Update: Gibson Guitar CEO Says Feds Told Him Problems Would ‘Go Away’ if Labor Done in Madagascar (Updated With Beck Interview)

The tale of the Gibson guitar raid — the one focused on the legendary guitar maker’s alleged importation and use of illegal wood — has taken an odd turn. Now CEO Henry Juszkiewicz is claiming the Feds told him that some of his problems “would go away” if the company used Madagascar labor.
In an interview with Beck radio affiliate KMJ 105.9 in Fresno, California, Juszkiewicz told host Chris Daniel that the government made the point “explicitly:”
CHRIS DANIEL: Mr. Juszkiewicz, did an agent of the US government suggest to you that your problems would go away if you used Madagascar labor instead of American labor?
HENRY JUSZKIEWICZ: They actually wrote that in a pleading.
CHRIS DANIEL: Excuse me?
HENRY JUSKIEWICZ: They actually wrote that in a pleading.
CHRIS DANIEL: That your problems would go away if you used Madagascar labor instead of our labor?
HENRY JUSKIEWICZ: Yes, yeah. They said that explicitly.

That’s an interesting charge. But what is it all about? Well, Juskiewicz is not referencing the latest raid, but rather a similar raid that occurred in 2009 when authorities confiscated ebony fingerboard blanks and accused the company of importing them illegally. According to Juskiewicz, those accusations are false.
“Gibson has obtained sworn statements and documents from the Madagascar government and these materials, which have been filed in federal court, show that the wood seized in 2009 was legally exported … and that no law has been violated,” the company says in a news release.
So why the comments about Madagascar labor? The latest raid may offers some insight. In the most recent case, the Feds say Gibson violated the U.S. Lacey Act by importing wood from India not finished by Indian workers. But Gibson says the Lacey Act only applies if foreign law has been violated, and it hasn’t been in this case:
The Federal Department of Justice in Washington, D.C. has suggested that the use of wood from India that is not finished by Indian workers is illegal, not because of U.S. law, but because it is the Justice Department’s interpretation of a law in India. (If the same wood from the same tree was finished by Indian workers, the material would be legal.) This action was taken without the support and consent of the government in India.
That could then explain the alleged comments by the Feds that Gibson could avoid problems by outsourcing labor to Madagascar: if workers in Madagascar finished the wood then — considering the DOJ’s interpretation of the law — there would be no problem.
Either way, the raid has been costly on the American business that employes about 2,000 people. According to Juskiewicz, “my personal guess is somewhere in the neighborhood of $2 million to $3 million.”
That’s a lot of money considering the Feds have yet to file charges in the 2009 case.

With the AG, Holder, declaring he will not prosecute “his people” regarding voting poll intimidation, the illegal shipment of assault weapons to Mexico used for killings, including a US Border Patrol agent, and now this, we have to assume the department is rife with criminals desiring to be an independent police force all of their own, with their own laws and policies, all of which are unconstitutional.
It’s getting so far out-of-hand now it‘s beginning to look like the only option to correcting the matter is for the peole themselves to step in and make citizens’ arrests, holding the perpetrators for trial in a people’s court.
This empire is disintegrating badly. It has always been so, but with this black administration now in charge, inundated with radical Marxist criminals, it’s gone way beyond what can be tolerated.

What I’m particularly enjoying ( I use that term guardedly) in all this is that many musicians are liberals and here is liberalism coming back to bite them on the a$$. The madness of the “green lobby”. I know I’d never give up any of my Les Pauls for this ridiculous “green” agenda and I doubt many musicians would. Gibson and Martin are hardly examples of excellence anymore. They’re thriving wholly on their names. You have to play about 25 guitars from either brand to find a good one and I still wouldn’t buy either. There are a lot of other builders making far better instruments than them for less. That being said, I’m not approving what Holder is doing to Gibson. The man, along with the entire administration that appointed him to his position, ought to be tried for treason and punished. Nothing but thugs. Everyone of them. I‘m seeing DC looking more and more like 1930’s Germany with every passing day.

Martin Guitars uses the exact same wood, yet contribute to democrats and are unionized if I remember correctly. Posted on September 1, 2011 at 7:30pmYou would be amazed at how many instances like this are happening everyday, and to many small companies who don’t have the finances to fight it… You either comply, or you go out of business.
I work for a small business that does manufacturing, and we are under the jurisdiction of the FDA. In the last two years, we’ve had the FDA at our facility more than the last 10 years combined. They come in, inspect you top to bottom, and give you a list of things you MUST fix before the next unannounced visit. During our last inspection, we had an inspector who was relatively new with the FDA, and he told us flat out that he was instructed by his bosses to find problems in our facility. Even if we had addressed all concerns from the previous inspection, and everything had been fixed according to their recommendations, he had to find more problems, otherwise he wasn’t doing his job.
Being a small company, we have no choice but to do as they say, as ridiculous and expensive to fix as some of these “problems” are. If we don’t comply, they shut us down. We’ve had to lay off workers due to the massive increase in regulatory costs, and it is only getting worse.
We will not be hiring anytime in the near future – heck we are struggling to keep as many workers as we have now. And if Obama gets 4 more years, I have no doubt in my mind we will be closing our doors soon, after 35 years in business.

Somebody decided that the iconic textile industry that literally started the industrial revollution in the US when an Englishman memorized plans for mills and introduced them to the colonies should be given to certain countries like Pakistan, even if it devestated a lot of local economies.
