Two House Republicans Skipped Swearing-In to Meet with Political Donors

Two Republican members of Congress have come under scrutiny after skipping the House of Representatives’ swearing in ceremony Wednesday to meet with political donors at the Capitol Visitors Center. The gaffe is gaining critical traction among liberals who point out that the U.S. Constitution requires members to be sworn in before casting votes.

On Thursday, Rep. Pete Sessions made a motion to open debate on the GOP‘s plan to repeal the Obama administration’s 2010 health care overhaul — an action that can only be taken by an official member of Congress. Sessions, however, missed Wednesday’s swearing-in ceremony while he and fellow Republican Rep. Mike Fitzpatrick attended a fundraiser.
“That wasn’t planned. It just worked out that way,” Fitzpatrick said Wednesday. According to the Bucks County Courier Times, about 500 Fitzpatrick supporters were in attendance Wednesday for “Mike Fitzpatrick’s Swearing In Ceremony.”
Sessions currently serves as chairman of the National Republican Congressional Committee, the House GOP’s campaign and fundraising organization.
Though Sessions and Fitzpatrick watched the House swearing-in ceremony on television in the Capitol Visitors Center with their hands raised, the Huffington Post points out that there is no provision in the Constitution that allows for a remote swearing-in.
Though the Huffington Post has characterized the even as a “fundraiser” and a website advertising the event said admittance was $30, Rep. Fitzpatrick’s office told The Blaze Thursday that the event was free to the public. “There was no fee to attend the event,” Fitzpatrick spokesman Darren Smith said. “Some people paid $30 for bus transportation to Washington, but the event was open to anyone who showed up, including several hundred people who drove down on their own.” By law, political fundraising is not allowed on capitol grounds.
Democrats were quick to condemn the congressmen. “Perhaps they should have read the Constitution yesterday rather than today,” a senior Democratic aide remarked to The Hill.
“You know, all this adherence to the Constitution has led to us [thinking] you should follow the Constitution,” Democratic Caucus Chairman Rep. John Larson, Conn., said.
As the err was brought to the representatives’ attention, Sessions’ spokeswoman said the situation had been rectified Thursday afternoon. “During the swearing in of the 112th Congress, Congressman Sessions stated the oath publicly in the Capitol but was not on the House floor. To ensure that all constitutional and House requirements are fulfilled, Congressman Sessions officially took the oath of office this afternoon from the House floor. Public records and votes will be adjusted accordingly,” she said.
Fitzpatrick’s office also weighed in, assuring his constituents that he, too, had been sworn-in appropriately:
“Yesterday, at the time the oath of office was administered, Congressman Fitzpatrick was in the Capitol Building meeting with constituents from Pennsylvania’s 8th Congressional District,” Fitzpatrick spokesman told HuffPo. “He took the oath of office at that time. When the oath was administered, Congressman Fitzpatrick had already signed the written oath of office provided by the Clerk of the House. Today, after speaking with the House Parliamentarian, out of an abundance of caution, Congressman Fitzpatrick was re-administered the oath of office by the Speaker. The public record will be adjusted accordingly.”

We all paid $35 to take the bus down. No other fees or donations were required. Anyone was invited to come in and participate.
A big screen TV was set up so that we could see the swearing in (we had been moved to this smaller room when the room we were supposed to be in was unexpectedly taken by someone higher up on the food chain).
When time came for the swearing in, Rep. Fitzpatrick stood in the center of the room, facing the screen and took the oath with hand raised. As a supporter I was touched that he wanted to stand among those who had supported him so that we could see him take the oath in person.
Didn’t occur to me that it might be misconstrued as arrogant, etc. Mike Fitzpatrick is an honorable man and I am sorry this is causing him problems.

Suggestion States need to make rules that limit the amount they can raise but more important States need to make rules where and when they can raise money. Posted on January 6, 2011 at 9:43pmAlways read the “fine print”. While I am a little disappointed by the added confusion, the event was NOT a fundraiser nor were those in attendance big money guys. They were supporters, likely a lot of Tea Party people, wanting to celebrate the event. Supporters came from some distance, some by bus at $30pp, others drove. Check the website.
What angers me a lot more was they intentionally left out portions of the Constitution in the “reading”, and when Congressman Aaron Schuck (R-IL) responded on Hardball that he couldn’t answer whether a portion of the healthcare bill was unconstitutional or not. He said he wasn’t a constitutional lawyer yet he took an oath to defend and uphold the Constitution! He most definitely should have been able to answer that question. I fear we have a very young RINO growing strong in the GOP leadership!! And that angers me.

Having read what the one person wrote about being there to see her rep it makes me think that with all of the tech that we now have wouldn’t it be nice to have our politicians a little closer to home when it comes to some of our bigger bills? Given all of the moronic, time-consuming and total waste of money functions they attend while in Washington wouldn‘t it be best if they would perform certain actions from their districts where we could watch them and remind them we aren’t far away when they are voting against their constituents? I guess I am just saying it would be nice if all of the members of congress would take their oath’s of office in the district they are elected from…after all, they are OUR representatives and it wouldn’t hurt to remind them that they are not voting for what they believe they are voting for what we believe.

But, technically he wasn’t officially a member of Congress. That may make him morally eligible to take refuge behind the “kings-X.” defense. Is the “kings-x” clause in the Declaration or Constitution? It’s all so confusing.
He should financially compensate everyone that incurred expenses in an attempt to witness his swearing in. He can use some of the money he was promoting at the time he should have been serving his constituents.

I kicked in a Hundred bucks to get him elected and it was my first ever contribution of money to any political campaign. That’s how important I thought this past election was. I have given vast amounts of time to the Republican Party; I’ve always thought that my time was more than enough to give to a candidate, this time I gave even more. I’m just a regular guy who earns his living working with his hand and sweat from his brow. I grow and can some of my own food and put venison in the freezer every year here in Bucks County.
Report Post »I can remember when Mike was a new congressman his first public event after swearing in was an Eagle Scout ceremony. I was in attendance that day, see Mike was an Eagle Scout too. While he was congressman before he went to every one of these ceremony’s he could, he could have sent a congratulation letter like the man he just replaced.
