UK Court Mulls Mother’s Request to Sterilize Mentally Disabled Daughter

LONDON (AP/The Blaze) — A British judge ruled Tuesday that more evidence is needed before deciding whether to grant a mother’s wish to have her mentally disabled daughter sterilized — a case that is troubling medical ethicists.

The 21-year-old woman, who has a significant learning disability and has been identified only as P, already has one child who is being cared for by her mother, Mrs. P. The woman is scheduled to give birth via cesarean section on Wednesday and her mother had proposed that doctors could sterilize her daughter at the same time.

“From my point of view, I want the best for my daughter,” Mrs. P told the court. “Obviously, we can’t carry on supporting more and more children.”

She said if her daughter had more children in the future, they would have to be cared for by the state.

The decision Tuesday means no sterilization will take place this week.

The daughter was represented in court by a government-appointed lawyer. It is unclear whether the daughter objects to having her tubes tied. The Court of Protection, where the case is being heard, would not comment on ongoing legal cases.

Because her daughter is mentally disabled, the matter has to go through the courts. The mother is asking the court to decide whether her daughter is able to make her own decisions about contraception. If the court agrees she lacks that capability, the mother asked that doctors be given permission to sterilize her.

The presiding judge described P as a “sexually healthy and active” young woman and said it was hardly surprising there was serious concern about future pregnancies.

But some critics questioned whether the radical step was necessary and worried about the precedent it would set.

“This is eugenics if they are doing this because she’s mentally disabled,” said George Annas, chair of the department of health law and bioethics at Boston University. “This decision needs to be made based on the person’s best interests, not the best interests of society or her caregivers.”

Annas said to justify sterilization of a disabled woman who doesn’t have the capacity to consent, doctors needed to prove why a less invasive method like birth control wouldn’t work.

Under Britain’s Mental Capacity Act, passed in 2005, courts can decide on medical treatments for people deemed incompetent. Most cases, however, involve decisions about withdrawing intravenous food from patients in a permanent vegetative state.

British courts can also order abortions for women who lack the mental capacity to consent or compel lifesaving medical treatments that mentally disabled people might otherwise refuse.

“It is a drastic step to sterilize someone against their will simply because they lack mental capacity,” said Mark Goldring, chief executive of Mencap, a British charity for people with learning disabilities. “It is a gross invasion of someone’s basic rights unless there are clear medical grounds … we urge the court to tread very carefully.”

Other experts said sterilizing a woman who is mentally incompetent could be warranted in exceptional cases, such as if the woman isn’t able to take care of a baby.

“The issue is also whether or not you’re being kind or being cruel by repeatedly exposing her to the dangers of pregnancy and the risk of a C-section without having the opportunity to keep the child,” said John Harris, a professor of bioethics at the University of Manchester. “If the alternative is to expose her to further pregnancies only to see her children repeatedly taken away, sterilization could be the lesser of those evils.”

Harris said people did not have an inherent right to have as many children as they like, especially if that imposed huge costs on society.

The case is now scheduled to be heard in April after the court requested more expert evidence.

    It is not necessary to sterilize this young woman. There are birth control implants that are put under the skin that can be effective for 5 yrs or 8 yrs, It is easy to have done.

    Geez, you people talk about mutilating her without her consent and how horrible it is to take away her choice. She isn’t capable of making a choice apparently. It is really hard to teach these people proper behavior. My husband sat next to one of the “special” people who ride our bus and he proceeded to rub himself and groan. And this guy is one I would consider higher functioning than some. If they are not capable of living on their own or having/accepting responsibility (of any kind) then their caregiver (guardian) should be able to do what is best for them without the court. It sounds as if this woman isn‘t able to decide one way or the other so how is it taking away her decision when she isn’t capable of making one? And as one pointed out, how about the cruelty of having her babies taken away everytime she has one? At some point people need to mind their own business.

    This is a decision best made by the individual and familly. The courts need not be involved. None of us posting know the extent of the situation completely. I’ve worked with developmentally disabled persons. I knew of a very pretty 14 year old girl with the mental capacity of a two year old due to a stroke she had as a baby. She was innocent and sweet until someone took advantage of her. She became a raging sex-o-holic with the temperament of a toddler going through the terrible twos! It was not a pretty thing. The poor girl’s life was drastically affected as was those who cared for her because of this. These primal urges are hard wired in the brain. When puberty hits, there they are. And sadlly, there are those who would take advantage. She is a nice looking girl and is MORE than willing to have sex anywhere, anytime.She throws herself at men! It is so sad. Her mother as guardian knows best.

    Oh, wow. My apology post showed up but not the one I lost,,,, Basically I said that I have worked with girls who are mentally challenged (okay, can’t move, talk, or make rational choices). Most of them who were able to conceive, were on some sort of birth control. The sad fact is that their parents have to work and care for other children. They can’t be with these girls 24/7. They all have to pray that the staff of the schools, daycares, hospitals and homes to help them are trustworthy. Unfortunately, these girls are easy targets for sick jerks (had a stronger word for them but hit delete) and their parent don’t know that their innocent daughters were victems until they are diagnosed as having a sexually transmitted disease or wind up pregnant. Finding the jerk is hard enough and prosecution? Yeah, right….

    You people supporting this are sick. If this woman has committed no crime, then she should be free to operate her own life. Mental disability is in the eye of the beholder and the state can call just about anyone insane. Psychology and psychiatry are pseudoscience and have a strong profit motive as well. This was famously proven in the 1970′s by psychologist David Rosehhan.

    If two psychologists (it is actually many more) can swear by opposing diagnoses, the methodology is a fraud. Sheer conjecture. Modern phrenology.

    Even if this P woman truly had the undeniable mental capacity of a 2 year old then Mrs. P or the asylum should be prosecuted for facilitating rape. Whoever is entrusted to be the guardian of this mental child is criminally negligent and THEY should suffer penalty, not P. I suspect, however, that P is not mentally diminished on that level or Mrs. P would seek to punish the caregivers (or shut her mouth if she is in fact the caregiver.)

    You cannot force law abiding citizens to give up their right to reproduce simply because you do not approve of their parenting skills.

    One could, however, make visectomy (or tubal ligation) a VOLUNTARY condition of parole for violent offenders if you seek a legal and moral form of eugenics. Although, parole boards violate the sacrosanctity of a jury’s sentence anyhow and should be abolished.

      I also work in this field & if the UK is anything like the US, there’s a big push for closing the institutions. With that being said, if someone is over the age of 18, there’s nothing legally that can be done to the caregiver, even if the caregiver is the legal guardian, charges would have to be persued against the “father” & if he’s also mentally disabled, then that probably wouldn’t happen. I have one consumer I work with that’s MR (no, I’m not going to use the “politcally correct” new term of ID) who was sterilized a little over a year ago. Granted, she was high functioning enough to say she didn’t want to have any children so there was no forced order. I know of another who was ordered by the state to have her tubes tied after DFCS took away her 8th child (most of them the result of obtaining crack cocaine), so it does happen here occasionally.

    First of all who are the creeps that are having sex with this girl? The girl can‘t be called promiscuous because she probably doesn’t even know what that means. Sterilization would be the way to go for her own sake. What if something happened to the parents and she had a child then who would assist with it’s raising? She will have a problem with grading the type of man or woman for that matter that would use her for her weakness. Her situation is heartbreaking but common sense must prevail here.

    It could be that the fathers are also mentally disable, and in that case there needs to be better supervision by their caretakers. After all, sex is as natural as eating and sleeping. No one needs to be instructed about desiring sex.

    This girl should be sterilized. Having a child is the most precious moment of life but only if you can love, raise and nuture that child. The girl’s mother should be the judge on this matter not a court! Putting this girl through multiple pregancies is very cruel!

    Wow, this is a tough call. I don’t like the idea of people being sterilized without being able to give their consent … BUT, it doesn’t seem that this mentally disabled woman understands the connection between having sex, and creating a child. Maybe she’s incapable of making this connection, but enjoys the pleasure of having sex.

    I can‘t imagine the type of guy who would enjoy having sex with someone who has no idea what she’s doing. I imagine that this type of guy would be just as happy with having sex with a blow up doll or unconscious person. “Daddy” must be held responsible for the children he produces.

    It could be that she actively seeks out random men to have sex with, and in that case, she needs someone to monitor her, 24/7.

    If I were the Judge on this case, I would allow the sterilization.

      Very good commets Diane, if this young woman is mentaly challenged as stated and truly dosen’t know right from wrong,the Mother has custody of her,then this should be the Mothers call, if this young mother contiunes to have sex then not only is she at risk for another pregancy if she dosen’t have her tubes tied but she is also at a high risk for S.T.D.’s,I feel bad for all concerned.

    The question of why shes having sex and with whom is best answered this way. Sex is a primal instinct and you don’t have to be “taught” how to do it, it feels good and you want it. She’s probably having sex with other handicapped people who have the same urges. When I would work at the local school for the severly mentally handicapped (and I mean people who didn’t mentally function at my 2 year olds level) they all knew how to have sex and one of the things you had to watch for on the job was the students having sex or masturbating.

      It may not be simple to teach her not to do it. I’m sure the mother has already tried. The court should let the mother make medical decisions for her daughter if she is not mentally fit to do so. Who will take care of the children if something happens to the mother and the daughter continues to have babies? If the father(s) is mentally handicapped, isn’t there a higher likelihood that their children could have mental disabilities as well? If he father(s) is fine mentally, he ought to be charged with some kind of crime for taking advantage of a mentally incompetent person.

      Ivehavehadenough has it right. I have a degree in what was still labeled then as “severely mentally retarded”. They have urges as strong as any of us but with much, much less of an ability to turn off that urge.It’s not a situation of right versus wrong but feels good versus will feel even better. I learned that early when making the mistake of letting one class watch a movie minus me watching them constantly. A commotion caught my eyes and when I turned on the lights there lay 9 yr-old-female next to a 13-yr-old boy … seconds and inches away from intercourse.
      I, too, would suspect in this news item the father is as disabled as this young woman. But it is not uncommon, if she is in an institutional setting, that a male caretaker is the father.
      Total separation and 24/7 supervision are the only other alternatives to sterilization. The first two choices combined are next to impossible. The other choice should be up to the legal guardian. Guardians of severely injured family members and others who cannot make reasonable medical decisions for themselves make such choices every day. There may not be (enough) precedence for the guardian to make this decision but I guarantee there are plenty of records and reports of sexual activity among persons of “like minds” and just as many of young … YOUNG … women easily and readily giving up and in to a pursuer. And as the odds would have it a number of those young women became pregnant.

      So I ask you … would you leave the care and protection of a newborn in the hands of a 5-yr-old girl and boy? The dozens of students I worked with … from ages 5 to 21 … averaged what we generally call “an IQ” of a 5-year-old. I’ve had to put muzzles on children who would not stop biting large chunks of flesh from their arms. I’ve harnessed helmets to those who would not cease from banging their heads against walls. Some may not favor sterilization of this young woman but it has to be done. Like some of you wrote here: the urges can still exist but at least the pregnancies will cease. Yes, someone needs to know who helped in causing this pregnancy … from the companion to those who failed to properly supervise this young lady. But it seems pretty evident those factors are moot at this juncture.

    My prayers go out to this girl and her family. I have to say, sterilizing this girl because she’s mentally disabled sets an awful precedent. If she is sterilized, let it be her own choice. If she’s unfit to make the choice, I say let the mother decide. No mother should have to take care of children that aren’t hers, especially if it‘s cleaning up her child’s mistakes.

      Don’t you see that this is no different from all the teen pregnancies and welfare mothers out there? It‘s all about teaching morals and protecting the young whether it’s a teen mother or a mentally disabled young woman. Just as handing out condoms to teens is wrong, so is allowing this woman to be procreating. She should be treated as a child, taught what she is capable of learning and protected.

    This is no different than any other case of people not being brought up with morals about sexual activity. This young woman was obviously exposed to sexuality and not taught right from wrong. Were they able to teach her other moral and social attitudes? Obviously, unless she is being raped, she has some sort of social skills, so why were other morals not taught to her? And why is she she not being better protected and led if she is more severely disabled?

    If the woman can’t take care of her children then she should be fixed just as a man should be. If they have them or make them then they should have to take care of the children if not physically then pay someone to take care of them. It’s called responsibility.       2 things- in this case, why has nobody brought up the chastity belt???
      Sex is supposed to be 2 things, unitive & procreative
      I don’t think I need to explain procreative, but unitive meaning 2 become 1 flesh, the word itself comes from the greek root seca- meaning to sever/ to cut off. When you join , you’re unified physically, mentally, emotionally, & spiritually . Longing for the return to the embrace of the other. There‘s a big problem in my book if the mother is doing this to allow her daughter more ’sexual freedom’ there certain cases in the Catholic Church that would allow for a mother to be sterilized, there’s too many unknowns to make a good call- a learning disability- no matter how severe- is not a cause for sterilization, nor should it be a reason for a young woman to spend her life with parental supervision- we don’t know enough about the whole situation to even guess -
      It could even be an overbearing mother

    This is no more eugenics than is the prohibition of 1st cousins and siblings having children, especially as the woman’s ability to care for the children is slim to none, and she wouldn’t be married anyway.

    I can’t say for sure, but I would bet that the Chatholic Church would OK this procedure. I generally find their moral reasoning to be sounder philosophically than any court or advocacy group.

      I wonder if the mother had proposed this when the daughter was a minor if there would have been a problem. I think the mother is only wanting to do what is best for the daughter and any other children she might have and not be able to take care of. Seems the mother of the young woman is a responsible person who will be caring for two children and her daughter .. how many more is she supposed to handle? Really I think this is a family matter and the government should stay out of it since her daughter is REALLY not an adult — only in years.

      This certainly raises a moral problem. I don’t really think there is right solution here; either you risk this young woman having more children she can’t take of, or you set what could be a very dangerous precedent.

      But why can the mother not control her? Who is/are the father(s)?

      If the mother has legal custody or responsibility of the daughter then by all means she should have a right to request that her daughter be sterilized. If this woman is so incapable of caring for her own children I see no problem sterilizing her.

      The father or fathers of these babies is most likely another handicapped person. They have programs and daycares for mentally handicapped people and I know of quite a few incidents where other patients or staff impregnate these girls. They are still human and have sexual urges and are not able to understand sex creates a child.

      One must wonder where the mother is while her mentally disabled daughter is getting pregnant? Part of the liberal agenda is, of course, to force these moral dilemma’s by creating situations where those who are not capable of making clear moral decisions are put in situations where they are either raped or exposed in such a way as to allow them to become pregnant in the first place.

      The Catholic Church has always taught that sex is a gift from God to cooperate with Him in making souls for Heaven. It’s not a toy, it‘s not a game and it’s not a “right”. It is God‘s way of making sure the human race goes on until such time He decides to take history to it’s ultimate conclusion.

      Sadly most people love this sin so much (fornication, adultery, etc.) they‘ve insisted that it’s a human right. That‘s not what God says and it’s not what the Catholic Church teaches.

People can only give government the powers they themselves have. Person A has no right to sterilize their neighbor or child or anyone for any reason. It is not one of their God given/natural rights. Therefore, no government has the right to sterilize anyone. This would make the UK no better than China who has forced abortions and who murders second born children.
      If the 21 year old woman in question is not able to make a decision for herself to give birth to a child because she is mentally unable, how in the world is she able to consent to sex in the first place? – and may I remind everyone that the article claimed she had a learning disability not that she was mentally unstable. If she is unable to choose to have kids, then she is unable to consent to sex, and therefore the men who have sex with her, the woman’s mother or anyone else who allows men to take advantage of her, is an accomplice in her rape and should be jailed.
      What is wrong with you people who find this to be just an interesting case? Have you no conscience? This is a totally black and white/ good vs.evil case. If this women is truly mentally handicapped she should be treated with compassion and protected from those who would hurt her, not punished and mutilated.
