When Martha Boneta hosted a birthday party for a friend’s 10-year-old daughter on her Virginia farm, she didn’t expect to have the county come knocking on her door.

But come knocking it did — threatening her with nearly $5,000 in fines.

Fauquier County officials say Boneta, owner of the 70-acre Liberty Farms in Paris, Va., didn’t have the proper permit to host the party, nor to sell produce on her own land. Zoning Administrator Kimberley Johnson sent her a cease-and-desist letter in April after the party, warning her with the financial consequences if she didn’t stop her activities within 30 days.

Boneta told Fox News she wasn’t doing anything wrong — that selling produce is just about as old as farming itself, and that curiously she seems to be the only one being targeted — possibly because of a neighbor’s complaint.

“It’s rather odd that I’m the only farmer in the county having these issues,” she told Fox. “It’s customary to do these things. It’s done on farms throughout Virginia to help farming and agriculture.”

Boneta did actually get a permit last year to sell fresh produce and crafts at her “retail farm store,” but after she received it, county regulations changed to require an additional permit to sell certain items — including handspun yarns and birdhouses — once covered under the one Boneta already had.

That’s why fellow local farmers took up pitchforks last week for a “pitchfork protest” outside the Board of Zoning Appeals where Boneta was having a hearing. They believe Fauquier County could be violating Virginia’s Right to Farm Act.

“The minute that we get to that level, every farmer here in this county is going to be in violation of this ruling of the county,” Pam Holloway of Go Farm U told Economic Freedom during the protest.

Boneta lost the Aug. 2 appeal but said she plans to try again. In the meantime, she’s closed up shop to prepare for the upcoming harvest and will be working with her fellow local farmers to come up with a plan of action. According to Hot Air, the Institute for Justice, which specializing in helping small businesses in similar situations, has taken up her cause as well.

“This affects every farmer. It affects our ability to earn a living to produce and sell on our own land,” Boneta told Fox.

      As citizens of this country it is simply time to take it back. People we can no longer just sit by and vote. It is time we demand change (not the Obama kind) from our local governments. It’s time we de- regulate the United States so that businesses may yet again flourish here instead of in China nd India.

      Everone has to stop applyng for licenses, registrations, etc. This is part of how they get you. You ask permission to do what is otherwise entirely lawful and within your right to do. i.e. drive a car, sell product, do a repair or improvement to your home. If you assume you need their permission, they’ll assume they have the authority. Stop because God is watching.

      This is just the tip of the iceberg !! Nine years ago Charlie Ray Fox Jr. was voted into office as Fauquier County Sheriff as a Democrat. From day one he started to ‘clean house’ by firing one after the other without cause, ( Sheriff,s can do this by law ) the intial firings were aimed at the Command structure most were not ‘born and bred
      Fauquier’ but all were very qualified, something the previous Sheriff ( a Republican) had insisted on in an effort to bring the office in line with surrounding jurisdictions.
      However over the next five years Fox’s administration slowly weeded out 55 officers !! 55 out of 120 sworn !! At first we all had no idea what was going on, after all we came to work and busted our tails, put our lives on the line and still we had our careers ripped out from under us. Then a few got together to compare notes and surprise surprise, almost to a person we discovered we were registered Republicans.

      This will never come out in the local press, The Fauquier Times Democrat, because the paper is so far left its not funny, just read the weekly editorials for a taste of opinion in ‘Hunt Country’ !!.

      I will be labled as a ‘disgruntled former employee’ should this story ever get some traction and I will be the FIRST to say hell yes I am disgruntled !! I had my career stolen from me without cause and consequently my wife and I lost evrything we had worked so hard for. What about the other 54 people and their families !! Can’t wait for the next el

      Paul99, wasn’t the last republican sheriff booted out because he closed a wing of the county jail, had it carpeted and decorated to house the daughter of a local socialite who was being detained? I’m not sure if Fox won because he was a Democrat or in spite of it. This county is all about the good old boy network. It’s who you know and what enemies you make no matter which party you are in.       Her neighbor making the complaint is a wealthy real estate speculator and real estate broker out of Middleburg, VA. He is from an old and well respected family in Virginia and if this Boss Hogg says her birthday party constituted commercial activity then the (supposedly Republican) county politicians he controls have to agree. He is trying to sell the vacant lot next to her for twice what it is worth and blames her with her two by three foot sign advertising her shop as keeping potential buyers away. When an earlier county inspector ruled their complaint on the farmer for abusing animals by housing rescued farm animals was unsubstantiated, his wife who is an attorney reportedly sent an email to the official threatening to have him fired if he didn’t change his ruling. This family has a lot of pull but I don’t know if it is out of respect for his family or his financial support in elections. Still, this is but one instance of the Counties new aggressive tactics to limit growth and keep the working farmers at bay. Farm Wineries have now been severely limited by a new ordinance passed last month that may put many of them out of business.

      To be honest, Phil is probably having a hard time financially since he had to pay estate taxes on his father’s 1200 acre property (at the foot of the blue ridge 50 miles from downtown Washington DC) before the market crashed and he may have been overextended when the market crashed. If he hadn’t put so many restrictions on the property though when he tried to sell it he could have sold it much faster for much more money. He turned down multiple offers by people who wanted to use it for a resort. His personal financial stress though was brought on by his own actions and shouldn’t be used as an excuse to control others.

    The country assessor just left my place. This state raised taxes on just about everything and my property tax increased by almost 42% this year alone. Now I can expect more after this “visit”.

    They can’t afford to buy ALL property, so instead they regulate through zoning laws that elminates almost all practical uses of land.

    You are seeing your freedom being abused and the regulators wasting precious gas driving out to her farm. Did the President have a permit to give his children a b/d party or did he have a permit to serve food to any dignitary. Did his wife have a permit to plant her garden?     I just for the life of me can’t understand this. I grew up in a smal farming comunity and the people that sold stuff did it to make ends meet. They didn’t have the money necessary to pay for all these dumbass permits you need for everything these days. (TAXES) Damned government theives.

      You need a permit to grow your crops and then you need another one to sell it. When you have invested your life savings in growing the crops for the year the county can then revoke your permission to sell them forcing you into bankruptcy to make your families farm land available to the wealthy speculators and new breed of Washington transplants looking for an exclusive estate in the outer suburbs

    I live in southern NJ and bigger farms and small backyard farms alike sell their produce a their stands. The gov‘t needs to stay out of small farmer’s markets’ business.

    There is a BIG difference between RINOs and the Tea Party. RINOs love regulations and wars and BIG GOVERNMENT especially a MASSIVE military complex = Collins, Romney(care), McCain, Graham, Brown, Snowe – etc. These RINOs would NEVER in a million years get rid of even one fed department like Jimmy Carter‘s Dept of Ed or Nixon’s EPA and other departments OR get rid of Bush’s out of control Homeland Defense. The BIGGER the better for them.

    SHEEP GOP voters think just because a candidate SAYS they are republican they are. The Tea Party does not like regulations, etc. with rare exceptions. West and Bachman were both Tea Party darlings and they slipped up and voted with the RINOs and libs on NDAA. Bachman voted both times to extend Patriot Act-IDIOT. West voted NO the 2nd time – Good for him.
