TX Gov. Rick Perry Reintroduces TSA Anti-Groping Bill

Last Month, Texas was thrust into the news when a state senator introduced a bill that would make it illegal for TSA agents to conduct the agency’s enhanced pat-downs without proper cause. The Justice Department sent a scathing letter threatening action. The legislation died. But now, like Lazarus, it has risen again, thanks to TX Gov. Rick Perry.

The Houston Chronicle reports that Perry has reintroduced the bill to a special legislative session, a move that could bolster his possible 2012 candidacy even more.

“I’m very pleased that Governor Perry agreed to add this legislation to his Special Session call,” Lt. Gov. David Dewhurst told the Chronicle. “Addressing unreasonable and unlawful searches of innocent travelers by some TSA employees is an issue that affects all Texans who use air travel, and it should not wait until next Session.”

According to the Chronicle, the move comes after Perry was confronted about the issue by a constituent at a book signing:

When he got to the head of the line and told the governor he was disappointed about his lack of support for the anti-groping bill, Perry said “Woo!” and then went on to say there wasn’t enough time in the special session to round up support for the bill. “They don’t have the votes on either side,” the governor said, trying to move Strackbein along. “That’s what I told them. I said, ‘Bring me in a multitude in votes.’”

Strackbein was polite with the governor but displeased. “This is a flimsy excuse, as the bills considered in the special session and the length of the session itself are the sole prerogative of Perry to determine,” he said later. “His comment, in effect, was: ‘I’m powerless to do what I’ve been empowered to do.’”

Even if the bill once again doesn’t gain full support, the move will certainly be seen by conservatives as a sign of strength regarding an issue that fires-up many of them.

    So, you think Governor Rino Rick Perry is a good guy? Just to give you a little “heads up” on the HPV vaccine that he’s FORCING girls aged 11-12 to take only protects against 2 of the over 100 HPV types and is not only NOT a guarantee to protect them it is completely “untested” on anything other than little girls. What does that mean? That means we still don’t know the long term effect. Yep, he’s a REAL Republican! He should definitely be President! /s

    This is just a political move to get the sheeple in the Republican party to vote for him. Where was his outcry when the bill failed the first time around. He is bringing it up now even when he knows there are not enough votes to pass it. Special sessions cost taxpayers extra $$$. All I can say is the GOP had better wake up. Anyone that the Republican establishment pushes I will not support. Period! Oh by the way… the War Power Act extension/threat just expired again… All we get is silence. I guess the golf game was a success. Congress should have been on the steps of the White House calling for the impeachment of BHO. Congress has just nailed the last nail in their coffin. They are now totally useless.

    The state needs only pass legislation making strip search and body searches mandatory for TSA employees to get into the workplace. The employees of this fascist agency should have to endure worse than they hand out….after every coffee or restroom break, even admin shoud undergo cavity serches….see how they like it.
    Remember the 10th amendment?We have the powerf, here n the states, not these vile hosers in DC…..

      If federal agents are to perform their duties vigorously, however, they cannot be unduly constrained by fear of state prosecutions. Accordingly, the Supreme Court has held that the Supremacy Clause cloaks federal agents with immunity if they act reasonably in carrying out their responsibilities. See In re Neagle, 135 U.S. 1, 75, 10 S.Ct. 658, 34 L.Ed. 55 (1890). Here is some reading to explain why this law is a waste of time and paper. As it is needless and unconstitutional on its face.

    Rick Perry is an living example of how easy it is to manipulate an uneducated voting population. Let’s take a look at what Perry has brought Texans – double the State spending budget from $49 BILLION to $90 BILLION (that’s small government?), doubled the State debt and increased the debt per citizen to over $10,000, raised taxes and fees in the State, Texas has one of the worst education records in the Nation, Texans has the highest percentage of workers making minimum wage IN THE NATION. Great job there Rick!

      I live in Texas, my son went to a great public school, and we are educated. Ofcourse Texas has debt, as the last couple of years have been rough for everyone! BUT, all in all, Texas has weathered this recession much better than most. Every day, I meet people who have moved here from other states because we have such a healthy economy and are business friendly. Jobs are jobs and if you want to start nit-picking WHAT job is worth counting, then maybe we should take a closer look at Obama’s “Shovel ready jobs” that never really panned out. just saying…..

    I’ve traveled on El Al (Israeli airlines). Best security – ever. No one was groped, no nekkid scans were taken. They know what they’re doing, they’ve been dealing with terrorists for decades.

    Rep. Tom McMillin (R- Rochester Hills) introduced House Bill 4772 on June 16. The legislation would make it a misdemeanor to “intentionally touch the clothed or unclothed breast, genitalia, buttocks, or anus of that other individual except upon reasonable cause to believe that the individual may be concealing an item that is prohibited on that public property or on that mode of public transportation.”

    Anyone convicted under the law would face a $500 fine and /or 93 days in jail.

    How can anyone criticize this bill? Why is Texas the only state with some guts here? I won’t take my kids on an airplane or my wife. It just isn’t right what the TSA is doing. So unless someone takes a stand like Texas, the airlines will go under and we will loose all freedoms. Next it will be searches when crossing state lines in a car.

      I am not criticizing the bill, I am criticizing the political game. Since it is known that Bilderberg has anointed Perry with their endorsement, I question whether or not Perry will be a champion of the American cause once he is elected. Yes, the bill is WAY overdue. I had to watch my husband get a TSA pat down a few months back and was taken aback by the “thoroughness” of the search. Thank God my kids weren’t subjected to it.

    It‘s too bad tat a State Governor has to do what the members of the Congress don’t have the guts to do. It is hignh time for the 28th ad 29th ammendments to the Constitution to be passed.

    Constitution!

    Congress shall make no law that applies to the citizens of the

    United States that does not apply equally the Senators and /or

    House of Representatives membership; Congress shall make no

    law that applies to the Senators and/or Representatives

    that does nor equally apply to the citizens of the

    United States.

    Proposed 29th Amendment to the

    Constitution!

    Service in both houses of Congress shall be strictly

    limited to 2 (two) terms consecutively. They may become

    eligible to be re-elected after being out of Congress

    for 1 (ONE) term. Furthermore No Representative or Senator

    will collect full congressional pay for service after they retire or

    are voted out. Instead, they will receive a stipend

    for service, the amount of which will be determined and

    APPROVED by the vote of the American People not the

    members of the Congress themselves.

    Service in the House or Senate should be an HONOR and

    not a path to self enrichment.

    Let’s get rid of he Congressional zoo!!!!

      I’d agree, except I wouldn’t allow them to come back after sitting out a term. Two terms and you’re done.
      NO PENSIONS – PERIOD – If they spent 40 years doing this, they would deserve a pension – if they only spend 4-8 years they don’t deserve a pension for it. So, with term limits they need no pension. They can get a 401K like everybody else.
      They can buy their own health insurance like everybody else, too. No group plan, either.
      They can live like almost ALL AMERICANS – like their constituents – like the people they supposedly represent – the more we can enforce their living like us, the more they will indeed represent us.
      They are our SERVANTS; they work FOR us.
      While you’re amending the Constitution, I want campaign finance reform – independent govt agency collects all donations – limit $100 per voter per office per cycle. That agency will combine the total donations into a single check and pay the candidates weekly (1check=anonymity) $100 limit gives ‘regular’ guys the exact same say in the process as the rich man. Also, NO political action committees (PACs), and NO donations from clubs, organizations, corpporations, etc. NO donations from non-citizens or foreign entities. Small donations also force candidates to talk to everyone, not just to $5000.00/plate pals or $100k donors buying jobs from obama.

      Any elected official that is found to have broken the law while in service to the people of the United States of America shall immediately forfeit any present and future taxpayer benefits such as pay, pensions, healthcare, secret service protection, etc. No more sanctions, slaps on the wrist, or joking about elected officials abusing their office and power.

That was said in response to President Jackass Jackson and Congress because of the “Indian Removal Act”, and subsequent march down the “trail of tears”. Mr. Crockett promised the native Americans this wouldn’t happen and the Supreme court agreed. Unfortunately, President Jackass Jackson ignored the Supreme court and did it anyway.

      Jackson’s nickname is also how the Democrat party got their mascot, the jackass. They were jackasses then and have been every since. From their opposition to the abolition of slavery to the creation of the KKK.

      Somehow these facts are no longer taught in public schools. Talk about revisionist history.

      @TCS; dont forget that Lincoln was also for not abolishing slavery in the south as outlined by his first inaugural address and by his support of the Corwin Amendment. It was also outlined in the Republican party platform of1860. Lincoln did threaten the South if they failed to pay taxes and imposts however.

      I also support Gov. Perry in this legistlation. I personally am a parent of a 2 yr old daughter, and I would be horrified if some TSA agent tried to conduct an enhanced pat down with her. I would in all honesty end up in jail for punching the agent.

      Also, the day that Texas once again becomes the “Republic of Texas” is the same day that I and my family will be applying for a green card.

      @TOMFERARRI Tom, in fact you can still fly our of major airports like La Guardia that do not have the machines or the pat downs, so the TSA is lying when they say these are absolutely necessary. Okay, gotta have them in TX but apparantly terrorists would never think of just using a NY airport instead. This is government thinking in action.

      Question for those who’ve advocated Texas succession….
      Putting aside all the legal mumbo-jumbo regarding “can a state succeed from the US?”….

      What exactly could the Federal government do if a State just did it??

      Some obvious answers:
      1) Cut off Federal funding for whatever.. (not necessarily a bad thing)

      2) Refuse to acknowledge the State as a new nation and continue treating the state as part of the US

      3) Impose bans, tariffs, restrictions on trade and commerce between the new nation and the US (legally could they be any different than those already in place with other nations?)

      But, would or could the Federal government go so far as to declare war on the State because the State declared itself a new nation?? And if they did, how would they justify it? Could the Federal government declare citizens of the new nation Traitors to the US?

      Another interesting consideration: if a State did succeed, would it‘s citizens be eligible for reimbursement of monies they’ve paid into Federal programs…ie: Social Security?

      Not saying succession is a bad idea….just wondering

      MidWestMom, all good questions. If the US continues its decline into Socialism, and eventually Communism, I will be up for the fight. Our freedom is worth any struggle.

      I would hate to the thing the US government would declare war and roll tanks into Texas, but it’s a possibility. Especially once the realize the amount of tax revenue they would lose. It may be like the situation which exists between China and Taiwan.

      There’s no way they would refund social security, or anything else. I already consider the thousands I’ve give in FICO taxes to be lost anyway. The Federal government has already stolen that trust fund and replaced the money with worthless IOUs. It’s just one huge Ponzi Scheme.

      I love the tbagger logic, they love the country enough to destroy it. Of course Texas will have to deal with its 25 Billion dollar debt and the lose of all the government jobs that employ a large percentage of the Texans, I give it a month before Texas looks like any other third world nation.

      By the way this action is on its face unconstitutional, supremacy clause prevents any state from outlawing the duties of a federal employee/agent. But Tbaggers should know this, they love their constitution.

      encinom, if the Federal government would follow the constitution, particularly the tenth amendment, there would be no talks of secession. If we weren’t sending money to the Feds for them to waste, or give back to us with strings attached, we would be much better off and would easily be able to wipe out our debt. A balanced-budget amendment to our state constitution would be a prevent further debt.

      TEA ****** logic, as you call it is far better than Communist or Socialist logic.

      In fiscal 2009, the IRS collected about $163 billion from Texans and the state received about $224 billion, for a net gain of $61 billion. Federal spending in Texas also exceeded tax payments in 2008 by $8 billion.

      The Job creation under Perry is a myth (it is mostly minmum wage jobs), with the trend in Texas of growing unemployment and opposed the rest of the nations slow increases.

      Like a typical Texans you and the rest of the state are great at talking a good game, but fail to show the actual results to yourselves up.

      Also, again, the action of the Texas legislature is unconstitutional on its face, Supremacy clause. THe TSA has 200 years of legal precedants behind it.

      encinom, I live here. I can personally attest to the state’s overall success. For example, my home value has only increased over the past five years despite the housing crash. If you’re so against Texas, don’t come here.

      The Supremacy clause only refers to the specific powers listed in the Constitution. Remember, the federal government didn’t create the states – WE THE PEOPLE (i.e. the STATES) created IT! We didn‘t give them the authority to do most of what they’re doing today, although we’ve allowed them to get away with it. The truth is, if it isn‘t listed in the Constitution the federal government isn’t authorized to DO IT. Just because they‘ve been getting away with it for generations now doesn’t make it legal!!

      The issue is inter-state commerce, and the safety there of. Airports are junctions points for Inter-state and inter-national commerce (both fully under the control of the Federal Government).

      If federal agents are to perform their duties vigorously, however, they cannot be unduly constrained by fear of state prosecutions. Accordingly, the Supreme Court has held that the Supremacy Clause cloaks federal agents with immunity if they act reasonably in carrying out their responsibilities. See In re Neagle, 135 U.S. 1, 75, 10 S.Ct. 658, 34 L.Ed. 55 (1890). Here is some reading to explain why this law is a waste of time and paper. As it is needless and unconstitutional on its face.
