Vandals Graffiti Calif. Man’s House 4 Times in 6 Months…And Now the City Might Fine the Owner for It

A California homeowner is fed up with the city of Sacramento after he was told he could be fined because his home was vandalized.
“I don’t know what I hate the most, those guys that do it or the [city council] members,” he said in frustration.
Javier Rios has had his home vandalized four times in the last six months, according to CBS13, and on each occasion it takes time and money to clean it up.
Now, rather than doubling-down on apprehending the criminals, the city council is saying Rios could be fined $373 “in addition to other related fees” if his property isn’t completely restored ten working days after the attack.
Not only that, the official letter also says “a lien may also be placed against the property for failure to pay all removal costs.”

Rios says he sometimes sits in his car overnight in an effort to catch the vandals, because he feels no one else will.
“On top of that they punish me [with fines],” he said in exasperation.
But the city maintains that graffiti only attracts more gang activity and vandalism, and that’s why it needs to be removed immediately.
Rios clearly wasn‘t sold on the council’s approach, likely thinking the city should invest its resources in arresting the criminals rather than fining the victims.
“Something’s gotta be done,” he said.

Send a letter to the city saying if they don’t arrest the vandals, you will sit in front of your home with a gun and protect your property from the vandals and see what they do. They will send the cops to your house to watch you sitting in your yard with a gun which will effectively keep the vandals away. Or send a letter demanding protection from the cops that YOU already paid for with your taxes. File a civil suit against the police dept for breech of contract.

The “kids” gang members, just kept coming back. Finally neighbors hid in the bushes with baseball bats and brass knuckles. The next day we heard they had put to gang bangers in the hospital and trashed their get away car. For weeks our street had a very visible police presence, why to “prevent further vigilante justice”. The break ins stopped over night.

Right before I moved out my 70 or so year old neighbor was robbed of her wheelchair while she was sitting in it. I called the cops they sent out a community officer the next day. I could tell you dozens of stories just like this. Cops don’t prevent crimes they investigate crimes that have been committed. Supreme Court ruled it’s not the cops duty to protect citizens. So if you call the cops for four days while you and your room mates are being brutally raped and they never show up, you can’t sue the cops for not protecting you. LOL this was an actuall case happened in D.C.

I live in TEXAS and they were going to put a lien on my house, or else have the city workers come out and trim my trees for me and then charge me, and put a lien if I didn’t pay it. All because the Crepe Myrtle in my front yard (actully on the leeway that they city is supposed to own, and I ca’t do anything I want to to it) was hanging over the sidewalk and wasn’t 14 feet off the sidewalk. Really? Who is going to get hit by a branch walking by that’s 13 foot tall? Another time, more recently, I got hit for 3 little branches sticking through my back fence about 4 inches. Meanwhile, the neighbor has a vine totally incasing his chainline fence. They made me pick up planks of wood (lying flat on the ground) and get them 6 inches up off the ground. now the rats have somewhere to hide, yea. I was also hit on the one day we had 12 inches of snow for not having visible letters on the back of my house…duh, they were covered with SNOW!

Posted on August 6, 2012 at 2:44pmIf I had his problem, I would buy a gallon of paint to match the colour of the fence with some foam disposable brushes and in the morning paint over the graffiti. Throw away the brush and do it every morning the same way.
After a week or so, the word will get out it’s useless to tag his fence. There is no satisfaction to paint something if others can not see it.
This works, I know it does.

That being said, since graffiti such as this is a crime, Mr. Rios should take photos/video and call the police/file a police report each time this happens.

Here is one of the funny things of Phoenix government; I know people who live in a HUD apartment site for the disabled seniors, several area properties went through massive rennovations, and this displaced a large band of wild chickens (yes I know, weird thought but its true), one department of the city ordered their property manager to get rid of them or be fined mega-dollars, while another dept when asked left an order saying the birds cannot be touched under Phoenix law.
I looked the ordinance up myself, and its on the books – these feral (ugh) chickens count now, after so many years, as free range and wild poultry and cannot be touched.
This guy in Sacramento has to deal with a city board more insane and desperate for cash than here. I hope he wins or moves somewhere else.
