A Richmond, Va. mother has been ordered to perform 50 hours of community service because she let her daughter draw on rocks with chalk.

Susan Mortensen, 29, was ticketed for vandalism in March after she allowed her 4-year-old daughter to use sidewalk chalk on rocks at Belle Isle, a small city park island in Richmond, WTVR-TV reported. A judge on Tuesday ordered her to paint 200 outdoor posts by Jan. 3 or face a $2,500 fine, according to WWBT-TV.

Officer Stacy Rogers testified that when Mortensen was told drawing on rocks was not allowed, she became “verbally abusive,” according to the Richmond Times-Dispatch. Mortenen’s lawyer, G. Brian Tacey, told the judge his client knew she overreacted and was sorry for the confrontation with police.

Police and park officials have said they’ve had a problem with people drawing on the rocks and have cracked down on property defacement. They’ve also said chalk is the same thing as graffiti, according to WWBT.

According to WTVR, it’s actually not the first time Mortensen has been in trouble over the rocks at Bell Isle: She was convicted of property destruction two years ago for painting on them.

On Tuesday, People gathered outside the court to support her, bringing buckets of their own chalk and drawing on the sidewalk.

One supporter, Meg McLain, told WWBT there’s no comparison between chalk and graffiti.

“When you spray paint something, it’s pretty much there. But when you chalk something, it rains, it’s gone. You’ll never know,” McCLain said.

James River Park Systems Park Manager Ralph White disagreed.

“It is all the same thing,” White insisted. “A couple of weeks ago, I was covering over pornographic drawings done in chalk. It doesn’t matter what the medium is. It’s offensive.”

According to the Times-Dispatch, Tacey said the judge will likely dismiss Mortensen’s vandalism charge once she completes the community service.

      Four year old allowed by her mom, who had been arrested for doing the same thing two years earlier, and who was “verbally abusive” to the arresting officer? Yeah, the world is upside down when people think they can do whatever they want, free of consequence.

      Again, aside from the vandalism the fact that she mouthed off to the cops should have gotten her beaten pretty severely. Evidently she didn’t obey some sort of lawful order and should have gotten a tazer, black eye, and some pepper spray for her and that little brat kid.

      Sounds like another liberal junk-head teaching her daughter that its ok to vandalize and draw all over the concrete with chalk. I’m sorry but if you are the kind of parent that will just let your child draw on the concrete wherever you go then you more than likely have not taught them any discipline at all. I had good caring parents who took care of me and loved me but if I were to pull out some chalk and start drawing on things in public places I would have had my ass whooped. Most parents are pure ********’s these days.

      I agree with you. Some people believe that the rules don’t apply to them. I will be more than happy to draw Ms. Mortensen a chalk masterpiece on her car demonstrating how chalk can still damage and applied to the wrong things it looks like $hit. So if the rules don’t apply to Ms. Mortensen, they don’t apply to the hundreds of other kids that visit the park. Wow all summer with hundreds of kids drawing on benches, walls, landscaping rocks, buildings, etc. Here in the Midwest there are places that have gone 60 day without rain. My kid chalks on my driveway, not the neighbors driveway, mine!

      Ms. Mortensen is taking the position that it is only a little chalk that will wash off. She is 100% correct it is only a little chalk, that is because everyone else is minding the rules, being respectful, and chalking at home.

      She recieved this sentence for two main reasons.She had been in trouble for the same thing two years ago.She smarted off to the cop.Her first offense was with paint.Its alot harder to wash off and affects the water system.[Imagine the degradation if everyone did it].Seems they cut her a break the first time.As to smarting off.If she had of acknowledged the officer in a civil manner with a willingness to wash it off she had of probaly let her go.If she had of apologized that day for being angry and speaking out of line the officer may still have forgiven her and let go on her merry way[after cleaning it up of course]
      To those of you who don’t know Belle Isle is in the rapids section.Unless she was in the high water marks it would have washed off next high water that came through.If it were at the very low point the next very strong incoming tide would have washed it off.This isn’t a condoning statement.Its simply the truth.Its not a permanent problem unlike paint is.It isn’t that hard to get rid of.
      As to chalk.I don’t think kids have any place using it except at a blackboard.or true art easal.That includes at home.Its simply my personal belief,I don’t expect anyone else to share it

    I can’t draw with chalk like I used to, awe darn I guess that introduces me to big government. Awe darn my grandma and grandpa who have an additional 20 years of parenting will have difficulty getting allowed to or raising my fatherless children? To top it off this woman knew the rules, had been in trouble for painting the same rocks in the past, and flew off the handle when told she would have to make the kid stop.

      Has nothing to do with me. You are also correct, it is a rock. No one claimed any damage was done to it. It was chalk, it will wash off. This is all beside the point. The lady was allowing her kid to break a city ordinance, one she knew good and well was in effect. She was warned and she got verbally abusive. The punishment might be excessive, but that is not for me to decide. I certainly am not going to feel sorry for her though. I would wager money that this woman is a real piece of work in real life.

      You are so right trolltrainer- agree 100% (please note the sarcasm) Just as when they government- federal, state, or city level, decrees that every citizen should pay a walking tax. (You know, for the up-keep of city sidewalks etc.) Everyone should comply. Always, always comply. As long as they have made it a law or city ordinance we must comply.

      OR- we could just grow some brains and stop electing idiots to power. At some point, we have to draw the line (in chalk, paint, or charcoal, I don’t care) and speak out against the lunacy as the woman in this story obviously did. Fifty days community service is outrageous.

      There was a time where adults would handle this without politicians and police. If the rock is in a public park, adults would would work together to solve the problem. Asking the woman to clean up after the child was done, or even holding an art contest, with the community working together to clean the rocks at the end.

      What wimps we have become. Too afraid to be Non-PC, we rely on the police and politicians to make others conform.

      You cannot mouth off to a police officer. They are hired to enforce the law, whatever law, as stupid as you may think that law is. They are to be treated with respect. If they are abusive or you have a problem for whatever reason then you take his/her badge number, voice the reason for your disagreement politely, then comply with the officer’s orders and take it up in court. This is how it is done in a free country. I do realize you Ron Paul nuts want anarchy, and in that sense you are even worse than liberals, but as of now you have to get along with your neighbors.     Always ask yourself: “What if everybody did what I am doing?” In this case the whole town would be covered with chalk graffitti. How would that look? Sure the rain washes it off but what happens between rains. Her kid is free to write all over her own walls, sidewalks and rocks and leave the mess for somebody else to clean up.

      And when the nice officer comes along and tells you to quit drawing on the sidewalk it would probably be smart to just shut up and move on. If you want to make a statement or fight the law then great! Do it in the right way. Smarting off to the cop is only gonna get your butt thrown in jail.       We need stronger chalk control laws! In fact, you should not be able to buy or possess boxes of chalk holding more than 10 sticks. No one needs to carry around that many chalk sticks, let alone have to use them!

      Its nice to know that the real crime rates in VA are so under control by the ever-vigilant authorities there, that they can now direct all their manpower to these type of heinous acts by little kids. Too bad the term “officer discretion” is no longer practiced situation by situation, but only hard core rule of law by the book. Suppose it all comes down to follow the money….

    While the offense is laughable and the penalty seems harsh I am not going to make any judgments because I do not know the full story. It seems to me that this woman has a problem. The park is for EVERYONE to enjoy, she seems like one of those people that feel they are entitled to just do what they please.

      Now I will admit that could very well be the case, in which I have only sympathy for the child if her mother is using her child’s innocence as a way to thumb her nose at the city.       I think it’s excessive, but considering that A) there’s a law and she clearly broke it, and B) She apparently knew this law as she broke it by painting the rocks two years ago… I have less sympathy.

    The punishment sounds excessive to me,make her clean it up and a stern talking to by the judge should suffice.It isn’t like she subverted the constitution.

    They should have tazered the 4 year old girl and used the night stick on the mom when she mouthed off. Bad enough to be a vandal but then bark back at the cops? She‘s lucky they didn’t shoot her. The officer should have used a back of the knee kick to take her down as soon as she popped off. And that 4 year old little criminal…in not a tazer at least a face full of pepper spray.

    Had the child been a 16 year old who spray painted the rock, the teen probably would have been reprimanded or sent to an art class to encourage his/her creativity – especially if the culprit was a minority since it would seem racist to punish the culprit oor his/her parent if it was a young child.
