Lawmakers Outraged Over Obama’s Latest Recess Apointments

President Obama’s bypassing of the Senate yesterday to appoint four new U.S. ambassadors and an assistant attorney general is not sitting well with GOP lawmakers, with one Rep. calling a specific appointment “absolutely shocking.”

The White House announced Wednesday that Obama would use his power to make recess appointments to fill envoy posts to Azerbaijan, Syria and NATO allies Turkey and the Czech Republic and appoint James Cole as assistant attorney general.

Specific senators had blocked or refused to consider the confirmations of the nominees for various reasons, including questions about their qualifications. But in the most high-profile case, that of the new envoy to Syria, Robert Ford, a number of senators objected because they believed sending an ambassador to the country would reward it for bad behavior.

“Making underserved concessions to Syria tells the regime in Damascus that it can continue to pursue its dangerous agenda and not face any consequences from the U.S.,” Rep. Ileana Ros-Lehtinen R-Fla., the incoming chairman of the House Foreign Affairs Committee, said in a statement. “That is the wrong message to be sending to a regime which continues to harm and threaten U.S. interests and those of such critical allies as Israel.”

The administration had argued that returning an ambassador to Syria after a five-year absence would help persuade Syria to change its policies regarding Israel, Lebanon, Iraq and support for extremist groups. Syria is designated a “state sponsor of terrorism” by the State Department.

President George W. Bush’s administration withdrew a full-time ambassador from Syria in 2005 after terrorism accusations and to protest the assassination of former Lebanese Prime Minister Rafik Hariri, killed in a Beirut truck bombing that his supporters blamed on Syria. Syria denied involvement.

Obama nominated Ford, a career diplomat and a former ambassador to Algeria, to the post in February but his nomination stalled after his confirmation hearings and was never voted on.

“All Administrations face delays in getting some of their nominees confirmed, but the extent of Republican obstruction of Obama nominees is unprecedented,” an administration official wrote in an e-mail to Politico.

The president’s appointment of James Cole as deputy attorney general drew heavy fire from Rep. Peter King (R-NY). King is outraged because Cole advocates using civilian courts to try terrorists instead of military ones. From The Hill:

King called Cole’s appointment “absolutely shocking” and said it may be one of the worst appointments Obama will make during his presidency.

“I strongly oppose the recess appointment of James Cole to lead the national security team at the Department of Justice.,” King said in a statement. “The appointment indicates that the Obama Administration continues to try to implement its dangerous policies of treating Islamic terrorism as a criminal matter.” [...]

Cole has advocated for the use of civilian trials in prosecuting terrorism suspects, and King views the appointment as a sign of the administration’s intent to continue to try detainees through the criminal justice system rather than military tribunals as most Republicans prefer.

As we reported yesterday, Cole is a close friend of Attorney General Eric Holder and a partner at a private Washington law firm.

“This may be one of the worst appointments by President Obama during his presidency,” King said, referring to Cole as a “left-wing ideologue who places terrorists in the same categories as drug peddlers.”

    Obama has shown contempt for Congress and his intentions to bypass it constantly. Not only with his recess appointments but with the FCC, EPA, DOE, and DOJ making new rules on their own authority and ignoring Congress. These appointments would have to be approved by the Senate, which is controlled by the Democrats. It shows just how radical some of these appointees are that the President does not want them subject to ANY public scrutiny,
    Before Rome was an empire it was a Republic. The Republic fell when Augustus simply bypassed the Roman Senate, making them irrelevant, and started ruling by decree. Notice any similarities? Agree with the final result or not, process does matter. Everyone should be concerned.

      Got any suggestions?? He ‘appoints’ who he wants, the house and senate hasn‘t a say on his ’Czars or who he decides to ‘appoint’ to important posts’. It really doesn’t care who was elected. WE WILL CONTINUE TO LOSE MORE AND MORE RIGHTS no matter who’s been elected as long as he is our President. They know this, and as a result 2011 will be a “pivital” year and probably one we will want to forget. But don’t worry.       However, it is the fate of all empires to rise and fall. America the Beautiful was founded to free the oppressed. Who do you think will come to OUR rescue in this our time of need? I struggle with the possibility that our time to fade has come. If that is the case, then God will not deliver, and He alone can help, either by the hand of the strong among us or by a sovereign act.     nothing is exempt in the gov view.I suppose if you mother became pregnant in California
    and you were born in Texas you would fall under the Interstate commerce clause.
    If you had a joint restraining order against you and your X 30 years ago you could not own a fire arm because if was manufactured in Connecticut.This some how affects inter state commerce?

    These appointments are just the tip of the iceberg in pushing their agenda. If the Obama administration does not get what they want, they just circumvent Congressional procedures and create new ‘REGULATIONS’ through all their new AGENCIES instead. It’s a win-win.

      Recess appointments in general have been sorely abused since the 1980′s, no question. No President, of any party or ideological affiliation, should be using them to end round the Constitutionally required Senate endorsements.

      That said, Obama seems, more than most other Presidents, to use it as an ideological tool. If he knows his candidates won’t stand up to scrutiny, he pulls stunts like this. Yes, other presidents may have done this a few times in the past on rare occasions (the “no scrutiny” motivation), but with Obama it seems to be a very consistent pattern.

      Throwing out “tu quoque” arguments, thus, are a logical fallacy I’m afraid.

      Pardon? He has a majority in the Senate and the House. Even the “obstruction” letter, as you call it, could not have held much weight until AFTER the confirmations in January of next year. He‘s gotten an awful lot of what he’s wanted. Even if every currently seated Republican had voted “No” on every single bill without exception, he could have had every single one of his initiatives passed. Even when he doesn’t get his way, he simply activates a given “Czar” and they pass regulations behind the scenes (FCC anybody?) without Congress.

If people want to help 9/11 responders, then start a private charity and I‘m CERTAIN that they’d find millions of dollars in donations flowing in. ;)

      The START treaty is a non-issue. How is it even important? I mean seriously, the START treaty is something pressing? Russia barely makes a squeak these days and is concerned with “internal” politics more than anything, they’re about as much of a threat to us as the Netherlands. While I have no problem reducing nuclear arms in a general sense, to claim that START was something *that* important doesn’t really fly with me. The hype around it was purely generated fiction.

      I really don’t see where the middle is. Obama has both chambers of Congress. Whatever he wants, he could get with votes of his party alone. If any obstructionism is going on, it’s in the ranks of the Dems in my view, as if they banded together and voted their agenda in lock step every single thing that Obama wanted would have been passed.

      In 1985, President Reagan made quite a few of them [recess appts.]. The majority at that time, the Democrats, under the majority leadership of Senator Byrd from WV, made the determination that he was making too many recess appointments.

      He challenged the President to submit a letter that would outline future recess appts. During the Reagan administration. In 1985, a letter was sent from Pres. Regan to… Senator Byrd… that stated no more recess appts. would take place unless the names of the individuals who were considered for recess appt. were submitted in writing in sufficient time in advance that the majority or minority leaders could take some type of action.

      The letter may not hold water but certainly shows the intent of the GOP. We are way past partisan politics here. I don’t beleive either side has the “people” in mind. The left is hell bent on moving their agenda at all costs and the right is clearly protecting the interest of big business and corporate lobbiests. Sites like this one and Media Matters don’t help our cause. Most people stick to one or the other for information. Neither site tells a whole story. Reading some of the comments on this site is disturbing. There are clearly some people here that do research and can engage in an intellectual debate but they are few and far between. Mostly calling people names.
      Politicians are being cradled and protected from media sources like Fox & MSNBC. I would love to find a forum that both sides can engage in a conversation based on two sides of a story.

      Yes, they are, and that’s where I get really ticked off with them, outside of any policy or ideological objections. They come off as supremely arrogant doing what they’ve been doing the last 2 years, to the point that it is so off putting as to make any few things they do that I might agree with nearly invisible to me. I prefer a government that works as much as possible along the lines of reason, debate and due consideration of consequences. Ramming things through, especially with this level of arrogance, even things I may agree with, is wrong and anathema to the very spirit this nation was founded upon.

      I agree, but probably with different definitions of “big business” and “corporate”. I’m not fan of state created fake persons called “corporations”. The “business” that the RINO GOP helps, and it does clearly as you note, are all anti-free market interests that wish to use government to keep their business competitors hobbled. I find that abhorrent, as I am a proponent of a *real* free market, and I reject mercantilism, which is what I believe that the establishment RINO GOP tends to believe in (mercantilism). In fact if I’m not mistaken, didn’t the “conservative caucus” which guided a lot of prior GOP policy fully reject free market ideology in the mid 1990′s? I seem to remember that pretty clearly.

      If the GOP really protected business, they wouldn’t accept one lobbyist pay off and would reject all pseudo-monopoly type legislation pushes. Handing favors back to companies, alas, is what many of them do now, for campaign contributions. It’s shameful.

      Actually this is an auxiliary site for me, I tend to hob nob on some of the more abstract/philosophical libertarian discussion forums as a general rule. However, I find The Blaze to be a great place to spread the word about little “L” libertarianism as the tea party types are, in my view, on the path towards libertarianism…and since I believe all people are capable of reason and logic, I stay and throw out my little sermons to whomever will bother to listen to them. :)

      I do dislike the ad hominem as well, and always try to take the high road, and say as much to “allies” and “foes” alike from time to time. From what little I’ve interacted with you, you tend to take that high road as well despite the notion that we probably wouldn’t agree on too much (I might be wrong about common ground though?).

    He is not just a socialist as that that does not explain his anti-American stances as does his anti-colonialist stances similar to his father and grandfather. It explains why he insisted that England take back the bust of Churchill. It explains why he bad mouths our country when he is overseas. It explains why he supports billions in Export/Import Bank loans to Mexico to drill for oil in the Gulf why restricting our drilling. He also supported billions in loans to Brazil to drill in deep water while telling us how dangerous it it.

      I agree, but the question I then have is what do we all do if close to 50% of Americans basically “think” like Obama? I mean, maybe 50% is a bit of a stretch, but I‘m damned sure it’s close to 40% and if it is close to 40% now, it’ll be 50% in 10 years.

      How do we stop this percentage from increasing if we do not have control of what kids are being taught in school? I mean, we all sit here and belly ache daily about this crap, yet we do absolutely nothing about it. We’ve got to get the kids back, but I’m not sure that can be achieved unless everybody home schools starting today.

      I’m with Ghost on this one. We are a majority and most think similar to us on these issues it it just they are happy with the wool that sits upon their eyes. We must plan something big that will put all of this stuff in the limelight to wake them up. What we can do I am not sure but I talk to everyone I know all the time about this stuff. I am sure it’s why I am becoming more and more of a hermit but I will pay the price of loneliness if I can get a third of them to start looking into things for themselves. Does anyone have any ideas on how we can make this stuff more mainstream or put the bright lights on it more than it is? I will help in any way I can. Once everyone REALLY pays attention there will be no way he or anyone like him could get elected in 2012.

      The “Law Du Jour” comment was with regard to James Cole’s appointment, who’s nomination had previously been shot down. Cole had failed as an overseer of AIG and had been used as an attack dog for the Democrats against Gingrich with false allegations. Cole’s opinions on the lack of importance of terrorists threats alone make him unqualified.
      Clearly, Obama has no real plans of moving to the center with actions like this.

      We have to get into our schools, expand our reach into the media, and do our own mind programming, or at least come up with some coordinated effort to de-program the masses from the malicious mind control programming that is carried out in our schools and most mass media..

      For now we have to educate as many as we can and de-program our children at home. The number one long term goal should be to rid the schools of the progressive agenda.

      A close second would be for some of you that are able to produce TV shows, movies, music, and other entertainment outlets that appeal to the masses. Ever notice how almost every show you watch on TV pushes some progressive point? How many movies have you watched where the main characters would rather die at the hands of an intruder, stalker, sexual predator, etc before they would consider owning a gun? Of course, most of the time on TV and movies the police get there to save the day. In real life they get to file a report on how you died. We need entertaining movies where the intruders and rapists get shot by whoever they are trying to rob or rape. Lets show stuff like that on the big and little screens for 30 yrs and see how easy it is to elect another Obama. Let’s get history and the constiution back in the schools and the communists out.

      If you have the resources and are looking for a business opportunity why not look into producing entertaining real movies and real TV shows. Not just political cartoons that pretty much preach to the choir. Look at the success of conservative talk radio and Fox News. The audience is there. Lets have a TV show where the kids are throwing the plastic soda bottles into the garbage can instead of refilling them with soda to try to save the planet. Lets have a show where the kids have pizza on Saturday instead of maybe two apples and an 8 ounce cup of carrot juice. I swear I’m afraid to watch network TV. I just have this gut feeling that someone, somewhere is writing the script now where the kid refills his soda bottle but mom and dad are taking soda away and it will now be carrot juice. I know that it is going to be filmed and put on TV for entertainment.

      Lets change it. While we still can. We can do it, but not without expanding our reach into the schools and media. Hopefully, the progressives won’t be able to finish the USA off before we can get it going.

      A subversion on the intent of the Constitution.{ POTUS has the power to fill up all Vacancies that may “happen”during the recess of the Senate which shall expire at the End of their next session.} It was never intended to be used to appoint people that could not be vetted by the Senate. It was to fill needed positions due to death and resignationes to insure the Gov’t would run smoothly until the Senate reconvened and a proper candidate could be vetted to fill the job. At some point Congress allowed the intent to be subverted and now we the people need to demand it be honored as written and not to be used to appoint a bunch of Socalists, Communists and Marxist that this POTUS knows would never be acceptable to the American people but yet he wants to surround himself with them in key positions. Obamas shadow Gov’t. All he needs is an excuse to grab total dictatorial power just like his buddy Chavez(Obamas role model for dictatorship). Actually when you look at all Obama has done to bypass Congress one immediately realizes Congress is now irrelevent and he just issues executive orders or regulations to accomplish his agenda to destry the economy of the USA. Look at every gov’t that has failed or collapsed allowing dictators to come to power. IN EVERY SINGLE INSTANCE THE ECONOMY FAILED! Usually from gov’t pressure.

      All Presidents of both parties make this kind of recess appointment. Is it unconstitutional? Technically, no. Does it violate the spirit of the Constitution? Yes, BUT so do the procedural manoeuvres that give one or two Senators the power to prevent a vote from being taken on an appointee who would be confirmed if the Senate as a whole were allowed to vote on it.

      Looks like we need a bill first to make sure NO funds from ANY department are used to pay ANY Czars,, than a bill to make sure that NO President can any longer make recess APPOINTMENTS.. these are NO LONGER necessary.. since the house and senate CAN be reached at all time via teleconference..THEREFORE available as if they were in D.C. just like this president make the appointments while he was NOT in D.C.       I have e-mailed my new “Tea Party” congressman, the first GOPer since the Civil War to be so, and mentioned to him that majorities mean nothing so long as we have ex (?) union lawyers at NLRB and anti-gun nuts at BTAF and four dozen insidious Czars. The new congress needs to haul every one of them up and politely ask who they are, what they believe, what they have done, what they want to do, how much are they making, what is their work schedule, what is the budget for their staff, etc. Congress does not matter when the exuctive has totalitarian tendencies and this Soros-endorsed (surely it is) radical shadow gov’t remains in place. Write your reps! (Also, who among us believes that The Obama is smart or “powerful” enough to be at the head of all this? You don’t have to be a conspiracy nut.
