Will Federal Judges Declare All or Part of ObamaCare Unconstitutional?The courtroom was tense earlier today when the Eleventh Circuit U.S. Court of Appeals began hearing arguments for the latest legal showdown in the war over ObamaCare. The three presiding judges are reviewing a previous decision that was made by Pensacola, Florida Judge Roger Vinson. Back in January, Vinson found the entire 2,700-page health care law unconstitutional.

The proceedings began with the three judges critically questioning the contents of the health care law. Collectively, these questions seemed to indicate that they may be ready to declare all, or at least parts, of the law unconstitutional. Perhaps most damning, the judges explained that they could not recall one instance in history in which a court had agreed with the government forcing citizens to purchase a product or service (the health care law mandates that most Americans have coverage by 2014). The Los Angeles Times has more:

“I can’t find any case like this,” said Chief Judge Joel Dubina of the 11th Circuit Court of Appeals. “If we uphold this, are there any limits” on the power of the federal government? he asked.

Judge Stanley Marcus appeared to agree. “I can’t find any case“ in the past where the courts upheld ”telling a private person they are compelled to purchase a product in the open market…. Is there anything that suggests Congress can do this?”

Many critics of the law believe that the government went too far in implementing the individual mandate. The judges appeared to mirror this sentiment. According to FOX News:

Judge Frank Hull later asked whether Congress could pass a similar law which could require Americans to buy certain types of cars or solar panels to comply with federal energy policy. Her question encapsulated the fear shared by many: that if the law is upheld it will open the door to unprecedented federal intervention in people’s lives.

To date, 26 states and the National Federation of Independent Businesses have come together to urge the judges to put a stop to the Democrats’ controversial health care law. These parties are represented by Bush-era Solicitor General Paul Clement.

Regardless of what happens, this case is far from over. The 11th Circuit judges are not expected to rule on the matter until the end of the summer and, even when they do, the case will likely move to the nation’s high court. During the proceedings, Judge Joel Dubina said, “I doubt this is the last time we’ll be arguing this case,” clearly predicting that the fight will likely make its way to the U.S. Supreme Court.

FOX News’ Judge Napolitano believes that the Supreme Court will hear the case sometime in 2012. If a decision is made before the November 2012 election and the Obama administration loses, it could spell trouble for the president’s chances at a second term.     So they require cars to have certain mileage capabilities, light bulbs which nobody wants, toilets which don’t flush properly, schools to serve specific lunches and on and on.     I think that as tax payers there should be a form with our 1040′s that allocate for what program & what % of our dollars should go to said program. idividually. we as american’s have the right to decide for ourselves where our taxes go. that should open some eyes!

    Throw the whole mess out, cut spending to the bone, cut all intitlements 10% first year, rid the country of its educational problems (unions), stop all foriegn aid except to strong allies if needed, remove as many ilegals and CLOSE the southern US border, then drill, stop oil money from leaving our country, we need it, beef up defence, get a new administration, send all political criminals to prison, no matter who they are, jump start industry, follow the constitution, honor the constition, make it a felony to burn US flag within US borders, that goes beyond freedom of speech, I dont care who argues otherwise, make it a felony to incite violance inside US borders no matter how old and ugly they are, shut the doors on fannie and freddie, give those people in calif. water so they can raise the food we need, I`m tired of eating foreign vegetables, they are probanly nasty, who knows what they do to them before we get them, give LasVegas A little bit of a tax break, nagotiable, just a personal thought, did I say geta new administration, dont alow any chidren to go hungry, or without care when they are sick, give our service men and women a desent living, they have an honorable profession just as dr,lawyers,nurses, teachers and such.     Forcing people to buy health insurance is wrong. I don’t even use medical services. Why should I be required to buy something I won’t use. My personal health plan depends on faith, natural food, and exersize. I stay healthier this way than I would using doctors.

      I have been working in large hospital for 16 years noe and see a wide variety of patients. I also have opportunity to see how the system is abused. I personally only use the emergency room in a real emergency. I see more and more people using ER as the “free clinic” for things like a free refill on a perscription or a hot meal and air conditioning.
      I, like you, run and diet and work out almost every day. I get a yearly check up so I can catch anythin early. If we would only make EVERYONE responsible for a small % of any ER bill we could probably save 30 % of the cost of healthcare. We need some personal responsibility.

He said for us to love one another as we love ourselves. The Bible doesn’t tell us to love one race and hate another. My Jesus wants us to hate the sin not the sinner. That is the truth and the truth is NEVER hateful. We are what we believe and the fruit of our beliefs show what type of person we are.

      Your thinking runs along the same lines that Hitler believed in and you know what happened to a whole group of people (God’s chosen people the Jews) when he was put into power and implemented his ideologies. If you consider yourself a Christian (I have no idea what you believe in) you definately need to delve deeper into the Bible and pray and ask the Lord for guidance. Whether you believe it or not, I’m not trying to change your mind, just give you a different perspective so that possibly you can discover for yourself what and why your moral ideology is what it is and if you believe you should better yourself by change.

      I pray you do decide to reconsider your belief structure and that you come away from your studies (hopefully the Bible if you do believe in the Lord) with a different perspective.     If Obama gets elected for another four years, millions of people will lose their existing health insurance. If they can’t find another suitable replacement (suitable meaning Government approved) then millions will be forced on to the government dole.       Unfortunately you have missed the paradigm shift. In the old days most people were of Christian doctrine and we stood along the line of Christian doctrine to the Right or Left. The right side being Zealot and the Left being liberal.

      In the 1960s and 70s there was a paradigm shift from Christian doctrine to Stoic doctrine. Most politicians of today are of Stoic doctrine the stand along the line of Stoic doctrine from the RIght to the Left. The right being Zealots such as Mr Obama and the Left being liberals such as Romney. Every now and then we see a person of Christian doctrine appear who is either Left (Liberal) or Center Left. We almost never see a Christian Zealot in politics any longer.

      So, now thee are two lines one contains all those of Stoic Doctrine which is the majority of politicians and the other contains the hand full who believe in Christian doctrine which is the minority. The majority of Americans are of Christian doctrine that is why there appears to be a great chasm between the people and the current administration. You are observing the vast difference in the doctrine of the people (Christian) and the doctrine of the democratic party (Stoic).

      A little study will get you there. You will find the Apostle Paul was engaged with these same Stoics in Acts 17 and spoke out against it in Colossians chapter 2. You can trace Stoic doctrine through Hegel, Marx & Engels, Henri Saint Simon, Darwin, and many others

      Pickle – no doubt that welfare hurts black Americans, it hurts white Americans also. Matter of fact, there are more white Americans on welfare then black. I have served side by side with black soldiers, and some are amongst the finest and most decent people I know.

      Here is a question for you. When is the last time a black person who is on welfare and lives in the projects came to your house for dinner? How about the last time you had dinner in the projects? I doubt you ever have. If you ever came down off from your throne, and interacted with such people, you might find out that you can make a difference, and help someone get their life going in the right direction. You might make a freind or two. Might even be able to invite some folks to your church, and help them for eternity. If you are not part of the solution, most likely, you are part of the problem.

      On a side note, Phineas the third high priest in the days of Moses happened to be black. Read about him, he did rather well.

      There is a clause on pages 58 and 59 of Obaba Care that is never mentioned but I am sure is in some way unconstitutional. It states: The government will have real-time access to an individual’s bank accounts and will have the authority to make electronic fund transfers from those accounts. I don‘t know about all of you but I feel that if the government cannot balance it’s own checkbook, I definately do not want them to be able to take what little I have without at least giving me a little kiss in return!

      There is not an out clause in the legislation, therefore if any of it is unconstitutional then all of it is unconstitutional. The Stoic – Marxists will put forth there best attorneys to argue their case. Only the judges can make an accurate determination based on the Law and the constitution. 26 states 52% have filed in the lawsuit against the federal law known as Obamacare. The judges must decide to side with the people or the administration and it does not look as though Mr Obama will be serving a second term. Its my guess the judges will side with the Constitution and the States on this one. We are not done yet this is simply another round. The final round will come with the Supreme Court decision.

      Now if I were a democratic – marxist strategist (and It would require a lobotomy, and some serious mind altering drugs for me to achieve that pentacle), then I would accept the defeat of the court who called the legislation (Obama care) unconstitutional and kill the legislation. Can you imagine the popularity boost killing Obama care would have for the democratic – marxist party? It would knock a huge amount of the wind out of the Republicans sails….On second though ….. Nahh!

      I’m not sure why RANGERP was making the coments he did under a story about the vote on healthcare but it did make me think. Even if that is the raw number, the last time I checked there were a lot less black people in America than white. Check the percentage and see what that tells you.
      When we cut back on entitlement programs you will get a better idea of who is crying hard times and who will pick themselves up and help themselves. I still remember Katrina.

      Black like to spout there are more Whites on Welfare than Blacks. The truth of the matter is there are 140 million more White people in America than black people in America. There are more White everything because there are 140 million more Whites in America. That explains why there are more White serial killers, more White child molesters….everything.

      Sadly, even though there are 140 MILLION more White people in America than black people the number of blacks are the government dole is equal to Whites. That means that blacks are 6 times more likely than Whites to be on welfare.

      Oh, NOW I understand why Congress is just sitting up there on the Hill on their butts and making no attempt to put an end to this odious legislation–they are waiting for the COURTS to do their jobs FOR them. So many good, Conservative judges retired and/or died since ODumber was elected, and he has loaded the court with so many of his incompetenjt and leftist cronies, I’m not sure the Supreme Court will do the right thing if the opportunity is handed to them on a silver platter!

      If they enact this unconstitutional tax upon the American people the simplest thing to do is just not pay it. If you don’t buy fuel or food from a regular outlet, you don’t pay sales tax. Why should this be any different.

      They can’t jail everyone. If they try, the country collapses from the drain on the workforce. The only problem is coordination and solidarity of conservative individuals.

      If what you espouse about T.Jefferson is true, would that make him the first president that performed acts of bestiality? And if so, what does that say about his judgement? If you fear someone because of the color of their skin, you must be a very frightened individual! I would guess that if you had trouble with the black people in your unit it would be because they knew you felt such antipathy for them. The problems in the inner cities are a product of decades of Dem. pandering to the victimhood society that politicians have used for years to buy elections. Stuffing thousands of people into concrete boxes with nothing to do is going to breed antisocial behavior in any ethnicity. Most men need to have value to their lives, just having them sit around collecting welfare checks is terrible thinking. There should be work-fare instead.

      It seems that farmers who grew their own wheat to feed to their livestock were ordered to destroy that wheat and BUY what they needed on the commercial market.

      I am well aware of the statistics, and that a much higher percent of black Americans are on the welfare system. My comment was that color is not so important, the system hurts blacks, whites, and anyone else that is on it. The question is how do you fix it? Sitting back and complaining does not fix problems. Pointing fingers does not fix problems.

      I claimed on another post, Blacks do not need a system, they need a savior. After a couple hundred years of slavery, then decades of Jim Crow, and seperate but not equal, blacks did not start getting a level playing field in this nation until around the 70s. You can not expect folks do dig out of a pretty big hole with only thirty years. Add in the damage from rap music, drugs, welfare….. They have a tough row to how.

      You may be a liberal on here just trying to stir the pot and make the blaze look racist, our may actually be real, and believe the hatred that you spew. Either way, I pray that you get it figured out. Hatred will not get you far. there is a big difference between racism and realism. I do not sugar coat, and know that the black community is struggling with very high crime, abortion rates, murder rates, children born in single parent homes….. If I take some young black kids to my church, have them over for a BBQ, take them fishing….. I may make a difference in the life of a couple, and help them see a better way. Pointing fingers does nothing.

      I would like it when the judge makes Obamacare unconstitutional he/she also add Obama/Soetoro and Michelle found to be unconstitutional. Then not only will the healthcare debacle end but so will our nightmare.       This may actually be more about getting a federal court ruling stating that the Fed govt. Does have this much control over the population than it is about health care.
      Think about what I said if it had been carefully thought out. They first pass laws and rules that make it possible for people who can’t repay loans to get them without means of repaying them, throwing the economy into a tailspin. Clinton signed into law rules removing banking restrictions, called the Glass-Stegall act, then complian that banks need to be regulated. Then they pass the stimulous, which EVERY stimulous in history has RAISED the unemployment rate. Then with all these new people unemployed, they now worry about health insurance, giving them just enough citizen support to pass the legislation. This really pulls on heart strings of the American public. But with this all thought out in advance, it could really be used to their advantage later.
      When you have had health insurance all along, and now you find yourself without because of the economy, I know it hurts and causes fears. All you hope for is a way to get covered and will let them do anything to you right now to get covered. But they will use that to their advantage later.
      Just like the fears in the article, if this stays law, the govt. could then mandate you buy an electric car or pay a fine to “save the environment”. they could mandate the amount of electricity you have to buy from the elec company. It may be less than you need.

      You’re right about the welfare thing. I don’t think the statistics take into account how many illegals are exploiting and defrauding the system also.

      There are more whites on welfare than blacks, and they receive more benefits paid out- 38% whites to blacks 37%- with hispanics and others basically eating up the rest.

      Welfare may be a problem, but compared to CORPORATE welfare….it is INSIGNIFICANT.

      If they are’nt talking about cutting spending on the military industrial complex and corporate welfare, such as lending OUR money to banks at .0001% interest, so they can turn around and lend it to us for 14%, then I don’t want to hear about welfare to feed needy people.

      I‘ll riot with the needy and I’m not on welfare in that scenario. Give the people .0001% DIRECT loans, not BIG GIGANTIC RICH GREEDY BANKERS.

      Actually Veryseniorperson, what you have is failure of the people to understand the law in the progressive era. The Agricultural Act of 1938 section 301 is general definitions. They provide us with the scope of the act. Since we all know Congress has no legislative jurisdiction within the Exterior boundaries of any state of the Union, They used an age old trick. Deception.
      Section 301 tells us that:
      (5) The term ‘‘United States’’ means the several States and
      Territories and the District of Columbia and Puerto Rico.
      (note:it does says states of the Union,United States of America,etc, so what “States” are they referring to? They tell you in the next definition)

      (6) The term ‘‘State’’ includes a Territory and the District
      of Columbia and Puerto Rico.

      Nowhere is the 50 states of the Union included because Congress can not legislate for them. The Constitution constrains them. To get around it, they got you to all “claim” to be “US citizens” (Find that in the Constitution). A “US citizens” you are dual citizens (look the word up in any dictionary. It will say the Status of US citizens WHO reside in a “state”. Doesn’t say what “States”. It only has force over their citizens(US citizens) who “reside(nt aliens) within a state of the Union known as America. The Case is void as repugnant to the Constitution.       It doesn’t matter anymore. Half of it has gone into effect, and money is already set aside for spending. Even if it gets reversed, the damage that the Health insurance industry has suffered cannot be undone. The heavy inflated cost that came with them guessing what was coming is now in the pipeline, and I can’t remember the last time health insurance went down. If this gets shot down(which is a 50/50), it just has to wait for the next stupid set of students to put in another group on the left that ram it again.
