Witness: Police Pointed Gun at Us, Smashed Cell Phone For Filming Fatal Shooting

Dramatic video out of Miami, FL, taken by two bystanders, shows what happened during the wee hours of Memorial Day. A police chase ended in the injuries of four bystanders and the death of 22-year-old suspect Raymond Harisse after several officers opened fire on him. But that dramatic video is exacerbated by additional footage that appears to show police turning on those who filmed it.
Two bystanders say police held a gun to their head, took one of their phones, smashed it, and then placed it back in one of their jean pockets. They also claim officers did the same thing to others they suspected of filming the shooting.
Narces Benoit and his girlfriend, Ericka Davis, described what happened to CNN, and said the only reason the video survived is because Benoit saved it to his SIM card and then hid it in his mouth:
The Daily Mail reports:
Mr Benoit claimed a police officer jumped into his truck when he noticed him recording video on his mobile phone, and put a pistol to his head.
‘My phone was smashed – he stepped on it, handcuffed me,’ he told CNN.
He said he only still has the footage because he took the memory card out of the phone and put it in his mouth before handing over the device.
A Miami police spokesman said he could not comment on eyewitness handling as an internal investigation or civil lawsuit may be launched.
But he confirmed police were looking for other suspects after the shooting.
However Ms Davis told CNN they were handled like ‘criminals’ and police ‘took everyone’s phones and smashed them’.
Mr Benoit, who was questioned and released, said he is considering suing police over his treatment.
Local station WPLG-TV interviewed Benoit’s attorney, who said Benoit was not found to have any weapons on him. The station also had a camera confiscated by police on the same morning.

Posted on June 7, 2011 at 1:29pmWe do need law enforcement but I am a believer that anyone in the law enforcement, judiciary, or legislative branches of government should face a doulbe sentence if they are convicted of any crime. They choose to be in positions of power where if they are corrupt they can use that power to destroy lives. Heck repeat offenders have different sentencing guidelines thus the same should hold true for our officials.

The Patriot Act allows police to conduct warrentless searches on EVERYTHING from cell phones to tracking devices on cars etc, and the Supreme Court said police could DOWNLOAD YOUR ENTIRE CELL PHONE if you get stopped for a traffic citation so the police do this now also.
It is just another step for the increasingly fascist police with Constitutional rights being eroded to feel they can now SMASH those cell phones.
Police no longer deserve to be given the benefit of the doubt or to be put on a pedestal. LOOK at the police behavior in Wisconsin. The police (in unions) REFUSED to kick out the Wisconsin state capital teacher union protesters and allowed THEM to squat for weeks ((Squatting against the law) when these same police REFUSED to allow the Tea Party to squat at that same capital.
If the police, in the heat of the moment, THOUGHT the cell phone help was a gun pointed at them, I can see the police holding a gun at them until they put it down. BUT, once the police realized it was a cell phone or a camera – THEY SHOULD LET THE PERSON GO WITH THEIR cell phone/camera INTACT.

Police today are getting as much out of control as they claim the citizens are. That was way to much and to follow up that excessice force by trying to hide the evdience and intimidate witnesses makes this an even more scary situation. Police need to be governed by the citizens and not themselves, and held accountable for their actions in court criminally.. This is way to much.

The car clearly was at a stop and the film did not show it being used as a weapon at all and it may have been that earlier it was – we simply do not know – what is clear is that the Police fired a great deal of rounds and then later used weapons and force to secure any devices that may have recorded their behaviors.
Guys, I hate to say this, but I do, most sincerely, fear our government and the Police. I used to respect both so much, but after seeing what some in each is doing, I must admit I fear them, and greatly so.
In our Republic, this should not be. The last elements one should fear are our Police and our governments. It’s hard to say, but even posting comments here, gives me reason to fear them and wonder if/when they will target me and how. Simply for expressing an opinion. I fear doing that at some level and it simply should not be. I want “Officer Friendly” back – well protected by the neighbors he serves and protects. I want a small, focused government – irrespective of level and each with a clear, limited charter to do the work of the people. I’m no fool. I understand we did this to ourselves, by acting so badly in so many cases and surrenduring our liberty by not taking responsibility. I am tired and I am afraid.

Posted on June 7, 2011 at 1:24pmI worked with law enforcement for years, and this is not very uncommon. Police now days are 50% 50%. Most of the time you see this happen with newer police. They are training the police with out constitutional rights now days. Here in LA they are now trying to change all toy guns to bright colors, because they tend to shoot first and ask 2nd. after 20 years, I have only drawn my side arm once. I work in a major city, and never once have I walked up to a car with a side arm drawn.
People need ton know this, don’t trust the police, don’t trust the goverment. Be cival, but never trust them. All cams need to be rolling all the time, because who watch’s over the police. Sure not internal affairs.
The police state is not coming it is here. Remeber a book called 1984?

They will harass, handcuff you, throw you in jail, maybe even shoot you and claim they thought you had a weapon or some such thing. I was always taught to respect the police and for the most part I do. They are there to “protect and serve”….but protect and serve what? And there are alot of cops that are so hooked on power they think they can do just about whatever they want. Remember how they tell you if a cop tells you to do something you better comply or else you can be arrested? A lot of them can come up with trumped up charges and you can be arrested in this country for just about anything. They want you, they have you. I don’t know what the answer is. There still are alot of good cops but that number is dwindling fast. They have a hard job to do and I understand that but what I don’t understand is that alot of them have the mentality that they can do whatever the heck they want and you better be in line with them.

For what macabre purpose? Or when someone collapses or has a misshape that possibly results in injury and people record it instead of helping. Your argument is based on “feeling” however, the rule of the US is based on the Constitution. I can relate to that …I teach my daughter to respect Police but do not EVER talk to them . Looking back on some of the LEO I used to work with I can understand why this is happening but I dont understand how ! It is just to much of a coincidence for this behavior to be random …..on this scale !

Cops or any official who breaks their oath to the constitution should be tried for treason as enemies of the state. The cops in seizing and then breaking the cell phones violated the 4th amendment, Laws against theft, and property damage. Pointing a gun at someone is reckless endangerment and terrorism.
They should repeal police protection laws. Police should be 100% liable both criminally and civilly for their actions not the tax payer.
The police are out of control. There isn‘t a month that goes by where don’t see one passing through red lights with no sirens or emergency lights on or zooming past stop sign intersections where in many cases they give out tickets to people for doing the same thing in the same intersection for just doing a rolling stop.

It is amazing that there are actually nations in the world where cops do not carry guns and people live mostly in peace. Go to Singapore and drop a hundred dollars on the ground come back couple hours the money will be there when you get back. Go to Korea cops carry guns but no bullets or they carry tear gas. If cops have anything similar to the mantra that military have, you only point your weapon any someone you are willing to kill. It’s one thing for the officer to have his weapon drawn but pointed in a safe direction until he saw an imminent threat but to point a gun directly at someone like that, unprovoked, is inexcusable.

I’m not in disagreement with you on this. What I‘m trying to say is that making all of it more easily accessible through legalization won’t make a bit of difference to the dead person who gets turned into a victim due to that legalization.
If I thought legalization and regulation of all judgement-altering drugs would reduce the bad stuff from happening I’d be all for it. The truth of the matter is that it’ll just create more exposure….from there it’s going to create more negative results, not positive.

Taking into consideration the seriousness of the subject at hand; I would think it would be more productive to address the actual events rather than taking a tangent. I don’t know Sinista and as for the facts, neither do you Kate, Joe, Dusty, Texas, et.al., BUT, you seem to find it more advantageous to attack a fellow poster than address what we actually saw in the video. I DID used to be a cop and I can attest first hand that they’re some of the most controlling, manipulative, imposing, and vicious people on the planet, right along with the so-called vermin that they’re (the cops) supposed to be protecting us against. I watched the video just like, I’m assuming, all of you did! I saw the police firing at will and with abandonment into a “stopped” vehicle. I then saw these same cops approaching a person videoing their deeds and pointing a DEADLY WEAPON at the person(s) doing the videoing. The rest is based on what we were told by the individuals that were assaulted by those that are sworn to “PROTECT and SERVE”.
I’m not interested in attacking another poster; what I am interested in is addressing the issues at hand and NOT loosing sight of OUR rights and also paying attention to those and the actions of those that are more than willing to deprive us of our rights at any given time!

Posted on June 9, 2011 at 4:39amUntamablekate: it seems to me that have been tamed already, if you belive, these triger happy cops, that are not behaving any more under the constitution,, then you are probably a family member , of a cop, many of this cops are out, not to serve the public but to intimidate, them and bringing any kind of suit, agaist, the departament, the tax payer is paying for the broken plates, that is why this creeps have become, so agresive, as for punishment, they don’t care either. They just go to another, town and join a police force, and continue on instead of sending them to jeil like the criminal they are. Wake up and smell the coffee. They want you as a tax payer, to fear them more than the corear criminals, but with lisence to kill, so just keep demanding for more police oficers to protect you.

Parilla said he began recording the beating with his cell-phone camera when he was grabbed by other police officers and threatened with a Taser, then handcuffed beside Ruiz, who Parilla said was bleeding from his face.
Parilla said police took his cell phone. When he got it back, the video and most everything else once stored in it had been erased, he said.
