‘When Does it Move Beyond Self-Defense?’: Civil Rights Leader Questions Texas Dad‘s Killing of Daughter’s Molester

Despite receiving tremendous support from nearby residents who say he was justified in his actions, the Texas dad who beat his 4-year-old daughter’s alleged molester to death near Shiner, Texas is remorseful for taking a man’s life, KRIV-TV in Houston reports.

“He told me that it wasn’t his intent for this individual to lose his life; he was just protecting his daughter,” Lavaca County Sheriff Micah Harmon said, recalling his conversation with the father after the incident on Saturday. The Sheriff doesn’t anticipate charges against the dad, but following an investigation the case will go to a grand jury.

KRIV-TV reports it was the father who initially called 9-1-1.

Yesterday, The Blaze brought you the story about the aforementioned father who after hearing his young daughter‘s screams coming from the family’s horse barn, found a man reportedly sexually assaulting her. He yanked the attacker off of her and punched him in the head repeatedly and ultimately killed him.

Now, a Texas civil rights leader has come out and questioned the father’s choice to “summarily execute” the alleged attacker without due process.

James Harrington, director of the Texas Civil Rights Project in Austin, said the dad had the right to “defend” his daughter but suggests he may have gone to far due to “anger.”

“Assuming it’s true that this guy was molesting the daughter, and we don’t know what exactly happened at this point, he would then have the right to defend [her], and hit him enough to have him stop,” Harrington told FoxNews.com. “But you cannot summarily execute him, even though I can understand the anger he would have.”

Harrington reportedly went on to say that, without specific knowledge of the case, he was “surprised” that the girl’s dad had not been charged yet.

“The question is: When does it move beyond self-defense?” he asked.

But as Hot Air points out, the Texas penal code is pretty clear and it appears that the Texas father was not only morally justified but legally as well.

According to the penal code:

(a) A person is justified in using deadly force against another:

(1) if the actor would be justified in using force against the other under Section 9.31; and

(2) when and to the degree the actor reasonably believes the deadly force is immediately necessary:

(A) to protect the actor against the other’s use or attempted use of unlawful deadly force; or

(B) to prevent the other’s imminent commission of aggravated kidnapping, murder, sexual assault, aggravated sexual assault, robbery, or aggravated robbery.

(b) The actor’s belief under Subsection (a)(2) that the deadly force was immediately necessary as described by that subdivision is presumed to be reasonable if the actor:

(1) knew or had reason to believe that the person against whom the deadly force was used:

(A) unlawfully and with force entered, or was attempting to enter unlawfully and with force, the actor’s occupied habitation, vehicle, or place of business or employment;

(B) unlawfully and with force removed, or was attempting to remove unlawfully and with force, the actor from the actor’s habitation, vehicle, or place of business or employment; or

(2) did not provoke the person against whom the force was used; and

(3) was not otherwise engaged in criminal activity, other than a Class C misdemeanor that is a violation of a law or ordinance regulating traffic at the time the force was used.

(c) A person who has a right to be present at the location where the deadly force is used, who has not provoked the person against whom the deadly force is used, and who is not engaged in criminal activity at the time the deadly force is used is not required to retreat before using deadly force as described by this section.

Further, in another unsettling development in the case, authorities have revealed that the deceased 47-year-old alleged predator apparently has family ties to Mexico, where investigators are currently attempting to notify his next of kin. His identity still hasn’t been revealed other than he is from Gonzales, Texas.

District Attorney Heather McMinn told FoxNews.com that the case is still being investigated and the Texas Rangers are now involved.

“My understanding is that they are looking for family members in Mexico,” McMinn said.

Police have not confirmed whether or not the man was an illegal alien or a U.S. citizen with family in Mexico.

The name of the father has not been made public either in a bid to shield the 4-year-old little girl from any further trauma.

    Another second guesser. What if this jokers 4 year old daughter was screaming and being raped and assaulted. This little girls life and virtue is worth more than 10 pediphiles alive. This was God’s justice. Kill all of them that are caught in the act. God says hang a mill stone around their neck and throw them in the lake. This father should be honored by the town. He did the town a great service. Wonder how many other children this pediphile had raped? To attack this girl when the father was near by and other people around in the area shows he probably was a bold repeater. This was not the first time he abused a child.

Now he doesn’t have to worry about it, and we don’t have to worry about him getting 20 years, out in 5 and back on the streets to do it again. Saved the tax payers money.       This will be a no-brainer once witnesses start coming forward to verify that the little girl was obviously traumatized or that the dead rapist had a criminal record of sexual assault.

      My prediction: The father will not be arrested or tried and certainly wouldn’t be convicted by a jury of his TX peers.

      I have an alternative legal action. Let’s drag Eric Holder down to TX and force him to stand trial for his lies in “Fast and Furious.” My prediction: Holder would be tried, convicted and hung by his neck until dead.

Perhaps he prefers the dog and pony shows provided by the attorneys for the defense of that Coach who was assaulting young boys in the showers and his own home –protected by the status of his position as a pillar of the community. Life, Liberty and Property (4 year old‘s can’t emancipate themselves) was being threatened by this perp. The perp needed to be incapacitated immediately and since the perp was the cause of this situation it is left up to the fathers discretion the severity of the actions needed.
      The fathers state of mind is irrelevant since all actions were directly caused by the perps illegal and immoral actions. In short, the perp caused his own death while committing an illegal act and thus is responsible for his own death.

      If this man in arrested for killing a child predator it will only show how totally broken our system of justice has become. It will cause an outcry across the country to eliminate the court system and let the people handle their own justice.
      Frankly I think child molesters,rapist,criminals who commit multiple violent crimes should be hung in the same kind of cages that pirates were hung in and allow to starve to death in the blazing sun.
      Those punishments were the primary reason piracy died in the U.S.
      No one would attempt to do crimes if the punishment were so severe.
      I also think alot of smaller crimes would be better punished by placing criminals in public stockade and let the public mock and ridicule them.

      That it would even be asked if the father should be charged makes me so angry I can’t even read this whole article. Killing isn’t fun, for normal people. Normal people do feel remorse for doing something so extreme, but he was fully and completely justified in doing it. Just because he feels something about it isn’t an indication he was wrong to do it. I would worry about him if he didn’t feel anything. Having two young daughters myself, I doubt I would have stopped at killing the POS.

      Oh I get it! Give us the 2nd amendment to make us happy but then question why we ever use it. In this case, no gun was used but self defense was. The idiot Harrington doesn’t understand that the father and the daughter will have to live with what they experienced regardless of the justice that was given out. Harrington thinks that the father and daughter will easily just go on living a normal life but forgets that the daughter may never trust anyone again and become hysterical in situations that you and I are just fine in. Also, the father has to relive that image of his daughter being assaulted in his head forever regardless of what he did. The image of seeing someone raping your child right in front of you is probably the worst thing ever to witness. The rapist douchebag would have seen some jail time but would have no scars to suffer from since this was normal behavior for him. I say we crucify Harrington and let him have it and tell him that if he sides with those that he deems worth of civil rights regardless of action, then he may be the next person to receive such justice from angry, protective, loving fathers.

      Was living in Seattle and read full page article about child molestor that raped three different little girls age four to eleven. And ready for this… The article was concerned because he was being released and the state had spent over a MILLION dollars on his ‘treatment’ and ‘rehabilitation’ and they were afraid he might reoffend and jeopardize the future… Of the… ‘program’. They weren‘t concerned about another little girl’s life being destroyed. Made me sick to read it. It was almost sympathetic to the guy as if he had a disease. Liberalism is a mental disorder. What should‘ve been done is the fathers of the girls should’ve been able to beat they guy to death as in this case and a million dollar trust fund set up to pay for their college. True justice! Killed in the act of your crime. With trials and the death penalty, there is always the question of “are we sure we got the right guy?” This way there is no questions and no repeat offenders.

      According to yesterday’s report, there were several people in the barn and the perp/perv took the girl out to a nearby pasture. But, surely, lots of people heard her screams and came running, too. So, these possible witnesses did nothing to stop the father.

      Anyone not willing to kill to protect their child; anyone who can’t even imagine getting so enraged over an act being perpetuated on their child, should NEVER even consider having children.

      and hung them up for the world to see, and I think everyone knows what I am talking about.
      This world is in a turmoil of “sin” and it‘s only going to get worse until people start standing up for what’s right and this man killing an animal who was molesting his little girl who couldn’t fight back got exactly what he deserved.

      Turn the man loose, what father in his right mind sould not act the same and beat the sob to death for messing with his daughter???I would have shot the sob save the state some money, and that would make sure he never bothered another kid. this country is going to hell in a hand basket, and all people want to do is feel sorry for the,poor man I am sure his childhood caused him to rape a child, get real we need to put these people away for ever or execute them.

    Interesting: “Harrington reportedly went on to say that, without specific knowledge of the case, he was “surprised” that the girl’s dad had not been charged yet.” The man admits he has no specific knowledge of the case but states the victim’s father should have only “hit him enough to have him stop.” Hmmmmm….. Two things: 1) That would be like me saying I have no specific knowledge of nuclear power plants but I’m going to tell someone else how to operate theirs anyway. 2) The so-called director of the Texas Civil rights project might want to brush up on the Texas Penal Code before opening his moronic mouth again. What an idiot!!

    In the meantime, I will have this little girl, her daddy, and their family in my prayers.

      If this were Utah about 15 years ago he the father would be in jail.They are known for protecting the rapist molester.They are also well known for vicitmizing the victim.I can site a case for you.Women married a man who through fraud and deciept concealed his true crime from her.[He claimed it was minor=she assuned it was parental involvement in an otherwise voluntary relationship]It was attempted rape of a stranger while in predatory mode.[victim one]He attempted to blind her.She fought back.They charged her instead of him.[victim 2]She had been divorced for a few years when she learned that he was still attacking women.The third time was a teenager.he went to prison for that.Sad thing is that had they listened to her in the first place, the third victim wouldn’t have been a victim.Oh in the interest of space[didn't think I'd have the space to go semiindepth] I left out where he followed and found her in a domestic violence shelter the court set her up in.She fled to protect herself.They obviously couldn’t protect her other than a jail cell which is where the criminal belongs not the victim.She fled in a way that would force him to leave a trail if he followed.There is more to what he did but in the interest of space and time I’ll conclude this post.
      Thank God its texas and not utah.They still have rational minds and a rational justice system.

      I’d never have to second guess a decision to protect my child from a molester/rapist.. This father did exactly what most of us would have done in the same situation.
      There will be hell to pay if they try to go after the dad, who was doing his natural job of defending his child. Just look at what a momma bear would do to anyone coming near her babies. She would never stop and ask questions first, just do her natural job.

      Then on the other hand, how can a woman kill her baby? Beyond my comprehension!
      They make women think it’s not a baby, but worse are the late term abortions that our Prez, actually voted in favor of, where they kill the baby with sissors into the back of the head, then let it finish dying in the trash.
      Is this the same mother who would protect her child, as this dad in Texas did? Not a chance.

      the torture never ends. I was 4, there were 2 & I’m living w/ flashbacks more than 30 years later. the death of those who raped me wouldn’t end the torture. but if I knew they had faced justice, that no other children have been raped, the cross might be easier to carry. maybe not. it’s not the kind of thing one can say w/ any sort of certainty.

      if our society isn’t based in Christianity, of, at the very least, we don’t live by natural law, the nightmares have only begun.
