Tucson Shooter Loughner Slapped With 49 New Charges

PHOENIX (AP) — The suspect in the Tucson shootings that critically wounded U.S. Rep. Gabrielle Giffords was charged on new counts that include the murders of a federal judge and a congressional aide, according to an indictment released Friday.
A federal grand jury returned the 49-count indictment Thursday, charging Jared Lee Loughner in the deaths stemming from a Jan. 8 shooting at a political event held by Giffords outside a grocery store.
The latest indictment charged the 22-year-old Tucson man with murder in the deaths of U.S. District Judge John Roll and Giffords aide Gabe Zimmerman. Loughner also faces new charges of causing death to or injuring participants at a federally provided activity.
Loughner had pleaded not guilty to earlier federal charges of trying to assassinate Giffords and kill two of her aides.
His attorney, Judy Clarke, didn’t immediately return a call and e-mail left at her office Friday.
Federal prosecutors haven’t yet said whether they will seek the death penalty against Loughner. But legal experts believe it’s a virtual certainty.
In all, 13 people were wounded and another six people, including a 9-year-old girl, died in the attack.
Loughner also will likely face state charges in the attack, but will be tried first in federal court before any prosecution begins on state charges. Federal and county prosecutors said federal law requires state prosecutions to be suspended while a federal case is pending.
Loughner is scheduled for a court hearing Wednesday in Tucson.
A day after the shootings, prosecutors filed a complaint in court charging Loughner with trying to assassinate Giffords, attempting to kill two of her aides and killing Roll and Zimmerman. Those charges were later replaced by federal indictments that mirrored the same charges.
In many criminal cases, prosecutors will often file charges themselves without a grand jury indictment, but will later replace those charges with an indictment.
It was not known why the charges against Loughner weren’t contained in one indictment.

There are people who will commit murder at the drop of the hat over a can of soda. I can’t justify how we should pay for decades of food, housing and medical benefits for these people, who would not hesitate to do it again if the opportunity presented itself.

Arizona should charge Loughner with three or four SEPARATE charges for first degree murder that include the death penalty. That way if the prosecutor (or the police under Sheriff Dupnik due to incompetence) mess up on the first charge, Loughner will very likely be convicted on the second or third charge and still be put to death.

Posted on March 4, 2011 at 5:01pmyou know i think this guy is gettin whats comin to him but how sad is it that no one is holding the parents accountable because while he was in high school and college they had meetings and sent letters to the parents saying your sons a nut job hes dangerous get him help but nooooo they ignored it and now there sons gonna be pushin up daisy. this could have all been avoided if personal responsibility kicked in but you cant go back and change things. god bless the victims and i pray for their families and recovery

Dupnick and the parents had to speak to each other – on every incident – and conspired to fix any charges filed – or to obstruct charges being filed = criminal conspiracy for obstruction of justice. Pay-offs are usually involved in such matters.
Loughner was calling numerous people on the phone – making DEATH THREATS – for two solid weeks – prior to his killing spree – at Giffords’ – “Congress on the Corner” event.

Mental illness – and this shooter definitely is a few bricks shy – strikes the children of even the best of parents. Lay off – they are not responsible for his actions. I thought the right was all about INDIVIDUAL and not COLLECTIVE responsibility

Posted on March 4, 2011 at 4:12pmREDEYEBLIND, I agree with you whole heartedly if there is even a sliver of doubt, but this is cut and dry, a waste of time and money (except for the lawyers). To drag these families through their heartache again is criminal all over again. Our elderly uncle was shot in the head by a 15 and 16 yr old many years ago and left in a ditch, all for $10 cash. He tried to write them a check for more but to no avail. They then killed two more people after that and injured another. One woman they killed had retired the week before to spend more time with her husband. They got their trial and were found guilty. My mother-in-law never got over having to live it again, day after day. In this case he is guilty and the families should not have to relive it.

So I became a Cat Lady. They are crazy cats, the vet. said it is because they were socialized by the dogs and me. lol They really are strange, But I wouldn’t take a milllion dollars for any one of them.

Posted on March 5, 2011 at 9:24pmI suspect that the additional charges are there so even if one gets shot down on an appeal, he’s still got 48 others with equal weight. Even if the jury tosses out 5, 10 or 20 of them, there’s enough left in the basket to finish the job.
Our small corner of the woods just had a murderer extradited from either Pennsylvania or Virginia for the cold blooded murder of a husband and wife, caught on the security camera. The murderer fought with all his might to be tried in the other state because our state has the death penalty and he didn’t want to end up with that. Oddly enough, his victims weren’t given that choice now, were they? Unfortunately for him, even though he pled guilty in the other state for another murder and got life imprisonment, it’s almost a foregone conclusion he and his girlfriend will be handed a death sentence. Somehow I don’t think the other state is going to fight too hard to have to molly-coddle him for the rest of his earthly life, do you? From what I understand, it was done this way so there would be NO chance of his EVER overturning either sentence or shortening his jail time, but with the real possibility that he could have an abbreviate life. Some are already whining that death by lethal injection is painful, but somehow I don‘t buy that as watching one’s spouse take a fatal .45 round knowing you are next would be far more painful. And that’s not even counting the pain and suffering of the other victim in the other state.
Criminal justice may be focused on the criminal, but there is point where JUSTICE needs to be served.
