was in office and they are anti-interventionism now that Obama is in office. That is something that the left AND the right can’t say.

Thanks for the Gandhi story, Im sure you gained much with your interactions thru his US liaison. This brought back my thoughts (that I had formed a while back) that this is not an intelligence issue (oh hes a genius, I cant possibly comprehend it) to it being an a informed issue. So I love quipping back to folks, no Im not intelligent in that regard, just informed. (ie Intelligence implies a superior level of comprehension while informed shows that you can look over things and ingest whats of value…).
As for BLAZE posting the story, I have my reserves, but will be happy if they bring this to light. If you have ever watched ‘locked up abroad’ you see that many US citizens try to smuggle in the drug for materials gains. Yes they are wrong but NO they do not deserve to die from it – while Pedos like Sandusky roam the street free and other Pedos sentenced can’t get the death penalty because, according to ‘them’, the punishment does not fit the crime….

It is called the National Defense Authorization Act and it pretty much give the Executive branch of government the right to arrest and detain without trial anyone they deem a terrorist.
The Senate rejected the Udall amendment which was an attempt to weaken section 1031 of the NDAA which basically will turn the whole country into a battlefield. Americans will be stripped of their constitutional rights and Posse Comitatus will cease to exist.
The Senate is voting on NDAA today.
Prisonplanet.com has had great information about this for days now.

Just becuase 99% we ask for extradiction does not mean we have to. Yes, I have read the Constitution and the case law associated with it, the Constitution does not extend past our borders (the W. argument for Gitmo was to get away from the Constitution). The courts have held that 4th and 5th amendment protection do not extend past the borders. There is no right to due process when you leave the US.

I frankly don’t care where it happens; the executive branch should not have unchecked authority to order the killing of American citizens without a trial. It goes against everything we stand for. For all our advanced weaponry, we’re effectively given carte blanche to the president (ANY president) to kill US citizens.
One dying in the heat of battle is one thing. One dying by a order of a single person without the right of a trial by his peers is an entirely different one, and it something I am very much against.

IS your arguement that an americna fighting for a foreign force against the US can be killed on the battlefield, but if he leaves the battle field for a rear command position, the President needs court approval?

Do you realize that this is about the use of the Military on foreign shores, not domestic. The Constitution’s reach ends at the US boarders. Additionally, the Contitution grants the President broad powers in Foreign and Military affiars. Americna citizens that leave the country to fight for foreign foes leave behind many of the their protections. Whether they are on the battlefield or is rear command positions, they are targets like any other fighter would be.

The Constitution makes no explicit difference between how the executive branch can treat a US citizen within or without of its borders. The “vast powers” certainly do not say “includes the unchecked ability to order the death of a US citizen once outside the borders of US territory.” Hence, I hope a case gets to the Supreme Court so they can give an official interpretation that hopefully limits the power that the executive branch is abusing.
If the SCotUS comes out and says “Well, sure, they can do that,” I won’t be happy about it, but I‘ll agree they’re following the law of the land. Right now it’s incredibly up in the air and nothing has been decided.
Just to make sure, you’d be fine with Bush ordering targeted killings on US citizens outside of the country as well? Or any non-Democratic president? I don‘t think it’s right no matter what party they belong to.

I know it wasn’t directed at me, but that’s not the situation. Nice strawman argument, though. No, prior to issuing a targeted individual killed, that individual (who is known to the president, as he’s ordering a select killing) is due his rights as a US citizen. That includes a trial.
If the citizen is a combatant in an engagement and dies during it, that happens. If he’s captured, he should be tried back in the US. But the president (ANY president) should not have the unchecked power to order a specific US citizen killed.

The 5th amendment protects “persons” (due process), this means we cannot willy-nilly execute ANYBODY by executive orders, in or out of the country.

If the President can decide who among our citizenry is an enemy to the state, and then exact death upon that enemy without due process, then said President has become tyrannical. DHS has already declared militia members, Tea Partiers, veterans, CCW holders, and those who frequently discuss the Constitution as “domestic terrorists”. Are they next?

Bush’s policies have been carried on by Obama, but they’ve always been (what I consider) unconstitutional policies. I hope the Supreme Court has a chance to rule on a case about this before things get any worse.

But, in general, in my lifetime the ACLU has been on the wrong side as often or more often than they have been on the right side of issues… IMO. Why we did not declare war immediately after 9/11 is beyond me. I understand that Al Quieda is not a nation state. I don’t have a problem with that. I do have a problem with it happening within our borders though.
