TX School District Sued for Including Prayer at Graduation

TX School District Sued for Including Prayer at GraduationA national group fighting for separation of church and state has filed a lawsuit against a local Texas school district because it has refused to remove prayer from its graduation ceremony.

Americans United for Separation of Church and State filed suit against the Medina Valley Independent School District (near San Antonio) on Friday on behalf of a local family. The group is upset that the June 4 ceremony will include a student-led invocation and benediction. But according to the district, the two planned statements by students do not constitute official school positions and those students have a right to free speech.

“A disclaimer is printed in each graduation program that notes the content of each student speaker’s message is the private expression of the individual student and does not reflect the endorsement of the district,” school board president Roland Ruiz told the San Antonio Express.

Christa and Danny Schultz, the family behind the suit, and the Americans United group allege, however, that the school is breaking the law:

“Public schools can’t require students to take part in religious worship as the price of attending their graduation,” the Rev. Barry W. Lynn, executive director of Americans United, said in a statement. “This is settled law, and the district needs to stop resisting it.”

In October 2010, the couple’s lawyers wrote to district officials asking them to stop plans for public prayers during school events. According to the release, officials didn’t respond to the request.

The Schultzes attended the graduation of a family friend in 2008, “where they were exposed to unwelcome prayers,” the lawsuit stated, and it happened again in 2009 when their eldest child graduated.

The son said he might not attend the ceremony if prayers are included, according to the release.

In a statement on the group’s website, it refers to two Supreme Court cases as evidence. In the the first, Lee vs. Weisman, the justices ruled that involving clergy at public school graduations was a violation of the Constitution’s Establishment Clause. In the second case, Santa Fe Independent School District vs. Doe, the justices concluded that student-led prayers over the PA system before football games also violated the Establishment Clause because of perceived government endorsement.

But the district isn’t backing down, according to Ruiz.

“It is sad that someone would choose the commencement exercises of the 50th anniversary of our school district as a forum for stirring political debate that threatens to needlessly cast a shadow of controversy over the pinnacle event of the class of 2011,” he said.

      What do mean God before government? What are you? A THEOCRAT, GEEEEZZZ. Organized religion is a curse on mankind, carried out by mostly con artists with the gift of gab. These con artists take advantage of otherwise rational people and convince them of a bunch of nonsense. Religious Fundamentalism comes in all flavors. It does not matter if it is Christian, Muslim, Judaism, or even Scientology; it’s a load of nonsense that is centered around fear, and division of the people, all in order to con you out of your hard earned money.

    We have prayer at many school functions, including graduation. There is always a presentation of The Lord’s Prayer by Native American girls in traditional dress as well. It’s touching and beautiful. Also bold. Someday somebody is gonna try to make something of it and we’ll have to school them.

      While Coyners introduces a bill to protect muslims against discrimination — prayer continues to a crime for Americans — civil disobedience is the answer — when hundreds of people everywhere show up and stand up at these events and pray — there will be nothing they can do — Americans everywhere need to stand against these activist wacko judges and exercise our rights — loudly.

    If they don’t want to hear the prayer, they have several options. 1. Don’t go to the graduation. 2. Put cotton in their ears or wear earplugs or earmuffs so their delicate sensibilities aren’t offended 3. Think about something else while the prayer is occuring – like reciting their times tables or the liberal talking points to themselves.

      No, you have it wrong, If the people praying want others to hear the prayer, they should go to an appropriate forum. A graduation ceremony where public funds have been used is the wrong place. Why can’t they pray silently? Can’t Jebus hear those prayers?

      @angelcat: It amazes me that people get upset about LOCAL communities opting to celebrate graduation or any occasion in the style of their forefathers. It is NO ONE‘s business how this town or city wants to conduct it’s graduation ceremony. For every school that allows the individual expression of faith in God, there is an equal and opposing location somewhere that has chosen to be PC. Stupid, stupid people! MIND YOUR OWN BUSINESS and let others live as they wish. If you don‘t live in this town and don’t pay taxes here, then you have no voice in what goes on there. If there is a separation of God and state as so many of these lefties proclaim, them explain to me why their president has an OFFICIAL committee for faith/religion in his administration!!!

    It is high time that the Christian community stand up for the cause of Christ by offering our public prayer to Him. We must not lose this right, to do so will marginalize Christianity and destroy its exclusiveness. Once these rights of speech, prayer, and witnessing are removed then it is a small step to persecution. Rick Perry has the power to start investigations into these atheist movements (ACLU) and tie them up in court and litigation. They are afraid of having to turn over their secrets.       I can think of a lot of “tacky” stuff I see everyday everywhere … Tacky is not prohibited in the Constitution, so you can be as tacky as you want. Freedom of Speech is “Required” … Freedom of Religion is “Required”.

      Let the kids pray for God’s sake, then you can spit and call them “Tacky CUCKOOS” and be on your way … You don’t have to sue them in an effort to stifle them. Here we are talking about “kids” … maybe one day they will grow up and see the error of their ways …

    I believe we’re long past the point where we let the courts, ACLU (Anti-Christian Lawyers Union), Americans United for Separation of Church and State, and others like them legislate from the bench or get their way through intimidation. I applaud the school district for taking a stand and hope they don’t back down. There needs to be more of that.

    There is no right not to be offended. It’s time we stop letting this minority of nitpickers bully everyone into submission and start some good old civil disobedience. Can you imagine that if Martin Luther King and other black leaders during the civil rights movement would have cowtowed to “legalities” and “cease and desist orders”? We’d probably still be in the 1950s. It were laws and “so-called rules” they ignored to further their cause.

    We the people need to return this country to what it was and not let those who would destroy it have their way.

      The courts have already ruled that if prayers are student initiated and led and not required by the school district, they are LEGAL. If this idiot dosen’t want to attend graduation, MAIL him his diploma. With the speed of the mails, he might get it in time in order to enter a far left university like Berkley.

There are those here in the U.S. trying to use gov’t to silence us, and we have a RIGHT to practice our religion.       I say that everything the ACLU and the Freedom from Religion groups do is completely unconstitutional. The net effect is that the gov’t is prohibiting the free exercise of religion as guaranteed in the first amendment and is in fact prmoting the “religion” of atheism. Everything they do prohibits our right to free exercise of religion and speech and assembly. They always want to focus on the first part of the first line of the 1st amendment and forget about the 2nd part against prohibition

It’s time for all freedom loving Americans to take a stand and tell these clowns to take a hike, which includes these activist judges and their so-called illegal rulings. I still contend that civil disobedience of these rulings are the answer. Ignore them as there is more of us than them. Using a page out of their book against them would be real fun. When they want to enforce the immigration issues of all the illegal persons assaulting our sovereignty, maybe we might look at your crummy rulings. We have got to quite catering to an extreme minority whose only wish is to erode our constitution.

      I pray where I am led of the Spirit of GOD to do so. If arrested or sued I’ll pray in court, just to piss off the actor in the black robe.
      I‘m done behaving like I’m part of this foul governments country, they are not Americas government, nor Americas laws, no, Lucifer rules the governing bodies and I’ll not serve him or his minions.
      Sue me all you want, I’ve purposefully put all my assets away from me so no one can touch them, I‘ll pray where I please and you’ll have to end my life to end the prayers. In fact I plan to ask GOD to make me a prayer warrior, to go to where the say it’s disallowed and to pray loudly and boldly in their faces daily. My GOD and I are fed up.

      exception of the College of Philadelphia in PA was not legally associated with the local church.The Old Deluder Satan Law in Conn. required communities to teach youth to read the Bible in the original Greek
      and Latin texts so they would not be deceived by wicked adults.The Northwest Ordinance-twice passed by Congress included Article III which declared “Religion,Morality ,and knowledge being necessary to good government and the happiness of mankind schools and the means of education shall forever be encouraged.” it was not until the revisions of Horace Mann after the Civil War that our public schools began to be encouraged to divorce Religion and Morality from the curricula -but it was not until 1940 Cantwell v. Conn. and again in 1947 when Roosevelts Court decided Everson v. Board of Education that we began down this talus slope to perdition.

      Regarding what Jesus said about keeping prayers private…
      Jesus pointed out that the Sadducees were praying on street corners and making a show of it. They were not praying for the sake of praying, they were praying to show the Pharisees they were better than them.
      This is not the same as leading a group in prayer.

      I say, go ahead and pray. What can they do to stop you?

      The solution could be as simple as giving the ones who are offended by prayer the option to leave during the prayer or by giving them ear plugs. Why should Christian students be denied prayer by the few non believers. I mean,, it‘s not like we’re blowing smoke up their nostrils, although they just might enjoy a burning fire for eternity. At least they will be staying warm.
