U.S. Army Silences Catholic Chaplains From Speaking out Against Obama Admin Ruling

Last Sunday, Catholic priests across the country read an open letter to their parishioners. It condemned the Department of Health and Human Services’ decision to force religious employers to cover the cost of contraception and abortion-inducing drugs in its employees’ health-care coverage. The letter argued that the faithful could not and must not in good conscience comply with the HHS’ “unjust law.”
However, Catholic chaplains in the U.S. Army were “forbidden” from reading this communication.
After Archbishop Timothy Broglio, who is in charge of Catholic military chaplains, sent out the note to be read at Sunday Mass, the Army’s Office of the Chief of Chaplains sent out another communication “forbidding Catholic priests to read the letter, in part because it seemed to encourage civil disobedience, and could be read as seditious against the Commander-in-Chief,” Business Insider‘s Michael Dougherty reports.
U.S. Army officials felt that “the letter contained language that might be misunderstood in a military setting,” according to Kathryn Jean Lopez of National Review Online, and they asked that it not be read from the pulpit.
“Instead, the letter would have been referenced in announcements and made available in the back of the chapel for the faithful, if they wished, as they departed after the Mass,” Lopez writes.
Despite these instructions, some U.S. Army chaplains read it anyway. Business Insider reports:
More than one Catholic chaplain who spoke to us off the record confirmed that many chaplains disobeyed this instruction and read the letter anyway. Others sought further instructions from their Archbishop.
Some reasoned that because the letter was not “politically driven,“ and that it only sought to reaffirm Catholic teachings on sexual ethics and the ”sanctity of life,” they would risk punishment and disobey instructions, one source involved told The Blaze.
Anticipating repercussions for reading the letter, a confidential email was sent to the chaplains instructing them to contact the Military Archdiocesan lawyer in case of more interference or any punishment (via BI):
The Archdiocese believes that any attempt to keep a chaplain from freely teaching and preaching the Catholic faith, for which you were endorsed, is a violation of the First Amendment of the Constitution. If any of you are in any way punished or slated for punitive action, I ask that you kindly call our Archdiocesan Attorney, John L. Schlageter, Esq….he will immediately place you into contact with a Religious Freedom Law Firm that will be most willing to take your case free of charge.
Here is the Archdiocese for Military Services account of what happened regarding the letter, its public reading, and a newly-edited, government-approved version to be released (via National Review Online):
On Thursday, January 26, Archbishop Broglio emailed a pastoral letter to Catholic military chaplains with instructions that it be read from the pulpit at Sunday Masses the following weekend in all military chapels. The letter calls on Catholics to resist the policy initiative, recently affirmed by the United States Department of Health and Human Services, for federally mandated health insurance covering sterilization, abortifacients and contraception, because it represents a violation of the freedom of religion recognized by the U.S. Constitution.
The Army’s Office of the Chief of Chaplains subsequently sent an email to senior chaplains advising them that the Archbishop’s letter was not coordinated with that office and asked that it not be read from the pulpit. The Chief’s office directed that the letter was to be mentioned in the Mass announcements and distributed in printed form in the back of the chapel.
Archbishop Broglio and the Archdiocese stand firm in the belief, based on legal precedent, that such a directive from the Army constituted a violation of his Constitutionally-protected right of free speech and the free exercise of religion, as well as those same rights of all military chaplains and their congregants.
Following a discussion between Archbishop Broglio and the Secretary of the Army, The Honorable John McHugh, it was agreed that it was a mistake to stop the reading of the Archbishop’s letter. Additionally, the line: “We cannot — we will not — comply with this unjust law” was removed by Archbishop Broglio at the suggestion of Secretary McHugh over the concern that it could potentially be misunderstood as a call to civil disobedience.
The AMS did not receive any objections to the reading of Archbishop Broglio’s statement from the other branches of service.
Update: The decision to forbid U.S. Army chaplains from reading the letter is an odd one. This is not the first time that the question of religious liberty and freedom of speech in the military has been brought up.
In fact, the Pentagon was once sued by The Becket Fund for having issued gag orders against a Catholic priest and Jewish rabbi for being vocal supporters of H.R. 1122 (the Partial-Birth Abortion Ban Act of 1997).
The Becket Fund argued in court that the gag order “violated their First Amendment rights under the Free Exercise Clause, the Free Speech Clause, and the Religious Freedom Restoration Act, 42 U.S.C. 2000bb, et. seq,” according to Free Preach.
The court agreed with The Becket Fund that the gag order was unconstitutional:
What we have here is the government‘s attempt to override the Constitution and the laws of the land by a directive that clearly interferes with military chaplains’ free exercise and free speech rights, as well as those of their congregants. 962 F. Supp. at 165.
Free Preach writes:
In particular, the court rejected all of the arguments advanced by the government to support their censorship of speech from the pulpit. For example, the government argued that it was not an important part of the plaintiffs’ religion to urge their congregations to contact Congress about particular moral or political issues. The court soundly rejected that argument, holding that it was not the role of the government “to determine whether encouraging parishioners to contact Congress [about a particular issue like] the Partial Birth Abortion Ban Act is an ‘important component’ of the [plaintiffs'] faiths.” Id. at 161.
Moreover, the court held that “[e]ncouraging parishioners to contact Congress“ about legislation addressing moral issues related to religious faith ”appears to be no less important to the [plaintiffs' faith] than other religiously-motivated activity courts have held to be important enough to a religion such that its prohibition amounts to a substantial burden.” Id.
The government then argued that the chaplains’ contemplated speech was “not religious” but merely “political.” The court rejected this argument also, holding that “it is not the role of this Court to draw fine distinctions between degrees of religious speech and to hold that religious speech is protected but religious speech with so-called political overtones is not.” Id. at 164.
Finally, the court held that any interests advanced by the government for their censorship policy were “outweighed by the…chaplains’ right to autonomy in determining the religious content of their sermons.” Id. at 162.
It is imperative to note that these same interests would likely be asserted by the government in the private freedom-to-preach context as well, and similar reasoning to reject such would apply. To summarize the holding: The State cannot interfere with the right of religious leaders to preach from the pulpit on political issues, even if those ministers are in the military [emphasis added].
Now, all that being said, and the legal and constitutional precedent having been set, the question is this: on what grounds did the U.S. Army have the right to forbid those chaplains from reading an open letter from the Archbishop during Sunday Mass?
Update II: The Secretary of the Army has approved the reading of the letter:

That order is no different than ordering that a Chaplin must carry and use a rife in combat. What kind of American Commander in Chief would issue or allow such an order to be issued. I say this as a career military man: I am only honor bound and legally required to obey orders that are not in direct contradiction to the US Constitution. I swore an oath that was argued and debated before it was written into the Constitution. I swear to uphold and defend the Constitution of the United States against all enemies, foreign and domestic. We’ve been right here and watched it. We know sharia is being implemented in the Military. I’ve watched it right here. Leadership “IS” at a moral impasse. It can‘t find the words to describe it’s support for our sovereignty to an outside sovereign entity (islam) without sounding discriminatory. But, that‘s what making a ’choice’ “IS” all about. Discrimination. It‘s a ’prejudice’ toward the other.
Without clear convictions of individual character based in morality, one can’t make the choice necessary to prepare oneself adequately for assault. And preparation is everything.

You do not hold authority over religion and especially ones eternal obligations. You are trying to dictate ones results before God after this life. Should you silence that of what one might hear free speech, particularly when it concerns and might affect ones eternal outcome. How many things does a soldier hear with his own ears during their service that provokes them disobey their commanders? I am sure that is quite often, yet the soldier still has a choice of good conscience to react appropriately and of not, then a trial should be the judge of that. You our government, (a servant to The People) need to make a choice, either put God back in all parts of our governments, or fully take God out. Do not continue to be lukewarm as stated in Revelations. I would rather have God in all parts of our government, since He is clearly the only one to be trusted with His perfect moral laws and guidelines.

Mitt talked about it in his speech on the night of the Florida primaries. He also said he would fight it and make sure anything the government has done against religion would be overturned and he would protect the freedom of religion.

The LDS faith does not preach that God was like man. Instead, we are capable of becoming more like Him by accepting the fullness of the Gospel and grace of Christ. We wouldn’t become God or supersede him. Instead, look at the passages in the Bible that highlight this even in His own words. The passages highlight that we are subservient to him forever and always.

Point your arrow where it belongs and that is the liberal leadership in the US Army. Let’s face it they get the same education the rest of the elite get. You are wrong about one thing. Obama IS very much behind this. Abortion and all its corollaries are an integral part of HIS agenda. Obama didn’t legalize abortion, but he wants to pull all the stops and turn America (and the world) into an abortion machine. Did you read the original letter? Obamacare will be FORCED on our military, unless they are willing to pay a hefty fine. That’s because Obamacare is extending its tentacles to all health insurers. Eventually, our health care will evolve into a single-payer system, as intended. In the end, everyone will be forced to comply with Obamacare abortion policies. And forget the courts. There won’t be a conservative court left in this country when Obama consolidates power.

Chaplains are given greater levity in freedom of speech than everyone else because it was understood that by the very nature of the Fiorst Amendment, what Chaplains do is covered as both free speech and the free excercise of religion.
A Chaplain friend of mine (active Army) has said (specifically regarding the DADT repeal) that while the Administration technically has the right to order them limit their speech, the imposition of something like that would cause a mass resignation commissions of Chaplain, effectively wiping the Chaplains Corps out of existence.
I asked if he thought Obama would actually think that was a good think and he declined to answer the question, which told me his answer.
He then said that he felt that some within the remnant of the Chaplain Corps would file and win a Federal First Amendment case, and it would all blow over.
Applying hat here, I suspect nothing will come of it. Chaplains are sworn first to God. That’s been the understanding for 230 years, and will probably remain the case for some time to come.

How can this letter informing American soldiers about agovernment mandate be remotely seditious?

The Army had no business restricting the very rights that those wearing the uniform are sworn to uphold. Just imagine if Obama lost the military’s support. If a President loses the military’s respect and support, he will be completely powerless. Civil disobedience? Most soldiers would never betray their nation or the oath they took, but if this President continues to dictate in this illegal manner, And he will continue to do so. I wonder what most military men and women will do? Will they continue to follow orders from Obama or will they follow their conscience?

I saw the lib theology becoming moreso in my teen years and had a profound distaste for it. I understood the basis for it, but did not think that priests and nuns should be reaffirming socialism or marxism nations in order to make nice with the unstable and dangerous leadership especially in Central America. Some of us knew this was coming along time ago. And not all Catholics only show up to mass once a week. We go to chapel alone and pray. Some say the rosary faithfully (not I, but I know a lot of older praying grandmas who do). We read the Bible before bed faithfully. We ask for help from this terrible man ruining and now dictating to a religious organization as to how to run and pay for healthcare, birth control, etc. I’m sure there are a few Baptists, Protestants, and Lutherans who only show up to church once a week who I too hope will vote out this nightmare in office. Obama wants a Holy War. He would be wise, to not dictate to the Vatican. They’ve been around longer than most nations on earth. Right or wrong, Obama should not *iss off the Pope. The late John Paul the Second would have publically denounced Obama from the Vatican window. That Polish Pope was a tough, anti-commie servant of God. Miss you John Paul II!!!

So help me God.” The Constitution, as mentioned first, trumps all others on the list.

Unless there is a standing order that forces all such laws to be considered as coming from the Criminal-in-Chief, they can ignore it as violating their right to practice their religion without interference from the government.

Posted on February 4, 2012 at 12:25amNo need to resign commissions when the Archbishop to the Military can pull every last priest off active duty/out of the reserves w/the stroke of a pen. Every ecclesiastical endorser has the power to pull one or all endorsed chaplains. Imagine the mess if the Archbishop did that! You think they would go into combat w/o their unit chaplain — no way…not the Army, not the Marines. Some ships in the Navy depend on Lay Leaders since the unit is too small for a detailed chaplain.
Here is how the military chaplaincy works. A chaplain candidate must have a bachelors degree plus a Master of Divinity degree (or its 90 hour graduate equivalent — Mormons and muslims do not have seminaries). The candidate must be ordained to the priesthood or equivalent (non-liturgicals do not call their ministers priests but pastors, etc). Then the candidate must have written approval fm his/her denomination to become a chaplain (reserve or active duty). Each denomination has different requirements usually related to pastoral experience or advanced clinical pastoral experience.
Then the candidate applies to the service of his/her choice to see if there is a vacancy. Most of the services have set numbers of Rabbis, Catholics, Liturgical, and Non-liturgical to fill. Those numbers correspond to manning documents. For instance, a typical aircraft carrier has a priest and two Protestants. The embarked air wing may also bring a chaplain. Laymen fill in gaps – Jews, Orthodox, muslim, etc.

When I was in, our chief did not want us working anywhere near families in crisis (family advocacy/domestic violence). I ask you, where is the grace of God needed most? We just did not have sites like this at the time to illustrate the left for what it is. BTW, Clinton stopped us from having a bible visible on our desks, and such things as no bible study classes held by dependent wives gathering in military quarters with their children in attendance. It was really that crazy back then too.
