U.S. Sues Alabama Over Immigration Law

WASHINGTON (The Blaze/AP) — The Obama administration is challenging Alabama’s new immigration law that allows police to detain people they suspect of being illegal immigrants after a traffic stop.
The Justice Department says the Alabama law conflicts with federal law and undermines federal immigration priorities.
In a lawsuit filed in federal court in Alabama, the government says the state law expands the opportunities for Alabama police to push immigrants toward incarceration for various new immigration crimes.
The Justice Department says a state cannot set its own immigration policy and cannot pass laws that conflict with federal immigration laws.
The department quoted Birmingham police chief A.C. Roper as saying the law would divert scarce resources from local priorities to immigration enforcement.
Last year, the department obtained a preliminary injunction against an Arizona immigration law.

If you can not provide ID, they can detain you until you are identified. Whether it be through finger prints or having a witness come down and ID you. I don’t agree with this law, as it doesn’t actually require the suspect to have broken the law, it is directed at the idea that a person may have broken the law and needs ID’d to make sure they are not wanted. If one has broken the law, then there is absolutely no reason at all that they shouldn’t have to provide ID. How do they not know if you are not wanted for murder or have a warrant for you ?? If you are breaking the law then there is reason to suspect you just MAY BE a law breaker …lol

They back down. Why bother with passing the legislation in the first place if the state is not going to fight the Fed. They know the Fed will rise against them. When is someone going to draw a line in the sand and tell the Fed to BRING IT ON. Unitl then its just talk and MORE TALK…whether its individuals or state governments. Once you draw a line in the sand you give the people of that state an opportunity to rise up and defend their state. OH I FORGOT..to do something will cost something. HELLO! Washington will not regulate itself – that has become painfully obvious.
Article V of the Constitution gives the states the right to author and pass Amendments to the Constitution, absent Federal Congressional involvement. It may be time to do so.
Focus on your state legislative races, and start putting people of Constitutional principle in place. We will need them in one capacity or another.

Article III, Sec. 2, clause 2 of the U.S. Constitution says:
In all Cases affecting Ambassadors, other public Ministers and Consuls, and THOSE IN WHICH A STATE SHALL BE PARTY, THE SUPREME COURT SHALL HAVE ORIGINAL JURISDICTION. In all the other Cases before mentioned, the supreme Court shall have appellate Jurisdiction…
“Original” jurisdiction means the power to conduct the “trial” of the case (as opposed to hearing an appeal from the judgment of a lower court).
Counsel for the States of Alabama and Arizona should consider:
1. File a Petition for Removal before the federal district court Judge demanding that the case be removed to the Supreme Court on the ground that under Art. III, Sec. 2, clause 2, US Constitution, only the Supreme Court has jurisdiction to conduct the trial of this case.

I say for every Democrat pushback of states forcing them to deal with the financial and criminal burdens—money comes from the district of that rep to handle the problem. Living in Arizona, we have a HUGE problem, one that our government refuses to address other than to put signs up in OUR OWN COUNTRY warning us it is too dangerous to go in certain areas.

Now I’m sure you, and all of posters here, would probably be perfectly fine if we treated illegal immigrants like an invading army and bombed them, dropped artillery rounds on them, and shot them on sight when they crossed the border, but that doesn’t make that civilized or right. While it is indeed true that we should control the flow of our borders, the fact of the matter is that 1) We don’t need to be so anal about who we let in, we require far more of them than the average citizen knows, 2) Pushing people who, realistically, are at least as qualified as our own people to be citizens, into the desert just makes it more difficult to spot the real dangers, and 3) There are WAY too many illegals who are already here+those who enter daily+plus those who come back for it to be financially feasible to deport even a substantial fraction of them, particularly with your sudden appetite for gutting the federal government. Now, I know, you might say “well why don’t we just kill them if they keep coming back,”–well okay, take the “+repeat illegal immigrants” out of the picture, setting aside what a barbaric and inhuman idea it is, that still wouldn’t be enough to reverse the inflow of fresh illegal immigrants, although it might makes us a less popular destination for illegal immigrants and a more popular destination for people trying to murder us.
