Virginia Judge Rejects GOP Primary Ballot Appeal: Gingrich, Santorum, Huntsman and Perry Will Not Appear

RICHMOND, Va. (The Blaze/AP) — A federal judge has refused to add Texas Gov. Rick Perry and three other candidates to Virginia’s Republican presidential primary ballot.
U.S. District Judge John Gibney ruled Friday that the candidates should have challenged Virginia’s primary qualifying rules earlier. Gibney said they knew the rules months ago.
Perry sued last month after failing to submit enough signatures to get on the ballot. Newt Gingrich, Rick Santorum and Jon Huntsman also failed to qualify and later joined Perry’s lawsuit. They asked Gibney to declare Virginia’s law unconstitutional and add their names to the March 6 ballot.
Only former Massachusetts Gov. Mitt Romney and Texas Rep. Ron Paul qualified for the March 6 primary ballot.

WASHINGTON (AP) — Many of Mitt Romney’s presidential challengers are having trouble fulfilling a fundamental requirement of running for public office: getting on the ballot.
Rick Santorum, Newt Gingrich, Rick Perry and Jon Huntsman have all failed to qualify for the ballot in at least one upcoming GOP primary. In other states, they have failed to file full slates of delegates with state or party officials, raising questions about whether these candidates have the resources to wage effective national campaigns.
And if one of them were able to marshal enough anti-Romney forces to challenge the front-runner, the ballot blunders could limit their ability to win delegates in key states.
The exception: Ron Paul, who appears to have avoided such pitfalls so far.
“This is why you need a real-life, no-kidding-around campaign,” said Rich Galen, a GOP strategist and former Gingrich aide who is neutral in the 2012 race. “All these guys who have been crowing that they found a new way to run for president, it‘s like saying I’m inventing a new airplane, and it has only one wing.”
Romney, the former Massachusetts governor, won the first two contests, in Iowa and New Hampshire, and he is leading in the polls in South Carolina and Florida, the next two states to have primaries. Romney raised $56 million in 2011 for his campaign, giving him big financial and organizational advantages over his GOP rivals.
Those advantages are on display as many of his competitors miss deadlines or fail to collect enough signatures to meet ballot requirements in upcoming contests.
Santorum, the former Pennsylvania senator who came within a few votes of winning the Iowa caucuses, didn’t get on the ballot in Virginia or the District of Columbia. His campaign also filed incomplete slates of delegates in Illinois and Ohio, which could limit his ability to win delegates in those key states.
Virginia has been a tough ballot to crack for several GOP candidates because the state requires campaigns to collect signatures from at least 10,000 registered voters. Romney and Paul were the only ones who made the ballot for the March 6 primary.
Perry sued, and was later joined in the lawsuit by Gingrich, Huntsman and Santorum. But on Friday, a federal judge in Richmond refused to add them to the ballot, saying the candidates should have challenged Virginia’s primary qualifying rules earlier.
Santorum is the only major candidate who will be left off the ballot in the District of Columbia primary April 3, said Paul Craney, executive director of the DC Republican Committee. The party provides two ways to get on the ballot: Pay $10,000, or pay $5,000 and collect signatures from 296 registered Republicans in the heavily Democratic capital city.
“It’s not easy, but it can be done, if you are a serious presidential candidate,” Craney said. “All the presidential candidates who are serious about winning the nomination will be on the D.C. ballot.”
Santorum adviser John Brabender acknowledged that Romney has more money and a larger campaign organization. But, he said, Santorum’s campaign has gained resources and momentum since the close finish in Iowa. Romney, he said, has been running for president for the past six years, giving him more time to build his organization.
“It’s a different campaign than it was earlier,” Brabender said.
Huntsman, the former Utah governor, failed to get on the ballot in Arizona or Illinois.
The requirements to get on the GOP ballot in Arizona are pretty easy – all you have to do is fill out a two-page form. Twenty-three candidates managed to do it properly, so they will be on the ballot for the state’s Feb. 28 primary.
Huntsman, however, was left off the ballot because his filing had a photocopied signature and wasn’t notarized, said Arizona Secretary of State Ken Bennett.
“If you can’t get on the ballot around the country, you’re a regional candidate, by definition,” said Rich Beeson, the Romney campaign’s political director. “Barack Obama is going to be on the ballot in all 50 states, and so will we.”
Gingrich, the former House speaker, didn’t make it on the ballot for primaries in Missouri or Virginia, though he has joined the lawsuit to get on the Virginia ballot and Missouri won’t award any delegates based on its Feb. 7 primary. Instead, Missouri Republicans will hold caucuses March 17.
Perry, the Texas governor, made the ballot in Illinois, but he will only be eligible to win one delegate in the state’s March 20 primary – a contest in which 54 delegates will be up for grabs.
It will take 1,144 delegates to win the nomination at the Republican national convention this summer.
Illinois has a unique way of awarding delegates to candidates. The winner of the state‘s GOP primary doesn’t necessarily get any delegates. Instead, Republicans will vote for the actual delegates, who are listed separately on the ballot but are identified by the candidate they support.
Each of the state’s 18 congressional districts will elect three delegates, for a total of 54. To appear on the ballot as a delegate, candidates had to collect signatures from at least 600 registered voters in the district where they are running.
Only one Perry delegate filed signatures by the deadline, according to the Illinois State Board of Elections. Gingrich, Paul and Romney filed full slates, while only 44 Santorum delegates filed signatures.
Ron Michaelson, who served as executive director of the Illinois State Board of Elections for nearly 30 years, said he doesn’t remember presidential candidates having these kinds of problems in previous elections.
“They’re concentrating so heavily on the early states, devoting so many resources there that they’re not looking down the road far enough,” said Michaelson, now a visiting assistant professor at the University of Illinois in Springfield.
The system in Illinois is designed to keep fly-by-night candidates from crowding the ballot, said Christopher Mooney, another political science professor at the University of Illinois.
“It keeps people who don‘t know what they’re doing out of the arena,” Mooney said.

One top volunteer told BuzzFeed that he was shocked Huntsman didn’t drop out on Tuesday. “I was hoping he would. I don’t want to be disloyal or anything, but he doesn’t have a chance anymore. Once he quits, then I can go work for a winning campaign.”

@Stuck – It is the candidates own fault that they did not get on the ballot in these states. They didn’t submit their homework in time, and didn’t have the gravitas to be able to assign one or two people in their campain to look after the issue. This is such a rudimentary thing to elections. It goes to show their leadership abilities and qualities.
Do you really want a president that can’t do his/her homework, follow the rule of law for elections in these states, and not follow through on important issues? Don‘t say it’s “too bad,“ or that it ”isn’t fair.” What a progressive mindset. It’s a consequence of poor planning and decision making. Blame the candidate, not the process. That is what Gingrich, Perry, and Santorum were doing in VA. They were blaming the process, and using the courts to bully their agenda. What kind of character does that show? Kudos to the Romney & Paul organizations for doing it right.

A federal judge in Virginia said today that he will issue a decision soon on Rick Perry‘s challenge to the state’s ballot access laws — and that the Texas governor is likely to prevail:
[T]here is a strong likelihood that the Court will find the residency requirement for petition circulators to be unconstitutional. The authorities make clear that circulating petitions for candidates is a form of protected speech, and that the Commonwealth has a heavy burden to justify the restriction on speech by showing not only that the limitation achieves a valid state interest but also that the limitation is no broader in scope than necessary to achieve that purpose. As in all strict scrutiny cases, the state has a difficult task to demonstrate the propriety of its limitation on protected speech. For this reason, the Court believes that the plaintiffs have a substantial likelihood of succeeding on the merits, at least on the issue of the validity of the residency requirement.
The judge also ordered the Virginia State Board of Elections to hold off printing ballots until the issue is resolved.

I believe Paul and Romney did their due diligence and acquired over 15000 signatures. If you had over 15000 signatures then the signatures weren’t verified. If you collected under 15,000 signatures then the signatures were verified….those were the rules.
I read also where Romney’s team did a statistical study of sample signatures on the petitions and their error rate was quite low…so they felt quite confident that their signatures would hold up if the signatures were scrutinized.
Paul and Romney’s teams were clearly more proactive and organized than the other candidates…end of story.
Rewarding people who fail to do the work sounds like a Democrat’s work ethic.

[UPDATE]: OK, I’ve just read the ruling. Short version: the court is denying the plaintiffs their injunction because they waited too long to file it (and the judge used here rather forceful language about that delay that will no doubt gladden the hearts of Romney/Paul supporters across the land); while at the same time noting that the in-state requirement for petition circulators is almost certainly going to be ruled unconstitutional by the courts, given recent case law. Bad news for Gingrich, Huntsman, Perry, Santorum; good news for ballot access people in general.
I think that this one’s a dead issue now, folks. Except that the next election in VA will probably allow out-of-state petition circulators.

It would be interesting to hear why the state threw out those signatures. Maybe the handwriting was too similar with the signatures on some of the petitions. I wouldn’t rule out voter fraud by zealous Perry campaigners. This could happen in any campaign.

He has stated that the theory of anthropogenic global warming is real. In 2005, as governor of Massachusetts, Romney imposed strict state limitations on carbon dioxide emissions from power plants. In a memo issued by Massachusetts Lieutenant Governor Kerry Hale, the Romney administration bragged that it was “the first and only state to set CO 2 emissions limits on power plants.”
In short, Romney did what Obama’s EPA wants to do now. It is revealing that Romney was advised on this drastic step by none other than Obama’s chief science adviser, John Holdren.
In his book, No Apology, Romney advocates carbon taxes through a “tax-swap plan” and declares that resultant “higher energy prices would encourage energy efficiency.” The plan is favored by economist and Romney adviser Greg Mankiw and many other “Republican-leaning economists.” In 2007, Mankiw wrote an op-ed for the New York Times entitled “One Answer to Global Warming: A New Tax.” He wrote that “if we want to reduce global emissions of carbon, we need a global carbon tax.”

One of the things I find frustrating about the right’s stance on global warming is that they also bash regulations or policies to keep cities and communities healthy for people and then use their anti-global warming stance to back it up. I am conservative, and I DO BELIEVE that man does have an impact on the environment, and it is not all about global warming. It has to do with safe and clean environments.
If you have ever lived in a polluted city, you will know that clean air is a good thing for a multitude of reasons. I like leaders that seek to create safe and clean communities. Don’t you? Or has the excess carbon dioxide in your community diminished your rational thinking abilities?

I would imagine the campaigns have to actually pay staff to LEGALLY sign people up. From what I understand the law requires a number of signatures from each of the congressional districts. Yes, ‘some’ Active Military have donated to the Paul campaign, but he mostly attracts young Reservists and Guard with a part-time militia attitudes who just want a few bucks to go to college, make some extra coin, get a little training, and show off to the boys and girls their new threads from Uncle Sam. For the most part, war never enters or entered into the equation until they were told to go (if they and their units went).
The Active duty that support Paul are usually young one and done’rs, who most likely had a hard time with adjustments to Military life and couldn’t quite fit into a life of regimentation,discipline and usually fall into the disgruntled category… whether it be from serving in a combat environment, serving an assignment not to their liking, or just plain didn’t like the Military. Most probably shouldn’t have been in the All Volunteer Military in the first place, but give them an A+ for trying.
There are a few in the ‘other’ category who might be some ‘Nam Vets, some 20+ yr Retirees and a few currently serving more than one or two tours (or enlistments) who just happen like Ron Paul. To them I say… go for it, but I don’t believe that the pacifist, anti-war, isolationist Libertarian Ron Paul has your backs. I think you are just pawns in his campaign of non-existent hype.

Did you serve yourself, or are you just making **** up? I guarantee that in the post-9/11 world, where we have been at war for over a decade and peace is not something that looks to be coming unless Paul is elected, war is foremost in most people’s minds when they volunteer. I know that it was on my mind when I tried to join through ROTC, and was rejected on medical grounds due to hearing loss since I was a child. It‘s definitely in my brother’s mind as he goes to school at the Air Force Academy (and supports Ron Paul).
It might be that the numbers of military that donate at all are relatively low. It might even be that some civilians that work for the military are counted in those totals. Or not. Either way, attacking the CHARACTER of the men and women who serve and support Paul? That’s just low.

I suppose that explains his detailed plan to cut $1 trillion from the budget in the first year, and balance the budget before his first term is up? Oh, wait. That’s Dr. Paul’s plan.
Rick Perry has a different plan. To balance the budget by 2020 (conveniently requiring TWO terms to do so). And specifics? Not really. He says he will cut non-defense discretionary spending by a whopping $100 B (peanuts) the first year, but doesn’t say how. And to balance the budget? He will push for a Balanced Budget Amendment (like everyone else has been doing, and what will not work) and cap spending at 18% of GDP (again, conveniently not telling us how).
Maybe Perry’s serious, despite his lack of specifics. But to say he is the “only” fiscal conservative in the face of Paul’s much bolder, and just as conservative fiscally, plan is ludicrous.

He is not going to be able to get the delegates needed to win as he is having a hard time getting on states and district ballots. You cannot get the delegates needed if you are not on the ballots. Posted on January 13, 2012 at 4:53pmYup, in NJ when scandal broke out on a Democrat running for the Senate, liberal judges ruled that he could be replaced, and the Democrats could run someone else in the general election, overruling the current law in place. They cited that the voting public would be “disenfranchised.”
Apparently they are not concerned with disenfranchising the voters in VA, but rather with upholding current law… this tells me the judge was probably a liberal…

As long as the activist judge does what YOU want, he’s a great judge – just as long as he doesn’t do the exact same thing for the left. God forbid a judge that upholds the Rule of Law regardless of political affiliation of the plaintiffs or defendants.

But, we would be under dictatorial rule either way if the general election is between Obama and Romney. Face it, people who will only vote for a man who supports the Constitution will not vote for Obama or Romney. In the primary elections thus far, Ron has garnered ~20% of the vote. That means that Romney is losing 20% of Republicans right out of the gate. Trust me when I say that you could not pay me enough to get me to vote against the Constitution and my conscience.

You and your ilk are the reason we can’t win enough to seat the congress too… So, your candidate is not on the President bid… You know that Senators and Representatives will be though. Everyone puts too much on the Pres… The two issues for that is:
1) Appointments (and congress needs to approve those)
2) Veto Power (but Congress can bypass that with 2/3 majority)
Focus on getting Senators and Representatives that are Conservatives. If we get enough, the Repubs will need to shift (especially Romney). Even if Obama wins (by some Miracle or fraud), enough Repubs will neuter any hopes of him. And if he doesn’t play nice and plays Mr. Dictator? Hello Impeachment.
People have to quite looking at one candidate as a reason to vote. This mentality is screwing us over every election an why the libs keep winning. Even when we get an R in office it is a progressive one at that. Conservatives must turn up for the election. Hell, don’t vote for pres (though you should). YOU MUST vote for other seats.

Romney supported bailouts and has absolutely no interest in auditing the fed. Romney will make sure his buddies that have dirt on him will be taken care of with more government intervention and low interest rates that the banks and financial sector are still taking advantage of. What will happen is that in 4 years Mittens will be thrown back out and another democrat ping-ponged back into office if he can even beat Obama. That‘s why I’m voting for Paul, not because he’s the perfect candidate, but he’s right on the economy, liberty and an actual national defense, not a national offense. Paul can win cross-over independents and dissatisfied democrats who care about civil liberties and who don’t agree with our offensive warfare, and especially the youth vote. Substance over style this time for me. Romney could not even win the south against Huckabee last go-around, and even the democrat McCain beat him. I voted for Romney last time, and it was a complete waste of effort and energy. Paul evokes passion out of his base, which has a core belief in our constitution and individual liberty. That‘s why I’m sold on Paul even with his shortcomings, we need respect for the rule of law and our constitution now more than ever.
