Update: Gibson Guitar CEO Says Feds Told Him Problems Would ‘Go Away’ if Labor Done in Madagascar (Updated With Beck Interview)

The tale of the Gibson guitar raid — the one focused on the legendary guitar maker’s alleged importation and use of illegal wood — has taken an odd turn. Now CEO Henry Juszkiewicz is claiming the Feds told him that some of his problems “would go away” if the company used Madagascar labor.

In an interview with Beck radio affiliate KMJ 105.9 in Fresno, California, Juszkiewicz told host Chris Daniel that the government made the point “explicitly:”

CHRIS DANIEL:  Mr. Juszkiewicz, did an agent of the US government suggest to you that your problems would go away if you used Madagascar labor instead of American labor?

HENRY JUSZKIEWICZ:  They actually wrote that in a pleading.

CHRIS DANIEL:  Excuse me?

HENRY JUSKIEWICZ:   They actually wrote that in a pleading.

CHRIS DANIEL:  That your problems would go away if you used Madagascar labor instead of our labor?

HENRY JUSKIEWICZ:  Yes, yeah. They said that explicitly.

That’s an interesting charge. But what is it all about? Well, Juskiewicz is not referencing the latest raid, but rather a similar raid that occurred in 2009 when authorities confiscated ebony fingerboard blanks and accused the company of importing them illegally. According to Juskiewicz, those accusations are false.

“Gibson has obtained sworn statements and documents from the Madagascar government and these materials, which have been filed in federal court, show that the wood seized in 2009 was legally exported … and that no law has been violated,” the company says in a news release.

So why the comments about Madagascar labor? The latest raid may offers some insight. In the most recent case, the Feds say Gibson violated the U.S. Lacey Act by importing wood from India not finished by Indian workers. But Gibson says the Lacey Act only applies if foreign law has been violated, and it hasn’t been in this case:

The Federal Department of Justice in Washington, D.C. has suggested that the use of wood from India that is not finished by Indian workers is illegal, not because of U.S. law, but because it is the Justice Department’s interpretation of a law in India. (If the same wood from the same tree was finished by Indian workers, the material would be legal.) This action was taken without the support and consent of the government in India.

That could then explain the alleged comments by the Feds that Gibson could avoid problems by outsourcing labor to Madagascar: if workers in Madagascar finished the wood then — considering the DOJ’s interpretation of the law — there would be no problem.

Either way, the raid has been costly on the American business that employes about 2,000 people. According to Juskiewicz, “my personal guess is somewhere in the neighborhood of $2 million to $3 million.”

That’s a lot of money considering the Feds have yet to file charges in the 2009 case.

      Here’s just one more example of a rogue Department of Justice revealing it is rife with corruption and criminality. With the AG, Holder, declaring he will not prosecute “his people” regarding voting poll intimidation, the illegal shipment of assault weapons to Mexico used for killings, including a US Border Patrol agent, and now this, we have to assume the department is rife with criminals desiring to be an independent police force all of their own, with their own laws and policies, all of which are unconstitutional.

      It’s getting so far out-of-hand now it‘s beginning to look like the only option to correcting the matter is for the peole themselves to step in and make citizens’ arrests, holding the perpetrators for trial in a people’s court.

      This empire is disintegrating badly. It has always been so, but with this black administration now in charge, inundated with radical Marxist criminals, it’s gone way beyond what can be tolerated.

      The founders gave the people the second amendment to correct situations just like this one.

      So, what about grandma that’s been giving her 10 dollars a month for their entire voting life? Is she just as guilty? Does she also deserve the same punishment? Your logic makes every donation a bribe. Where will you stop it?
      Gibson has done nothing wrong to “deserve what it gets”. No laws have been broken. If the fact of bribing a candidate was the issue that should be what they are charged with. Because they don‘t like how you spend your money can they charge you with something you haven’t done? Because you bought a coffee from Starbucks and not from Dunkin Doughnuts can they charge you with bank robbery because you withdrew the money to pay for it? Don’t think so, because you DIDN’T rob the bank. Corruption is out there, and it is an issue. But you can’t just charge them with whatever comes to mind. That in it’s self is corruption.

      Shift jobs & manufacturing from what is left in the USA to India. India in return will become a major buyer of our treasuries. Then the central government can continue its expansion without having to raise taxes.       This is how big government finances itself. It sells off our manufacturing base to another country with the agreement that they will use the revenues to purchase our treasuries. Clinton signed NAFTA and made China a preferred trading partner. China’s purchases of our debt increased proportional to the amount of industry & jobs we shipped to their nation.

      This is a rather obvious attempt at weakening our private sector so that the only option is for the government to become involved in all industry. Remember Andy Stern’s “workers of the world unite”?       t’s worth pointing out that Henry E. Juszkiewicz, Gibson’s Chief Executive Officer, is a donor to a couple of Republican politicians. According to the Open Secrets database, Juszkiewicz donated $2000 to Rep. Marsha Blackburn (R-TN07) last year, as well as $1500 to Sen. Lamar Alexander (R-TN). Juszkiewicz also has donated $10,000 to the Consumer Electronics Association, a PAC that contributed $92.5k to Republican candidates last year, as opposed to $72k to Democrats. (The CEA did, however, contribute more to Democrats in the 2008 election cycle.)
      One of Gibson’s leading competitors is C.F. Martin & Company. The C.E.O., Chris Martin IV, is a long-time Democratic supporter, with $35,400 in contributions to Democratic candidates and the DNC over the past couple of election cycles. According to C.F. Martin’s catalog, several of their guitars contain “East Indian Rosewood.” In case you were wondering, that is the exact same wood in at least ten of Gibson’s guitars.

      Martin and Gibson are the standards of excellence. However Gibson is in a class by itself when it comes to electric guitars. When politics start to threaten a superior company like Gibson it is time for us to wake up and realize what’s going on.       Gibson is one of the most prestigious -and recognizably American- instrument makers in the world. The Les Paul is an icon of music making. What I’m particularly enjoying ( I use that term guardedly) in all this is that many musicians are liberals and here is liberalism coming back to bite them on the a$$. The madness of the “green lobby”. I know I’d never give up any of my Les Pauls for this ridiculous “green” agenda and I doubt many musicians would. Chuck Berry played a Gibson ES335..to paraphrase Chuck…“go Gibson go”.

      CBS does NOT own Fender anymore. They haven’t owned them in nearly 30 years.

      Gibson and Martin are hardly examples of excellence anymore. They’re thriving wholly on their names. You have to play about 25 guitars from either brand to find a good one and I still wouldn’t buy either. There are a lot of other builders making far better instruments than them for less. That being said, I’m not approving what Holder is doing to Gibson. The man, along with the entire administration that appointed him to his position, ought to be tried for treason and punished. Nothing but thugs. Everyone of them. I‘m seeing DC looking more and more like 1930’s Germany with every passing day.

      Gibson guitars are Republican donors and are not unionized. Martin Guitars uses the exact same wood, yet contribute to democrats and are unionized if I remember correctly. It’s the government playing the Mafia and extorting a business for their $$ and support, or to cater to the larger idea of de-industrialization our nation. After all, it’s very hard to sweep an wealthy, liberty loving country into the global societal order if they remain wealthy and free. It’s equally as hard to do it when you have a bunch of liberty lovers armed to teeth because they have the right to bear arms. They’ll be coming for our guns soon enough

      You would be amazed at how many instances like this are happening everyday, and to many small companies who don’t have the finances to fight it… You either comply, or you go out of business.

      I work for a small business that does manufacturing, and we are under the jurisdiction of the FDA. In the last two years, we’ve had the FDA at our facility more than the last 10 years combined. They come in, inspect you top to bottom, and give you a list of things you MUST fix before the next unannounced visit. During our last inspection, we had an inspector who was relatively new with the FDA, and he told us flat out that he was instructed by his bosses to find problems in our facility. Even if we had addressed all concerns from the previous inspection, and everything had been fixed according to their recommendations, he had to find more problems, otherwise he wasn’t doing his job.

      Being a small company, we have no choice but to do as they say, as ridiculous and expensive to fix as some of these “problems” are. If we don’t comply, they shut us down. We’ve had to lay off workers due to the massive increase in regulatory costs, and it is only getting worse.

      We will not be hiring anytime in the near future – heck we are struggling to keep as many workers as we have now. And if Obama gets 4 more years, I have no doubt in my mind we will be closing our doors soon, after 35 years in business.

      I have watched just enough hearings on c-span to believe that redistribution of American industries to underdeveloped countries has been part of our foreign policy. Somebody decided that the iconic textile industry that literally started the industrial revollution in the US when an Englishman memorized plans for mills and introduced them to the colonies should be given to certain countries like Pakistan, even if it devestated a lot of local economies. Likewise steel should go to whomever in the name of helping poor countries. Let Pittsburg be damned. Note that, even though many American advocate cutting foreign aqid and UN membership, all elite politicos just scoff at the very ideas that we should criticize their wisdom. the moralis,don’t expect pliticians to change these things.

    for all the small minded people out there, who probably belong to the 78% who can’t name the 7 continents of the world let alone know anything or have any sort of respect to other people’s cultures and believes, i have no problem with it being a safety rule, after being in this country for over 20 years, I AM SHOCKED TO KNOW ABOUT IT NOW, you have to understand why i am simply asking for the memo i missed!!! Besides i am only concerned for our fellow Jewish followers.. in their religion some believe that a woman should only wear long skirts. On rides like bat man a skirt flying in the air might be a hazard too! If the concern is a piece of clothing flying in the air, therefore whether it’s from the bottom or the top should be irrelevant. A scarf tied in a knot around your neck will not be undone by the wind not to mention the safety pin the holds it around your neck. This is not a hat the will fly off, therefore in that case your only concern should be the piece of clothing flying in the air, just like long skirt wrapped around your waist will not go flying in the air a hijab in a knot and a safety pin will not fly in the air and put your precious life in danger!!       Strong arm government on FULL display, from the pages of history you saw it in pre World War II Germany. Wake up America, government was never the solution, government is the WHOLE problem, they write the laws and regulations that stranglehold our economy, all the while demonizing companies and our ultimate fuel sources when they adhere to such ridiculous, dangerous (treasonous in my view), policies and regulations, doing so (the companies) just so they can survive in the world market. The lack of safety on oil platforms = loose government oversight and checks and balances that allow such things to happen. What’s this mean? The government enforces laws and regulations that harm our country (immigration, etc.) and lapse on the meaningful safety-implemented regulations that would save American lives, at the same time using the tragedy or event that ensues to further try to demonize oil to all there mush-headed non-thinking voting base.

      ‘91 Les Paul Standard for me since new for life! I’ve owned and unfortunately had to sell some others. Still hope to replace the doubleneck some day. I’ve owned some nice guitars from other companies, but Gibsons are the best to me, no question. Being not only a great company (great guitars, info and customer service), but an American company makes getting one worth the extra dollars too. American made! American played!
      This raid is just Obama leveling the playing field. It will CHANGE when we send him back to Chicago in 2012. We’ll still be fighting his “organizing” for the rest of our lives though.
