Update: Armless, Legless Girl Allegedly Offered Compromise on Cheerleading but Parents Refused

Earlier Thursday The Blaze asked if a Nebraska teen with no arms or legs should be offered a spot on her high school cheerleading squad. According to our report, Julia Sullivan’s parents claimed their daughter was barred from cheerleading by the school because of her disability.  It comes as no surprise the ACLU swiftly became involved in the case, citing discrimination.

Now originally we were led to believe school administrators refused 16-year Sullivan a place on the cheerleading squad outright, without so much as even entertaining the seemingly far-fetched possibility of giving her a shot. However, we are now learning that the girl’s parents may have actually been offered a compromise by the school district that would have allowed their daughter to become a cheerleader. A compromise the parents reportedly refused.

According to Blaze sources, the Aurora Register News reported on June 15* that the school district offered Sullivan a chance cheerleading for the football team and even a one-time try out for the volleyball team, to determine if there would be any safety issues for either Sullivan or the other participants. The Register News, however, says the girl’s parents refused the compromise, as they had their minds set on basketball cheerleading, which reportedly wasn’t on offer.

Aurora Superintendent Larry Ramaekers told the Register all the problems started when the Sullivan’s attorney became involved in the discussion.

And once lawyers were thrown into the mix, the school brought in its own.

Kelley Baker, the school district’s legal counsel, explained to the Register some of the factors that go in to the school’s decisions about allowing handicapped students to participate in team sports:

“You also have to take into account the fairness to other competitors if you are eliminating a criteria. Is that fair or unfair to other competitors?” he asked. Baker said the school also has to take health and safety into a consideration, noting the school has an obligation to protect its students and to try to structure their involvement in an activity, when it can be structured, to keep them safe. The school’s attorney said a third criteria that is important to consider is whether an accommodation would fundamentally alter the nature of the program.

“I looked at the criteria in the handbook. It’s thoughtfully written. It’s well written and incorporates the essential functions of the cheerleaders that have been in place for a number of years,” he said. “I have been told since the girls do not have a dance team, the element of dance has been an important part of the cheerleading squad. You do have kicking, jumping and dancing as criteria.”

But despite having what he believes are good reasons for possibly not allowing Sullivan on the squad, Baker reportedly said he’d be interested in a continued dialogue with the Sullivan’s attorney about finding “reasonable accommodations.”

So what say you? Are the Sullivan’s just screaming discrimination, or was the school district’s decision a fair one? If Julia‘s parents only care about their daughter’s happiness, wouldn’t they have accepted the compromise? After all, wasn‘t this all about their daughter’s desire to experience being a cheerleader? Does it matter whether it was for the basketball or the football team?

      Not for noting, but able bodied girls are getting cut from the cheerleading squad ALL THE TIME. If she isn‘t good enough then she can’t be a CL, period.. No discrimination, it’s like you have to pass a test..

      Cheerleading has become a combination of dance and gymnastics and is highly competitive. Most cheerleaders cheer for several teams and rehearse several times a week. Love this girl’s spirit and there is a place for her, but lets face it, she can’t be quarterback on football team, goalie on soccer team or nuber 4 hitter on softball team. She should be allowed to cheer like everyone else.l By the way cheerleaders cut from roster, so to allow her on team means the lowest qualified gets cut, and the lowest qualified could be a good athelete trying hard.

      This is brought to you by your american lawyer. Attorneys do much more harm than good. The ACLU is a socialist and greedy org. that cares only about lawyers. Class action suits are another big mistake over all. They sue a company “in behalf” of consumers for nothing half the time, the lawyer gets rich and we get a check for 39 cents. Then the cost of the product goes up. The lowlife attorney comes out well. The company just raises prices and we get the shaft. Attorneys should be better regulated and not by the lawyers association.

      So how about we not give her, her parents and their lawyer the 15 min. of fame they seek. Leave it to the isolated story in the local paper. Its like the MADD people who become zealots for a cause in order to fill some vacuum in their lives. While no ones condones drunk driving, including myself, their lobbying and legislative efforts have gone way beyond the original issue, like for example drinking age. If you can go to Iraq and Afghanistan and die for your country, you should be able to order and drink a beer.

      Just let the girl cheer on it. It’s not brain surgery. Besides, it could end up being one of the highlights of her young life. There probably won’t be a bunch of those. Especially later. It’s just a cheerleader team. It shouldn’t matter.

      Any able-bodied girl who was shallow enough to complain or compare herself needs a slap in the face. This is just a consolation prize. Freakin’ give it to the girl.

      You’re making this about the parents and the organization. my high school had a girl in a wheel chair AND a retarded girl on the cheer squad and NO ONE HAD A PROBLEM WITH IT.

      You guys go on and on about PC being out of control. You can’t even see that your “level playing field” mentality is overreaching.

      Does anyone here see the irony here between this girl, and a young man with his affirmative action upbringing/education? He was entitled to all kinds of allowances and still is. Where are his school records? How many passports did he have? In 2008 accomodations are made one more time to allow a black man to become president. Look what we got, a boy who would be king!       This is just another form of affirmative action. It lowers the standards to allow some that can’t make the grade to get the job thus lowering the quality of the job done. Lowering the standards serves no one, most of all those trying to qualify. If she had come up with a complementary routine to the able bodied girls that does not alter their regular routine perhaps it could be considered. But then every other girl trying out has that chance. I have 3 handicapped children. I know about this and I say there are times it is just not reasonable to expect society to include my kids in main stream activities. Some (total inclusion) classes just don’t work and it is unfair for other kids to have to put up with disruption. I don’t want my kids forced into situations that they cause others to be held back from doing their best to accommodate my child.

      While I feel for the young girl involved and believe she can do or be anyone she puts her mind to, I just don‘t see how she’ll be able to be a cheerleader. If she just didn’t have arms, maybe. If she just didn’t have legs, a little less likely but still a maybe. But how is she suppose to do any of their moves without arms or legs?

      And since when does different sports have different cheerleaders in high school? Obviously in professional sports they’re different, but if my memory serves me correctly, my high school had one squad that cheered as all events. I think there was a jr/varsity squad but not different squads for different sports….

      Then you should start putting your child ahead of kids that are not your child. letting this girl on the cheer squad means what? Letting her sit in here wheel chair and cheer and feel like part of the team? SO WHAT? LET HER DO IT.

      When I read this yesterday I felt sorry for the girl, thinking they could at least have her participate in some manner, cheering etc. But, I read today she was offered a spot and the parents turned it down?
      WTH? They just wanted to be troublemakers I guess, to diss the offer. Let’s get real, she could do nothing more than cheer, obviously, but she was offered a place. Parents refuse and want to sue??
      Yeah, this sounds like America, they’ve dumbed down everything for everyone, qualified or not.

      Personally, I feel sorry for this girl. The parents are the selfish ones obviously. The girl should have every advantage that she’s capable of doing. There are many things she can do and as much as I’ve wanted to fun things, I realize I’m not programed to do some things with skill. Who do I sue?

      having lived in a state of denial for 16 years that their daughter‘s being ’limb challenged“ has nothing to do with the ”wonderfulness” of their daughter or her apparently infinite capabilities, they have twisted the world to fit their skewed vision of it. not wanting to admit the horror that is the body of their daughter they invent reality-its 1984 and not only does she have six fingers on each hand but also has two arms and two legs, if you just believe it. the “tyranny of the handicapped.”

      Your examples are the foolishness. Just let the kid be part of the team and stop being so mean about it. She doesn’t have to get on the pyramid. She can just be “part of the team” and cheer from her chair.

      I live in Lincoln, NE. I am quite familiar with the area. Aurora is a small farming community with a strong history of excelling in athletics. This is not the mindset of the strong majority of this community or most Nebraskans. These parents are obviously selfish gold diggers and looking for cash in any way they can (a settlement, hey about a book deal or maybe a movie) at the expense of their beautiful daughter. I grew up w/a a man that was born with no arms. I use to watch him in amazement and speak w/ him whenever I saw him. He could smoke a typewriter, drive a car (specially designed) and drink beer in the local bar. He never asked any one for special assistance or acted like any one owed him. He was married and had children. He worked for the county w/ my mother and was a respected member of the community. He told me once his parents treated him like a child w/out disabilities and refused to coddle him even as a young child. I also played Legion Baseball against a one armed first baseman. OMG it was pure poetry watching him field or catch a ball flip his glove & ball in the air, catch the ball and make the play. He also smacked the crap out of the ball when batting. I am sure many of us have had similar experiences to some degree or another so you can relate.These are the people that make this country exceptional. Oh I forgot, I’m missing my rt ring finger. Thanks Mr. P (typing teacher) for not letting me quit. The parents & the system are traumatizing her

    Gee, would the parents have felt better if their daughter had instead been rejected for not being attractive enough? After all, in that one picture, she’s not the prettiest teen out there. Where the heck does this garbage end? Maybe they will want to sue because she can’t be on a gymnastics team, too. How about golf, tennis, and wrestling teams?

    This girl’s parents sound like agitators and lunatics. YES, the girl was barred from being a cheerleader because of her disability – she has no arms or legs, so, NO she cannot perform the required cheers. It appears the parents are forcing the girl to pursue this ridiculous pipe dream instead of helping her tap into her real talents and skills. It is sad that this girl and her parents have deluded themselves into thinking that she is whole, that she is “normal”, because she is not, and there are many things that she simply cannot do.

      I agree, when trying out for a team, you are judged on what you bring to the team. Only so many can,
      compete in cheering competition. Maybe she can sing or somehow contribute to pep rallies, or play in the band, but let’s be realistic, unless she can actively participate, she would only be an honorary member of any team. I wonder what her school mascot is?

    I guess I should‘ve gotten a lawyer when the poms sponsor told my 6’ daughter she was too tall for the group. 137 lbs and 6′, and quite a dancer, but because of the length of her legs formations would never look right. Hmmm……Girl in a wheelchair. Stunts. Cartwheels would hurt like heck and her parents want to put her through the humiliation of “that poor girl….etc.”? Goodness knows we all have different abilities and skills. Mom and Dad need to get over it, and quit trolling for the lottery in some kind of crazy lawsuit.

      Agreed… But she should not be encouraged to do what is an impossibility for her to do, unless her intention is to destroy all sports.
      As a parent of a handicapped daughter I say – get real, folks; you have picked the wrong battle and are making yourselves out to look like lunatics. In the end this will hurt your daughter more than rejection from all ‘able bodied’ sports.

    I am handicapped and have excepted my limitations and like it or not I do have them. This girls parents and the ACLU are not doing her any favor. She needs to except this fact and do it sooner than later as I did. Acceptance of limitations is NOT a surrender, it’s common sense.

    If the school was willing to allow her to be a cheerleader for football games, why not for the basketball games? It seems like it would be easier for her to get on and off the court than on and off the football field. With that having been said, it does bring up thoughts of the lawsuit a few years ago that involved men wanting to be Hooters waitresses. If I remember right, the courts agreed that there are certain requirements for certain things that not everyone can meet.

    This was said by the girls father, “She scored ones across the board by each judge on jumps and kicks because the judges were instructed by the coach, who was instructed by the administration, not to accommodate.”

    She has no legs. What other score did anyone think she would get for “jumps and kicks”? They want an “accomodation”, not that will help her do something that is DIFFICULT for her, but that will substitute for her COMPLETE INABILITY to do it. Because she is crippled she should be accomodated by crediting her with doing what she can’t?

    I sympathize with parents of severely disabled children. But what they are doing here is just wrong. And the lawyer is clearly a shiester bully.

      I agree 100%. You don‘t get a pass when you can’t do what the others are required to do. They didn’t bar her from trying out and rated her fairly. I think that meets the criteria for not discriminating.

      That’s what really bothers me about this. What if she was fully accomodated and put on the team. Who would see her and not focus on her disability? Who wouldn’t think, “There’s that crippled girl. I feel sorry for her. I’m glad they took pity on her”? And who would want that kind of attention? Is anyone really going to see her and be proud of what she had accomplished, when she couldn’t do much at all? How is she ever going to be proud of what she has done when she doesn’t do anything? Let her excell where she can and let people be proud of her for what she can DO.

      A good reference is the guy from, I believe Arizona State with one leg, who won the Div 1 Nationals in wrestling. Trust me he was not given any accommodations at any level of his career. Having wrestled in college, the one thing nice about one on one sports, like wrestling, tennis, gymnastics, etc., is there is no subjective BS. You either win the wrestle-off to make the team or you don’t. You go on the mat, it is one on one, you either win or you don’t. The fact that the parents rejected a compromise shows that this has little to do with their daughters participation. Again, best recourse is to give them and their crusade as little attention as possible.

    This stuff irks me. What about the people who are legitimately qualified physically (i.e. they’re talented and athletic) who don’t get a shot when exceptions like this happen? Besides, being a cheerleader is not the end all/ be all. I was one; I know. Better that she be known for her mind and her ability to reason…. She might be a star debater. Why not find out?

    The politically correct entitlement mentality is accelerating the decay of this country.
    Do these parents really think their kid can be a cheerleader with no arms or legs?
    This article touched on the safety aspect… Not only will it be unsafe for this girl but think about the other girls; would you want your daughter doing flips, cartwheels etc. next to a wheelchair?
    No I don’t think these parents give a crap about cheer-leading, this is probably just an attempt to milk some money out of the taxpayers (AKA school district) . The citizens of this community need to support the schools on this one.
    What is really said, is this girl who already has a tough row to hoe is being used as a pawn by her parents.

      This is ALL it is, sue and get some money and make everybody pay for your childs physical problem. There is NO logic here only a BS lawsuit that only the ACLU will take and usually win due to the fact that they have more money than the whole school district takes in all year. Publicize it nationally and the “guilt” trip of some sorry souls will send them thousands of dollars a day. This is just stupid.

    Tragedy+Entitlementality=Stupidity. It’s tragic that this girl must overcome this physical disability, but, let’s be absolutely clear: it IS a disability. Can she perform the stunts that the other girls can perform? Will special accomodations have to be made to even give her access to the performance? Cheerleading is competitive, and not everyone who wants to be on the team makes it. Those with the greatest skill & talent make the team. This is true in ALL SPORTS. I’m all for “Be all you can be” and going after your dreams, but REALITY has to come into play at some point. The fact that she & her parents believe that they are ENTITLED to the special consideration just proves that, as a society, we have apparently lost our way from the people we were just 100 years ago. A little common sense could go a long way here…

    I feel badly for this girl, but less badly now that she hired a lawyer. Years ago I had an amusement park and we gave free ride tickets to the handicapped camp kids every year. One year they were mistakenly given tickets for the pedal boats. I was horrified to see the ride operator loading the kids onto the boats, watching them sit there a few minutes, then unloading them. There are some things the handicapped just can’t do. They need to come to grips with that. What’s next, the swim team?

      I cut the girl slack on this. She’s sixteen. And who of us know what it’s like to grow up with a disability like hers. I give less slack to her parents. They should know better. But given the stress of having and loving a child this disabled I’m still going to cut them a little bit. They’re being selfish and stupid, and not really helping her at all, but they are too blind to see this.

      The lawyer should be turned into dogmeat.

    Gawd……..I hate this crap. This girls parents should be *** slapped. This is not teaching your child that they can be anything they want. Why? Because you can’t. Face reality, use your talents where they will do the most good. I had polio at age 2 and guess what? I didn’t sue to play on the baseball team. I dislike stupidity.

      Well the parents pretty much put into perspective what their real goal is: To force the issue and put their daughter in a position to be ridiculed and cast out of the main stream high school experience – it is all about them. Sounds like she needs a new set of parents who want to help her fit into a normal life, not expose her to an endeavor she can never achieve. What a pity.
