Why is This Bizarre 2004 Shooting Video Going Viral?

If I include the following quote in a story about an accidental shooting during a gun safety presentation, you can probably guess what the video below will show: “I am the only one in the room professional enough, that I know of, to carry this Glock 40.”
If you said that the DEA agent who said those words would then almost immediately shoot himself in the foot, you were right:
The incident in the video isn’t new — it’s from 2004. But the video is going viral this week because the agent pictured, Lee Paige, is suing the government saying someone within the DEA released it out of animosity toward him. The video, he claims, damaged his reputation, was an invasion of privacy, and is “highly offensive.”
The case has been rejected by lower courts before, but now the U.S. Court of Appeals for the D.C. Circuit agreed this week to hear his case.
One judge in the past said that Paige failed to prove that anyone withing the DEA leaked the video (an investigation hasn’t turned up a suspect), although Paige says that those within the department are the only ones who had access to it.
“In order to prove [the government] acted willfully and intentionally, it is essential that Plaintiff identify the source of the disclosure,” Senior Judge Jack Shanstrom of Montana federal district court wrote in his December 2010 ruling.
“[T]here is no doubt that the incident is an embarrassment to both [Paige] as well as the DEA,” he added. “However, ‘highly offensive’ matters generally relate to the intimate details of a person’s life, sexual relations and other personal matters and does not generally include the present situation.”
The irony is that Paige may have taught his most effective gun-safety lesson the day he shot himself.

Posted on February 2, 2011 at 3:16pmIt’s a somewhat understandable mistake. He obviously cleared the weapon, you can see him removing the magazine and showing the class the weapon with the slide back. He assumed it was 100% clear but failed to check the barrel that must have had a round stuck in it. The extractor failed to extract the round that was in the chamber and he failed to double check that. In the military, we‘re trained to not just clear it as he did but to check the actual barrel to make sure there’s not a round there that failed to eject.
Although if i were him I would have cleared the barrel prior to going into that classroom. There’s no reason to be fully locked and loaded going into a classroom to teach unless he was in South Central….

Posted on February 3, 2011 at 10:08amWhere in the video did you see him remove the magazine?
I’ve owned and shot multiple Glocks and NEVER seen an extractor fail, as you suggest may have happened.
What he did is NOT an “understandable mistake”, and he should have been immediately severly disciplined, if not fired for it.
IF he is directed to always have his loaded duty wepaon at his side, he SHOULD have had a separate, previously cleared firearm for display purposes ONLY, and should have NEVER touched or removed form holster, his duty weapon. Even WITH a previously cleared weapon, he should have cleared the wepon AGAIN, and followed ALL safety rules, and especially, TREAT ALL FIREARMS AS IF THEY ARE LOADED.
NO EXCUSES.

Posted on February 2, 2011 at 11:42pmAS, you said, “He even cleared it, how the hell did he not realize there was a round in the chamber that didn’t eject when he cleared it? ”
He must have had a loaded magazine in the weapon with an empty chamber. Maybe someone trained him at some point to pull back the slide and check the chamber to make sure it is cleared, and then have another adult double check it for him. He appeared to do just that. Unfortunately for him, he was also probably trained to, and did not do, FIRST – pull the magazine OUT of ANY pistol (and all other similar weapons that take magazines), and THEN pull the slide back and check not only the chamber, but also the magazine well to make sure the weapon is clear. He also broke at least two of the safety rules – treat every firearm as if it were loaded, and keep your finger straight and off the trigger until you are ready to fire.
Report Post »I think he is likely a dumbass product of affirmative action, along with the female agent who supposedly doublechecked with him to ensure the weapon was clear – which, as he painfully found out, it was not. At least his stupidity (by the way, it was NOT an AD – accidental discharge as he claimed, it was a ND – NEGLIGENT discharge) did no harm to anyone but himself, but this was just luck and the Almighty looking out for those poor souls ignorant enough to be in the room with this turd.

Posted on February 3, 2011 at 12:43amLOL what an idiot, he’s got no case.
Basic gun safety:
1. assume every gun is loaded
2. knowing 1, ALWAYS remove the clip and clear the chamber, every time you pick up a gun. Do it out of habit, even if you just saw someone else clear it, you make sure for yourself.
3. if you’re going to be handling a gun inside for demonstrations, put a pencil or something through it to keep it OUT OF BATTERY
This guy should have resigned after this incident. It doesn’t make me feel very safe when a DEA agent, of all people, shoots himself in a classroom full of kids.
If anything, the parents of these kids should sue HIM for being a DIPS***!
