Update: Charges Dropped Against McDonald’s Cashier Who Hit Women With Metal Rod

The graphic images caught on tape of a male McDonald’s cashier beating two aggressive female customers with a metal rod after they hopped over the counter to attack him, brought varying and heated reactions from the thousands who watched the video. Some felt that the McDonald’s employee had every right to defend himself, others commented that he crossed the line after giving one of his attackers a beat-down so severe that her skull was partially-crushed. After 11 days of grand jury testimony, the justice system has ruled in favor of former McDonald’s employee Rayon McIntosh, as he was cleared of all charges Friday stemming from the incident that occurred at a Greenwich Village McDonald’s in October.
The New York Daily News reports that McIntosh was expected to be released from Rikers Friday night, where he has been jailed since October 21. The Daily News reports on Friday’s ruling:
“A whoop of ‘Hallelujah’” was heard in the courtroom after the announcement. A handful of relatives were present to hear the good news.
‘They were trying to turn him into a monster, my son,’ mom Maureen Lucas, a registered nurse from Rockland County, said as she sobbed with relief.”
While he may have been acting in just selfdefense this past October, McIntosh is no angel. He began working the McDonald’s job just after he finished serving 10 years for manslaughter after shooting and killing a 17-year-old classmate in 2000. He was on parole at the time of the attack.
The October incident was spurred after McIntosh checked to see if the $50 bill that the two enraged 24-year-old women attempted to pay their bill with was real. After first spitting and slapping at McIntosh, the two women hopped over the counter where they met the employee who had run to the back of the kitchen to get something to defend himself with. Cell phone video showed that McIntosh had grabbed a metal bar which used to repeatedly beat the unruly customers with. McIntosh’s lawyer claimed that the employee feared for his life.
“He didn’t know if they had a weapon,” lawyer Theodore Herlich told the Daily News Friday. “They were saying, ‘We’re going to f–k you up.’ He thought they were saying, ‘We’re going to cut you up.’ I think the grand jury had a lot of sympathy for him based on the video, based on how the women were behaving.”
“He was at work. He wasn’t looking for trouble,” Herlich said.
Now that McIntosh has been cleared of assault and weapons charges, the women who attacked him are waiting to hear from a grand jury that has not yet voted on the charges of criminal trespassing, menacing and disorderly conduct that the two women face.
The women’s lawyer, Harold Baker, tells the Wall Street Journal that McIntosh is not innocent but a man with a history of violence who viciously attacked two unarmed victims.
“The tragedy here is that the only people facing prosecution are two women who were hospitalized after being brutally beaten by a convicted killer,” Baker said. One of Baker’s clients suffered a fractured skull, broken arm and neurological damage, and the other injuries that included a serious cut to her face.

Posted on December 3, 2011 at 9:18pmIt is really important to know if the $50 was counterfeit. If it was then their assaults were committed concurrent with a another crime.
It is handed if you are passing a counterfeit bill to bow beat another person by appearing menacing or threatening violence. If it happens enough times then no one will date check if a bill is counterfeit. Which would be the whole point if a counterfeiter being violent.
Also what about mob action, aggravated assault or assault & batter. The did slap & spit on him. the definition of assault varies by jurisdiction, so if the skanks are charged with a lower level assault they may be able to pleas down to a misdemeanor. that would be a miscarriage of justice. Those two skanks need to hang.

Posted on December 3, 2011 at 9:59pmIf I hand over large bills, they are routinely checked. I’m a white male. It’s standard practice. get over it. And if you can’t get over it, and assault the cashier, I hope you get whacked.
So this guy is no angel. Seems to me, he was minding his own business until he was assaulted. Now, maybe it would have been the more manly thing to just punch these “ladies” out. But have you seen these “girls?” Not very feminine. Jumping the counter? Whack em!

Posted on December 5, 2011 at 10:41amI’ve watched so many out-of-control black women going on a rampage it’s raised a question in my mind as to why they think they can get away with that kind of behavior.
I can only guess that they‘re not getting the crap knocked out of them when they need it by some man and they’ve assumed a kind of attitude where they think they’re badassss on a par with men.
I don‘t know why this guy in the video didn’t just floor both of them with a flurry of punches, because I have no doubt he could, instead of getting a club. He wouldn’t have been considered for prosecution if he had just blasted them in the mouths.
But it‘s good that these ho’s got what was coming to them. and I hope they‘re charged and convicted so they won’t have a suit against the restaurant. The result will be cracked heads, no money, and I seriously doubt they’ve learned anything helpful at all about attacking people.

Posted on December 3, 2011 at 7:02pm““The tragedy here is that the only people facing prosecution are two women who were hospitalized after being brutally beaten by a convicted killer,” Baker said.”
This is why the legal system is a joke and must be dismantled – this guy was just working and these two thugs decided to whip his ass. They lost the fight and if it hadn’t of been for the video, they would have won the court battle, and now some lawyer is allowed to say the above statement without penalty of imprisonment. Such statements are a direct affront to freedom and liberty, it contorts and destroys the legal system. Such lies are told daily, and believed by judges, and innocent people sent to jail.
This lawyer belongs in jail for a minimum of 10 years for his utterance. These woman belong in jail for at least as long for their acts and for their continued denial of their actions.
Hell, I would be perfectly happy with the death penalty for all three of them.
I bet this guy was acting in self defense in his earlier conviction, too.

Posted on December 3, 2011 at 7:08pmMy Daddy raised me that you NEVER go around the counter whether it be Sears, McDonald’s wherever. Once you invade the space of the cashier, they will assume you are trying to rob them. This was a case of self defense, even though he went a bit far. I imagine his adrenline was pumping. I had a boyfriend in highschool who got in a fight with someone, got him on the ground and starting pounding him. One of the girls yelled, “Don‘t hit him while he’s down!” He quipped back, “Why do you think I got him down?”

No one knows for sure if the two women would have won a court case against the man without the video, to say otherwise is… assuming the outcome. And you know the old saying on what happens when you ‘assume’ things right?
So if a lawyer stretches the truth a bit he should be thrown in jail for telling ‘lies’ as you put it? Be careful with what you are calling for there. That is a slippery slope. Besides, the lawyer didn’t exactly tell a lie, the two women WERE beaten by a person who has killed someone before.
Now before anyone rails on me I will reinforce the point/comment I made on the original story. ALL parties are at fault here. The man had every right to defend himself but went well over that acceptable level of response. It was uncalled for, like using a stick of dynamite to kill a bird. Overkill. (it would have been different had the women brandished a weapon, which they did not)
I don’t agree with letting any of the three off the hook for anything. All three need some form of either punishment or therapy of some sort. Just my two cents worth.

Posted on December 4, 2011 at 11:58amI like your idea about charging the lawyer with a crime! We need to create disincentives for lawyers who regularly seek ways to use the legal system as their meal ticket with the effect of making our laws into something the laws were never intended to be.

Well I am glad that they now have to live with their injuries. Too many times women drag men into doing things (yes by their testicles) sometime terrible tings then turn their head and walk away like they did nothing. I know of cases that women drive men crazy by their infidelity then expect that nothing happens to them when things go bad and they (the bad thing) usually get away with it. Some beat guy’s up then play the innocence game.

Posted on December 4, 2011 at 12:09pmThe point is not if he will beat someone again, but rather that these two women will think twice before they attack someone. We have no way of knowing their motive of their past history, but I think we can with reason suspicion that these two dollies were not first time offenders.
Had they got been able to convince someone that the person behind the counter did something to inflame them, they likely would have received an apology from McD’s and a very nice cash settlement. As soon as their lawyer found out the guy behind the counter had served 10 years in jail it would have been a cake walk. Thank god the incident was captured on tape and thank god the person behind the counter was not some young kid.
We can wrap this story up by saying these two women enjoyed an extension of their learning experience that may benefit them and will without question benefit those around them.

Posted on December 3, 2011 at 6:42pmYes, this is Just,Felon or no Felon. The Person behind the Counter has a Right to Defend himself. Spitting, due to AIDS, is a Felony Assault until the test comes back.
This kid, 17 years old kid when he went into the system, had been dodging spit and AIDS for sure. I too would have pounded the crap out of anyone until they either fled or appeared to be completely subdued. That means not giving threatening words and tone, and behaving in a complaint manner.
I am sure he was well familiar with this technique probably not merely witnessing it many times, but being on the receiving end at least once.
When you institutionalize Boys, they become, from the example of the prison Guards that they are accountable to.
Ladies lawyer, Excuse me? There is a Counter in place for a reason. It is a Barrier. Your clients need to be incarcerated for asault (crossing the Counter with intent), making terroristic threats (F–K you up means Maiming, nobody has the right to damage another person except in fear and defense), Felony Asault&Battery (spitting).
Since I believe that all people have the Right to be Armed, even Felons, these women are lucky that they are not dead.
Felons should be placed on probation and given the average cost of incarceration for being a criminal, under one stipulation, that if they commit even the slightes crime under common law, they will be executed. That will save money, most won’t live a year killing themselves with drugs.

My GF had to go to the Hospital, as she started bleeding from the stress of the assault. She had just got released from the hospital and almost died three days before from accute fibriod tumor hemoraging.
At trial, the girl pressed counter charges against my GF (like she couldn’t even defend herself when attacked), and they arrested my GF and then dropped all the charges against both. Guess her family came up with some money to pay the Judge.
Someone was actually trying to help this girl, and got a beating and an arrest.
