Wisconsin Supreme Court Backs Controversial Union Law

MADISON, Wis. (AP) — The Wisconsin Supreme Court handed Republican Gov. Scott Walker a major victory on Tuesday, ruling that his polarizing union rights law can go into effect.
In a 4-3 decision, the court said Dane County Circuit Judge Maryann Sumi overstepped her authority when she said Republican lawmakers violated the state’s opening meetings statutes in the run-up to passage and declared the union rights law void.
The law, which eliminates most of public employees’ collective bargaining rights and requires them to pay more for their health care and pensions, sparked weeks of protests when Walker introduced it in February. Tens of thousands of demonstrators occupied the state Capitol for weeks, thrusting Wisconsin to the forefront of a national debate over labor rights.
Walker claimed that the law was needed to help address the state’s $3.6 billion budget shortfall and give local governments enough flexibility on labor costs to deal with deep cuts to state aid.
Democrats saw it as an attack on public employee unions, which usually back their party’s candidates. Democratic state senators fled to Illinois to try to prevent a vote on the measure, but Republicans got around the maneuver by convening a special committee to remove fiscal elements from the bill and allow a Senate vote with fewer members present. Walker signed the plan into law two days later.
Dane County District Attorney Ismael Ozanne, a Democrat, filed a lawsuit the next week claiming Republicans didn’t provide the proper public notice of the meeting in violation of state law. Sumi first issued a temporary order blocking publication of the collective bargaining law while she weighed his arguments and then last month declared the law void.
Attorneys for the state Department of Justice, representing the Republicans who control the Legislature, asked the Wisconsin Supreme Court to take the case directly, in part to speed the process. Walker counted on the law being in effect in the budget he put forward for the fiscal year that starts July 1.
Ozanne had urged the court to let the case work its way through the usual appeals process.

Then come Jan 03 2012 the signature collections start to recall the governor in WI. 2012 will the governor’s last year in politics. Our “collective bargining rights” consist of liberal democrats stealing from our paychecks and telling us HOW to vote. I work for the state, but the union is just another bunch of hands in our pockets. Our pay has been cut, we have forced furlough days, our health care has trippled, and what we pay for our retirement has doubled. Taxes are higher, buying power of our dollar is schrinking, those in the unions are caught in the squeeze between managment and union bosses, neither of which actually KNOW (or have forgotten) what it is to REALLY WORK. I fully realize that I no longer do manual labor (I used to), and there are those who have worked all their lives who have no pension, so I don’t take what I have lightly. I have realized that the “promises” of 20 years ago, are no different than the “promises” FDR made with “The New Deal”. Neither are sustainable.

The sexual orientation if the judge making the judgement is immaterial, as Judge Napalatano said on Fox the other day – it isn’t, by itself, justification for recusal. If a homosexual judge is, by definition incapable of rendering a true verdict, why are we expected to assume that a heterosexual judge can?
As for the Wisconsin issue, I’d like to see the basis for overturning the lower courts decision before celebrating, but I think the recall effort will fail in WI – sure, you can find enough union members to sign a petition for a recall election, but the vast majority of Wisconsin voters are not state employees, and will, given the chance, vote in their collective self-interest, and letting union workers have more negotiating rights than nearly every federal worker is not in their collective self-interest.

Just hope they find some way to keep the outside big money from destroying the democratic process. There should be a ban on outside money being spent on state elections. Shouldn’t we the people be the actually people who live in the state.

Do you realize that things in the state have gotten much worse through 2 terms of Lib Doyle compared to where they were before his terms? They now have a budget that erases the state $4B deficite without putting it on the backs of the tax payers and raiding other funds to try and close the holes. The probelm is you really dont understand what unions were intended for, you only see what they are now and think that is is OK. Watch how many of these so called union supporters stop paying their union dues when given the chance!

I‘m 72 years and I can’t remember the unions ever doing anything for anybody except take your money and spend it on self satisfying things such as unauthorized trips including taking girlfriends with them ( I was with the head of a union on one of these party trips. Knew him personally) and none of it was union business. Have seen this happen in New Mexico and Texas also. Way back when unions first started they were good and gradually became more corrupt as they are now. Yes I am a Republican. Democrats need to wise up. The time has come. NO MORE UNIONS AND NO MORE OBAMA. Watch the state of Wisconsin they have been known to be the first to make government changes and then the rest of the states will follow. Too bad they aren’t on the Mexico border. We wouldn’t have the number of illegals that we have now. Give a big hand to Arizona for the job that they are doing.Many of the illegals from their are “getting out of Dodge and fleeing to Texas and New Mexico. That will end soon also with the right president in office and it sure isn’t “puppet” OBAMA!!
