U.S. Court: Alabama Can Detain Suspected Illegal Aliens

ATLANTA (AP) — A federal appeals court issued a ruling Friday that temporarily blocked parts of an Alabama law requiring schools to check the immigration status of students but let stand a provision that allows police to detain immigrants that are suspected of being in the country illegally.

The 11th U.S. Circuit Court of Appeals issued the order after the Justice Department challenged what is considered the toughest immigration law in the nation. The opinion also blocked a part of the law that makes it a crime for immigrants to not have proper documentation.

A final decision on the law won’t be made for months to allow time for more arguments.

Since a federal judge upheld much of the law in late September, many frightened Hispanics have been driven away from Alabama, fearing they could be arrested or targeted by police. Construction workers, landscapers and field hands have stopped showing up for work, and large numbers of Hispanic students have been absent from public schools.

To cope with the labor shortage, Alabama agriculture commissioner John McMillan at one point suggested farmers should consider hiring inmates in the state’s work-release program.

It’s not clear exactly how many Hispanics have fled the state. Earlier this week, many skipped work to protest the law, shuttering or scaling back operations at chicken plants, Mexican restaurants and other businesses.

Immigration has become a hot-button issue in Alabama over the past decade as the Hispanic population has grown by 145 percent to about 185,600 people, most of them of Mexican origin. The Hispanic population represents about 4 percent of the state’s 4.7 million people, but some counties in north Alabama have large Spanish-speaking communities and schools where most of the students are Hispanic.

In addition to the Obama administration, a coalition of advocacy groups also filed a separate appeal of the law, claiming it has thrown Alabama into “chaos.”

Alabama’s law was considered by both opponents and supporters to be stricter than similar laws enacted in Arizona, Utah, Indiana and Georgia. Federal judges in those states have blocked all or parts of those measures.

Arizona Gov. Jan Brewer earlier this year asked the U.S. Supreme Court to resolve the legal fight over her state’s tough immigration law.

The Justice Department has called the Alabama law a “sweeping new state regime” and urged the appeals court to forbid states from creating a patchwork of immigration policies. The agency also said the law could strain diplomatic relations with Latin American countries, who have warned the law could impact millions of workers, tourists and students in the U.S.

The law, it said, turns illegal immigrants into a “unique class who cannot lawfully obtain housing, enforce a contract, or send their children to school without fear that enrollment will be used as a tool to seek to detain and remove them and their family members.”

“Other states and their citizens are poorly served by the Alabama policy, which seeks to drive aliens from Alabama rather than achieve cooperation with the federal government to resolve a national problem,” the attorneys have said in court documents.

State Republicans have long sought to clamp down on illegal immigration and passed the law earlier this year after gaining control of the Legislature for the first time since Reconstruction. Alabama Gov. Robert Bentley signed the measure, saying it was crucial to protect the jobs of legal residents amid the tough economy and high unemployment.

      There is one reason and one reason only that this pro-black, anti-white Justice Department would not want to tighten up on immigration laws and that reason is because Eric Holder and Barack Obama want to water down the white power structure in this country with non-whites.

      The fools stupidly believe wresting control from whites is going to give blacks more power, unable to understand that the influx of illegals in this country is reducing black economic power and causing many of them to accept public assistance which will drive them further downward.

      Or do they despise whites so greatly they feel driving more blacks to poverty is a small price to pay for watering down the population?

      The Alabama law makes illegal aliens fear they will be detained and deported if they try to find housing or education. Well, they are here illegally should we make them comfortable while they violate our laws? We pay for public school and they snuck in illegally. Soooo frustrating!!!!!!

      It’s worked so well all of those times too–they didn’t just come right back after we spent a fortune. You people make me laugh; you know that Adam Smith believed that in order for a free market system of economics to be successful at finding the most efficient production price level, labor (indeed all markets for factor inputs) would have to be international…in other words, freedom of labor movement was a constraint assumed by Smith to be necessary in order for the market to correctly function and find the most efficient price to produce-consume at for a given economic good.

      Adam Smith? of wealth of nations fame? When he wrote that statement…in 1776….the government didn’t pay for food, housing, and medical care for imagrants. . Those who didn’t work….didn’t eat. Therefore, the freedom of laber movement would have worked back then. The product or service they provided would have been of great value to the society in which they moved. Today however, the cost to society is far greater than the value received. Many of his theories don’t hold up in todays world..

      not deportation. Besides, its the parents who PLANNED to have them in America knowing they were here illegally. These children are American citizens, but their parents are not. They cannot care for themselves. Instead of tearing families apart let the parents take care of them in their native country until they are 18, then they can choose for themselves if they want to return to America.

See how the Liberals use the “family/children” as weapons to prove how evil and baby eating the Conservatives are? Just because your born here I DO NOT believe grants you instant citizenship! Yeah, I served 20 years of faithful and honest military service! I know what the current law states but that LAW was MADE in regards to freed slaves not so that China can send hundreds of due women to America to MAKE US Citizens or the Woman from the Phillipines suing so here baby born over international waters gets a US Citizenship!

      Read the Constitution…Born in the USA does not make you a Citizen, you must be “Under The Jurisdiction” (here legally) of the US to be a Citizen. We need to make this absolutely clear to stop illegals from coming here only to have a baby and then cry about being sent back.

      If they are anchor babes, give them a choice, ex-pat or orphan. But I think if you force them out til 18, they will just return with a chip on their shoulder. Maybe give their illegal gardians a green card (along with fines commensurate with the length of residency) but do this only after removing from the 14th amendment the anchor baby option.

They are taught, not necessarily to hate Americans, but definitely animosity toward us even though they are living in our country, using our resources, etc. Not so much the ones who are here legally and have been here for a few generations, just the illegal ones.

      I like that. That way we do not have to take their entire families unless they become legal citizens as well. I hate the thought of any child suffering but as a country that is unable to take care of its own right now we have to enforce the law. There are children and families worldwide that are suffering and it is impossible to allow all of them to come in. Our culture should not have to change to suit the immigrants, it is their choice to come here . By doing so they should adapt to the laws and customs here, if not, they should go back to where ever it is that they came from. As far as making them enlist in our military, I am not sure, but they should be required to have a background check and to get employment.Then they would go through the same process to become a citizen as the rest of those who are here LEGALLY. They must speak english if they want to stay. No special treatment or government assistance.

    too bad the ‘anchor babies’ are caught in the middle of this but the line has to be drawn somewhere. I think the illegals AND their children should be sent back to whatever country (mostly Mehico) and the children who were born here have an option to return when they turn 18. Maybe make them serve our country for four years or something to pay for their own education as well.

    I’m glad that at least one state has a law like this, yeah it takes years and money but come in legally we want you here the right way, don’t come in and take jobs from those of us who are here legally (Born/naturalized) and for those kid’s born to illegal immagrants your parents get caught that sucks but not your fault they hopped the border to have a baby here rather than in their home country. You can stay you folks gotta go.

    I don’t care what the libs say our laws have to stand or we lose who we are as a nation, if our laws mean nothing then what did the founders fight for 200 years ago? not to go runing back into the arms of an appeasement government that would throw those of us here legally under the bus

    Why isn’t this a federal law ? As far as the discrimination,so what? I feel discriminated against every time I bid on a job and don’t get it because some illegals do the job for a fraction of the going rate,I bet our number of unemployed is about the same as the number of illegals working here
