Update: House Nullifies Votes of Two GOP Reps. Who Skipped Swearing-In

WASHINGTON (AP) — House Republicans had to correct a first-week gaffe by nullifying the votes of two of their members that were cast before they were sworn in.
Democrats pounced on the mistake, saying Republicans violated the Constitution on their first day in the majority by allowing the pair to vote six times before they were sworn in.
The House voted 257-159 to nullify those votes cast by Pete Sessions of Texas, the party campaign chief, and Mike Fitzpatrick of Pennsylvania. Retracting their votes didn’t affect any outcomes. The two were at a reception when others took the oath Wednesday. They were sworn in Thursday.
Democrat Anthony Weiner of New York said it also violated the Republicans’ newly approved rule that legislation be made public three days before being put to a vote.

Weiner also made a parliamentary inquiry on whether members can be paid before they are sworn in, but the acting House Speaker said this question was not asked in a proper form.
Before the brief debate took place, Rep. James McGovern (D-Mass.) asked whether a non-sworn-in member can preside over a committee. The Acting Speaker said they could not, but H.Res. 26 ratifies their participation in any proceedings before they were sworn in. This issue is relevant because Rep. Pete Sessions (R-Texas), one of the members not properly sworn in, chaired portions of Thursday’s House Rules Committee hearing on a rule for healthcare repeal legislation.
The measure invalidates the votes taken by the two members before they were sworn in. But otherwise, it would essentially treat Sessions and Rep. Mike Fitzpatrick (R-Pa.) as if they were sworn in on Jan. 5 with other members.

The nullifying of votes was the proper action to take, and it was taken. All in all, this is a non-story except perhaps to show some level of integrity in Congress, for whatever reason.

Also, if I understand this correctly, legislation means laws and making the public aware of a vote to not allow the not sworn in members of the House is following existing law, not voting on a new one. First of all he didn’t actually answer any questions, he just came back with another questions. And second, his only response was “well now that the republicans are in office what are they going to do”. It really showed that we will never get a body of legislator’s who actually care about our country or the people in it. They really are only about themselves and their party line. So much venom and hatred. You never win in situations like this.

That will give the three day and then some period the republicans have promised.
Mr Weiner needs to do some fact checking for one time.

Their oath would stand as constitutionally valid in any court. I don’t care what the moonbat congress critters and the leftard media are saying. One lone Republican with some smarts was trying to make the point that they we in the building, but the moonbats would have none of it. What a bunch of grand standing losers.
Fitz is my Rep and I voted for him. This is not an issue at all to me. For those saying they were “courting donors” and fundraising that is false. It was 500 constituents from Bucks who came on busses for a tour and to see how government works. That’s it, he was making himself available to the people. Unbelievable what fires people up and what doesn’t.
Ok, please (anyone) point out to me the part of Article VI section 2, that says you must be “in the chamber” not in front of a TV set in order to take the oath of office. Here it is:
“The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution; but no religious Test shall ever be required as a Qualification to any Office or public Trust under the United States”
I am really getting sick of the vitriol from supposed conservatives against my rep. This is unbelievable.

Does protocol mean anything to you? Protocol is necessary so that things are done in an orderly fashion. Pretty soon we would have Congress voting via video conferencing too. Those two have to get their act together and not schedule tour events when Congress is in session.

Don’t know how he got caught “out of pocket” when they administered the oath, but he may have thought that doing it “remotely” would suffice. At any rate it was a screw up, though not one done in arrogance.

Missing the swearing in ceremony is really inexcusable. Their constituents should let them know how dissappointed they are with them and their lack of taking their job seriously.
