Update: High School Senior to File Complaint After Third Racy Photo Rejected From Yearbook

Sydney Spies, the Colorado high school student whose provocative senior portrait was rejected from the yearbook, has vowed to continue to fight even after a third photo was rejected and she was forced to use her school ID picture instead.

As The Blaze previously reported, the 18-year-old made headlines in January after submitting a photo of herself dressed in a short yellow skirt and black midriff and shoulder-baring top to run in the Durango High School yearbook. The photo was rejected by the student yearbook staff, who said they didn’t want to run something unprofessional.

Since then, she submitted two additional photos that were each rejected as well before the yearbook’s editors decided to use her ID photo. Miki Spies, Sydney’s mother, told the Denver Westword magazine the family plans to file a formal complaint over the matter.

“Sydney feels very bullied, by the entire school, basically,” Miki Spies told the magazine. “The school has been awful and the kids have been awful. She’s received very little support in any way from anybody. There’s been a ton of cyber-bullying, where people can say whatever they want without looking the person in the eyes. It’s been extremely hurtful for our entire family.”

Miki and Sydney Spies fought back after the first photo was rejected by the yearbook staff, holding a protest in front of the school and charging that Sydney’s First Amendment rights had been violated. They said school administrators barred the photo because it violated dress code policy, though the yearbook editors maintained the decision was theirs alone.

“We are an award-winning yearbook,” Brian Jaramillo told the Durango Herald in January. “We don’t want to diminish the quality with something that can be seen as unprofessional.”

The Spies family submitted a second photo, this one of Sydney posing in a strapless black dress and grasping a wall, which was also nixed. They then tried a third “model-type photo,” Miki Spies told the Westword, which she said was rejected because they didn’t submit it in time. She didn’t specify which photo out of the ones released to the magazine was selected as the third shot.

“The yearbook adviser and editors have decided to use my school ID picture as my senior photo. Since I went to NY, then had the flu they said I was too late to submit another Sr. picture,” Sydney Spies wrote on her Facebook page, according to ABC News. “They ALSO decided that I couldn‘t use the ’controversial’ picture in my ad anymore that I had already paid for, so I requested my money back. I also dropped my yearbook class because its become a hostile environment. What a lovely Sr. year this has turned out to be…”

After her first photo was rejected, the yearbook staff initially told Spies the photo could run in the back as a paid advertisement.

According to the Westword, the staff’s decision to use the school ID photo was the final straw for the family: Miki Spies said she plans to copy a formal complaint to the school board and the superintendent so that they “acknowledge that there’s been a lot of mishandling of this situation.”

Addressing the controversy on her own Facebook page, Miki Spies defended the actions that she said have prompted people to question her parenting skills.

“My kids tell me everything and I try to guide them as best as I can. But in the end I allow them to make their own decisions resulting in their own successes or failures,” she wrote, according to ABC. “I don’t see what resulted with all of this as a failure at all. Sydney has had the world see her photo. In my opinion the fact …that she would love to be a famous model someday shows that she made a pretty interesting decision! No matter how all of this turns out my daughter made her own choice and is ready to make her own way.”

      When I was a HS senior (1996) we were only allowed headshots, you couldn’t even have your hands in the pic. I had friends who simply aren’t in the yearbook because they had their hands showing. Well, they were mentioned in there, but in the back listed under “Seniors not pictured”. Nobody sued, because there were rules and we actually had respect for the rules, and that wasn’t even that long ago. I am sad over what is happening with our youth.

      As a 22 year old female, I can say that she’s in the wrong. Whether she‘s attractive or not isn’t the issue here- it‘s the SCHOOL’S yearbook. If she wants her racy pictures to be published, she can do it with her OWN yearbook on her OWN time. Spoiled little *****..lol

      All you people making judgments about this girl’s morality or personality are way off base. Neither you nor I know her. All we can accurately judge is what she has done with three pictures of herself. And that is brilliant. She, at the cost of three photos, has engineered a publicity campaign worth millions of dollars. Can any of us make the same claim?

      I thought not.

      The fact that she is strikingly beautiful seems to have the more prurient of you all worked up. Take a cold shower and be prepared to see this young lady appear in a high paying job at one of the better known publicity companies.

      A few years ago when I was working, there was a nineteen year woman who enjoyed sex. Most of the men had negative condescending disparaging remarks about her.       Hey, I‘m not knockin’ it! I think this young woman knows exactly what she’s doing and exactly where she wants to go. I don’t have any judgement what-so-ever. I think she’s hot and I find her attractive. I don’t care who she sleeps with, that’s her business.       This woman is marketing herself as a model. The school and press are presenting her as (to be polite) inappropriate. I think her mother is right; let her try to ‘market’ her style however she wants. Let her learn how to be a business woman. There are many double standards in our society. She seems to be standing up to such a double standard. (yes, I may be reading too much into this.) She is entering the market place. I hope she finds her market. If you find her ‘product’ undesirable do not buy it. If there is no market, she will fail, and the converse is true as well. She is challenging the standards according to the established protocols of the school system. We will see, I am sure, in the following weeks the result.

      This is not the government telling us what to do. This country has ALWAYS had a wide variety of behaviors. Some succeed some do not. If a person is not harming another in their activities, have at it.

      Regardless of how the appeal turns out; the yearbook guidelines will surely change.

      I’ve never seen yearbook photos showing full body lenght, most are head and shoulder shots that can be reduced and still see the face. Just tell her this is not acceptable and not put her photo in the book. This is just another woman thinking she is better than everyone else and rules don’t apply to her. Leave her out of the book alltogether. Bring her nose down a few notches.

      Good looking and surrounded by ugly liberals my foot. I am a very good looking female and I am also NO PRUDE, but I would NEVER want my yearbook picture next to anyone’s dressed as a ******. Model indeed. My aunt fanny! Who thinks this is a good image for high schoolers? Even by today’s (lack of) standards this is appalling for a yearbook picture. It is certainly appropriate for an ad advertising for “adult” services, however, and that is exactly where it belongs. I am sure the apple doesn’t fall from the tree here. Her mother must also be a real piece of (totally degenerate) work and her father a milquetoast who hasn’t got the backbone to marry someone with standards and pass them on to their children. It has been my experience in every case that where you have a daughter who dresses like this, her lack of self-respect is also found in the mother. These people don’t even know the difference between what is appropriate for modeling pictures and what is appropriate for yearbook pictures. This is the level to which America has fallen and it will get worse because this little ****** wannabe will most certainly create more of her kind, just like her mother did.

      I wonder if you have any idea what you sound like? You contradict yourself and are extremely judgmental. You may have a different standard of what you think is “acceptable” but by what authority is your standard better than her’s? Or anyone else’s for that matter? Maybe a yearbook isn’t the right place for a photo like this, I’ll give you that. But I applaud this young woman for pushing the envelop on conventions. You all look at this as something shameful and abhorrent. You in particular see this as a girl with no self esteem. I see this as a young woman realizing that she has power and is unashamed of her sexuality and good looks. She may not be as dumb as you all think she is. Only time will tell. Maybe she will be a model. If that’s what she wants, fine. Go for it. Good luck to her.
      I dunno,… for someone who says she’s a “very good looking female and NO PRUDE”, you sound a little stuck up and really up tight. What exactly does that mean anyway,…. NO PRUDE?

      How about Madonna? Lady Gaga? These ARE highly successful secular women. Some of the actions these women have done fall in the same category (to me) as professional sports personages. I do not need to describe any of the things I do not like….I do not buy nor watch them. I vote with my feet and my dollar.
      Unlike obamacare which i will be FORCED to either buy or pay a fine (then jail).

      People can be WHATEVER they want to be. The issues are the rules and regulations of the private entity called the school yearbook. Both parties are debating the policies. This is an ongoing story. The guidelines of the yearbook are in question.

      My soul is just fine, y’all. And you people are exactly what I am talking about, actually encouraging this type of behavior! The school has every right to demand that students comport themselves with dignity and these pictures of this……person…… are anything but dignified. I hope she gets EXACTLY what she is asking for. She deserves her 15 minutes of shame and so do her disgusting family. I would object strenuously if this type of picture were anywhere near any of the other students who obviously understand what “standards” are. I can see that his group has none.

      Hey, all of you; – Winged Wolf, and everyone looking at this girl are justified in making their own judgements. That’s what happens:

      The Bible says,”…Man looks on the outward appearance, but God looks at the heart…”

      Now that is often interpreted to say that we should look at the heart like God does…But…Guess what! WE CAN’T!!!

      So if this girl doesn’t want people judging her, maybe she should stop making a SPECTACLE OF HERSELF!!!

      It’s not like this girl is making a name for herself by doing some GREAT THING; Wowing us with her brains, or her sports acheivements, or her good deeds. All we have to go on is her LOOKS and her LACK OF DECORUM. She’s showing poor character by even the manner in which she is doing this. She is acting like a boar, – and doing something weird, just to make herself the CENTER OF ATTENTION!

      People like that TURN OTHERS OFF, whether even if they are doing some of the impressive things I listed above. IT’S ALL ABOUT THEMSELVES!!!

      And this girl is showing that spirit IN SPADES!!!

      She needs to go to Las Vegas where all her type have their own newspaper advertising girls for the evening. The corner newspaper machines are full of girls like her wanting to play games, if that’s her ambition. High School yearbooks are not the right place for her outrageous actions. Modeling is one thing, but not what she’d doing. Hostile environment at Durango high school? You asked for it baby.

    Lets think about this for a minute. There is: No Child Left Behind which actually leaves everyone behind; schools dump bull into the heads of children; They don’t teach about America not really; The department of education and health wants to pass out contraceptives to children. I don’t think they really care about these pictures which are actually borderline, but that they are thinking of the America they want in the future, and lets face it, she is white and hot.

      to heck with vivid, i got a handycam and a a few min to make my acting/directing debut. seriously cant this chick use a normal picture, that dosent make her look like a headshot for a stripclub. the pics are not ‘obscene’ but not really appropriate for a HS yearbook. there are so many other shots she could do, the fact she only wants to use sexy ones shows she has an agenda
