Two Abortion Docs Charged With Murder After 35 Late-Term Babies Found in Freezer

WASHINGTON (The Blaze/AP) — A 16-month investigation into a botched late-term abortion conducted by two out-of-state doctors that led authorities to find 35 late-term fetuses in a Maryland clinic’s freezer has resulted in the arrest and multiple charges of murder for the two.

Dr. Steven Brigham, of Voorhees, N.J., was taken into custody Wednesday night and is being held in the Camden County jail, according to police in Elkton, Md. Authorities also arrested Dr. Nicola Riley in Salt Lake City and she is in jail in Utah. Each is awaiting an extradition hearing.

The two doctors were indicted by a grand jury for murder under the state’s viable fetus law, authorities said.

The investigation began in August 2010 after a botched procedure at Brigham’s Elkton clinic. An 18-year-old woman who was 21 weeks pregnant had her uterus ruptured and her bowel injured, and rather than call 911, Brigham and Riley drove her to a nearby hospital, where both were uncooperative and Brigham refused to give his name, authorities said.
A search of the clinic after the botched abortion revealed a freezer with 35 late-term fetuses inside, including one believed to have been aborted at 36 weeks, authorities said.
Brigham, 55, is charged with five counts of first-degree murder, five counts of second-degree murder and one count of conspiracy. Riley, 46, faces one count each of first- and second-degree murder and one conspiracy count.
The procedure authorities say was botched resulted in the murder case against Riley and three of the 11 murder charges against Brigham, prosecutors told the Cecil Whig in Elkton, Md. The other charges against Brigham relate to four other illegal abortions he performed there, prosecutors added.
Maryland is one of 38 states with a law that allows murder charges against someone accused of killing a viable fetus. The 2005 law has so far only been used for cases in which defendants were accused of assaulting or killing pregnant women.
The botched 2010 abortion led regulators to order Brigham to stop practicing medicine in Maryland without a license, and Riley’s Maryland license was suspended. Brigham’s New Jersey license was also suspended.
According to regulators, Brigham would begin abortions in New Jersey and have his patients drive themselves to Maryland to complete the procedures, taking advantage of Maryland’s more permissive laws. Brigham was not authorized to perform abortions in New Jersey after the first trimester, and regulators called his actions manipulative and deceptive.
The allegations are similar to those against Philadelphia doctor Kermit Gosnell, who faces trial in 2013 on charges that he killed seven newborn babies by having their spinal cords severed with scissors. Authorities described Gosnell’s clinic as a filthy “house of horrors,” and his wife has pleaded guilty to performing an illegal late-term abortion.
Deputy State’s Attorney Kerwin A. Miller did not immediately return a message seeking comment.
An attorney for Riley said she had not seen the indictment, but said her client had been inappropriately charged.
“We believe the charges are without legal merit,” said Sharon Krevor-Weisbaum. “We believe it’s inappropriate for her to be held without bond. She is not a flight risk and she should be released on her own recognizance.”
Krevor-Weisbaum said Riley’s legal team would comment further after they had seen the indictment.
A message left for an attorney for Brigham wasn’t immediately returned.
Anti-abortion activists hailed the arrests of Brigham and Riley.
“These two individuals are now where they belong and should be in jail for the rest of their lives,” the Rev. Frank Pavone, national director of Priests for Life, said in a statement. “Even those who believe abortion should be legal can join with us to stop the out-of-control practices of people like Brigham and Riley.”

Anyone who intentionally caused the death of these babies should be charged with 1st degree murder as they willfully and with intent took the life of another human being. There is no gray area here, these babies have heartbeats, they have brain activity, they feel pain…just like you and I!

If he actually caused harm to women, and the woman actually died as a result of his abortion then yes he should be charged. However, I doubt they can use fetuses under 21 weeks for a viability case because viability does not occur until 24 weeks, and varies with each woman and each pregnancies. Fetuses in a freezer prove nothing, and he cannot be charged with murder based on aborted fetuses, in a freezer because a fetus is not considered a human being under law.
This is the kind of thing that happened before Roe when abortion was illgal and some states limited a woman’s access to legal abortions.

It is such a sad story that others see this as a problem, our president thinks this should be okay, because he doesn’t want his daughters to be punished with a baby. I sure hope these people are prosecuted to the fullest extent of the law, this is disgusting!

We all know that for a long time in this country it was “legal” to treat black people as “property” but we’ve progressed since then. Except some still consider babies as “property”. In 2007 a 22 week old baby was born and survived. Medical advances happen every day, iin utero surgeries are performed.
If the law in Maryland allows murder charges to be levied upon the death of a viable baby, then they CAN be charged with murder. There is no reason the babies wouldn’t have survived the term of the pregnancy.
Why is it double murder when a pregnant woman is killed? Is it only considered such if the baby is over 24 weeks old? A more responsible medical professional may have advised her towards adoption instead because of the late term nature of her pregnancy. She had about 3 months left to go. Studies have shown that most young women considering abortion change their minds when given the chance to hear the baby’s heartbeat. It’s a life, it’s a baby. There’s a little person in there. Do you consider a two-year old viable?

I heard illegal abortions can be a lucrative business. Do you think these people did this to make a profit or were they truly helping poor women out for free? What does it cost now-a-days to kill your unborn baby? So, no, I don’t believe any rational person can make a convincing argument that a 36 week baby being killed is any different than medical atrocities of the past.

It should (and is, in some states) the government’s place to protect the human rights of unborn children who are incapable of protecting themselves, just as it is the government’s place to protect any individual (handicapped, etc.) who is incapable of protecting his/herself from harm.
Don’t try and sugarcoat the misguided CHOICES of irresponsible women. They are not victims of society or government- they are victims of their own accord.

If you have the guts to face the truth about abortion, I suggest that you do the research. Info about Bernard Nathanson, MD and Norma McCorvey [aka Jane Roe] are easily found on-line. Both of them played a HUGE part in getting Roe v Wade passed. When they realized the horror they had helped put in place, they both did a complete about face.
I dare you to watch Dr Nathanson’s anti-abortion videos: “Silent Scream,” etc. You Probably Won’t! Most who are pro-abortion prefer to live in the lies because they can’t face the truth. They can‘t face the truth because they’ve probably been involved in making pro-abortion choices.

Maryland’s law “alloing murder chrages against someone accused of killing a viable fetus” is a step in the right direction. If a father causes the baby in utero to die, it is called murder. It should be the same if the mother does it.
