Utah School Fined $15,000 for Accidentally Selling Soda During Lunch

A Utah high school is learning the hard way that the government is serious about nudging students away from food it doesn’t want them to consume. Davis High School in the Salt Lake City area is having to fork over a whopping $15,000 in fines to the Feds because it accidentally sold soda through a vending machine during lunch.

Federal law requires the school to turn off its soda machines during the lunch period, which is 47 minutes a day. And Davis High school did turn off the machines in the lunch room. However, the school didn‘t realize that there was another machine in the school bookstore that wasn’t being turned off. And when the food police realized it, the school was hit with a $0.75 fine per student for the duration of the offense.

Now the school is going to have to cut money to fine arts programs to make up the cost.

KTVX-TV has the report:

But here’s where things really get nutty, so to speak. Davis High School Principal Dee Burton said that the law is disingenuous. For example, while students can’t buy soda, they can buy sugar-loaded sports drinks and even Snickers bars because they contain, you guessed it, nuts. In addition, students can buy soda earlier in the day before the machines get turned off and drink it during lunch.

And simple economics is at play, too. The ban isn’t forcing students to stop drinking or eating the sugar-laced food and drink. It’s just driving them to places where they can get it.

“The misconception is if we don’t let kids buy candy and pop, we drive them to the cafeteria, it doesn’t drive them to the cafeteria it drives them off campus,” Burton told KUTV.

One commenter on the KUTV website picked up on that.

“The principal is right, the kids will leave campus. What are you going to do? Close Walmart and Quick Trip for 47 minutes every day?” the commenter wrote.

Don’t give them any ideas.

    My answer is simple: civil disobedience. Don’t pay the fine. Get a lawyer to represent Davis HS pro bono. Maybe when such resistence crops up everywhere the gov‘t can’t prosecute them all.

The Feds, are, you see, a federal government entity, run by, guess who, the federal government, which is currently the obama administration, and his nazi food and car and energy and …………….czars. The State of Utah had nothing to do with it.

      A lot of us are piling on Jrook for his oversight. It might not just be liberal prejudice that influenced him, though. In a sane world, the federal government would have NOTHING to do with soda machines in high schools. The assumption that things will be sane can effect a bias as much as a political agenda.

And fining the school means the taxpayer picks up the fine and the school (as in this instance) has to cut funding for programs to deal with their Orwellian slap on the wrist. When I was in school, we had a vending machine, but no sodas were sold, only fruit punch and lemonade, BOTH with more calories and sugar than the soda!

      The president can solve this problem with the stroke of his executive pen. He should make a new law that say schools taking Federal dollars shall trash all vending machines ASAP. The kids will have to buy the balanced meals and drink water from the water fountains only. This will also stop all the graft and payoffs that Principals get to stock certain drinks and junk food.

      Exactly. This is called Capitalism and the free market system and the “law of supply and demand.” Just like states that prohibit fireworks whereas adjoining states that don’t. A person drives across the border, buys several hundred dollars of fireworks, then drives back home and sells those fireworks at a an extreme markup. If there’s a demand, there’s practically no limit to what one will pay for a given product. Apparently this “Federal” gov‘t of ours just don’t get it that they are actually causing more problems and encouraging price-gouging for illicit items just like some states do that outlaw fireworks while an adjoining state doesn’t.

Its up to the state and locality in the state to decide what is best for its population.       Hm…because something wasn’t there when you were in school, it’s stupidity. No idea how old you are, so I’ll go with my own experience.
      Copiers are stupidity…I have wonderful memories of being chosen to run the hand cranked mimeograph machine. I miss carbon paper too!
      Computers…who needs them, we learned just fine with books.
      TVs…film strips were so much more, I don’t know, riveting.

    Let me see. The local tax payers fund the schools through overbearing property taxes to fund excessive UNION teachers saleries. The Feds then come in and fine the schools an over bearing amount which has to be taken from property tax payers taxes to pay the Feds. In turn the school puts up another levy for more funding because they have run out of money because they were fined by the Feds for not turning off a pop machine that was not accessible to students during lunch anyway because it was in a bookstore and not the cafeteria. Sounds to me like the inspector was the product fo a Unionized public school education because they are dump as a box of rocks. IF this jack booted Government (Of, and by Moochelle) food policeman was doing his job a simple warning should be enough at this time. BUT NO! They acted as a complete moron. Don’t pay it and make them take you to court. One more freedom will be lost to the all encompassing big gulp of the Federal Government. and the Goodyear blimp in the White House, if you don’t. And to think she called Oprah fat and didn‘t want her near the White House because it wouldn’t look good., such hypocrisy.

      Goodcook: Then to put the icing (sugar) on the cake; my Granddaughters in grade school, come around and sell us unbaked “sugar” cookies as a fund raiser for supplies, because the schools budgets are busted. Here is Utah we have superintendents making high six figures and I buy “sugar” cookies so my grandchildren can have paper and pencils? Education has nothing to do with children anymore, it is all about the adults…

    We have thousands and thousands of regulations from the feds dictating every activity of our lives,and the idiots in congress are paid to create more laws and regulations to control us,it’s maddening and disgusting.I wouldn‘t be surprised if in the not to distant future we’ll be required to have on display in our government approved ‘living space’ a picture of the tyrant currently ruling us serfs.

    And they wonder why the school system is not up to snuff…..get the government out of our school system….let the teachers have control of the classrooms…..go back to the basics of reading, writing and Mathmatics……like the article says…money will now be taken from the fine arts program to pay the goverment…… Yea for the governments wisdom…..       Blackcrow is right. At what point in time did the Federal Government get the authority to dictate what is sold in a state school? The schools must not teach about US History and the Constitution anymore either because there are many ignorant sheep out there now.

      When they took a dime of federal money, they became slaves to all federal regulations. The federal government on average only contributes 10.8% for education with the rest from the state. But that 10.8% obligates the schools to follow all federal regulations.

      It was the same way with the 55 MPH national speed limit. The feds did not have the power to make it so but withheld federal highway construction money from any state that did not comply.

      I would like to see one state refuse federal education funds and burn the regulations during a football pep rally. Then watch how education improves.

    Don’t pay it, keep the soda machine on, tell the Fed food and drink police to go to hell.

      We need to start the cleaning locally. Our governers, our state legislators. If Utah didn‘t have Herbert who caved and took the money from the Feds in the first damn place then they wouldn’t be able to make these demands. We need to hold our local government to a higher standard, and say NO! to the Fed encroachment.

      They have a law similar to this in Nevada. No school shall sell soda, so the schools have had to change out all the contents of soda machines with juice, gatorade and water. However, this works at elementary and junior high schools, this is pretty ineffective for “stopping kids from getting soda” at the high school level since they can either bring it from home, or since lunch hours at a majority of schools are open campus, you just go to 7-11 and stock up on Monsters or something.
      The sales of food on campus should be set by the districts and schools not the skidmarks sitting in DC, touting their education philosophies of standardized tests..
