Woman Launches First Lawsuit Against Idaho‘s ’Fetal Pain’ Abortion Ban

BOISE, Idaho (The Blaze/AP) — An eastern Idaho woman has filed what is believed to be the first lawsuit in the nation to directly challenge the constitutionality of a so-called “fetal pain” abortion ban.
Jennie Linn McCormack filed suit in federal court against Bannock County’s prosecuting attorney, contending Idaho’s new law banning abortions after 20 weeks of pregnancy violates the Constitution.
Idaho is one of six states that have enacted such bans in the past two years. The bans are based on the premise that a fetus may feel pain at 20 weeks. LifeSiteNews.com has more about the development of this concept:
The science behind the concept of fetal pain is fully established and Dr. Steven Zielinski, an internal medicine physician from Oregon, is one of the leading researchers into it. He first published reports in the 1980s to validate research showing evidence for it.
He has testified before Congress that an unborn child could feel pain at “eight-and-a-half weeks and possibly earlier” and that a baby before birth “under the right circumstances, is capable of crying.”

McCormack, who was briefly charged with having an illegal abortion, is seeking class-action status in her lawsuit against prosecutor Mark Hiedeman. The suit also challenges other parts of Idaho abortion law.
McCormack was charged with a felony in June after police said she took pills to terminate her pregnancy last December. Police found the fetus in a box at McCormack’s Pocatello home Jan. 9, and an autopsy determined it was between five and six months gestation. Police said McCormack told them she didn’t have enough money to go to a licensed medical professional, so her sister helped her access abortion-inducing drugs online.
A judge later dismissed the criminal case without prejudice for lack of evidence. That means the prosecutor may refile charges if he chooses, unless the federal courts stop him from doing so.
In the lawsuit, McCormack challenges the lack of access to abortions for women in her region, as well as the ban on abortions after 20 weeks.
She notes there are no elective-abortion providers in southeastern Idaho, forcing women seeking the procedure to travel elsewhere.
McCormack was unmarried and unemployed at the time of her pregnancy – with an income of $200 to $250 a month – and already had three children. She couldn’t afford the time or money it would take to travel to Salt Lake City to get an abortion, the lawsuit says.
If McCormack prevails, it will be a win for women across the region, said her attorney, Richard Hearn of Pocatello.
“If we’re successful, they’ll be able to access legal and safe abortions in southeastern Idaho,” whether performed with medicine or surgically in a clinic, Hearn said Wednesday.
Hiedeman could not be immediately reached for comment.
Idaho law bars women from getting abortions from anyone but licensed Idaho physicians, and requires that second-trimester abortions be performed in a hospital. Women who purposely cause their own abortions, or who get abortions from unlicensed physicians, face up to five years in prison and up to a $5,000 fine.
McCormack is asking a judge to find that those criminal sanctions are unconstitutional, in part because they wrongly burden women in regions like southeastern Idaho that lack abortion providers.
Another Idaho law, passed during the 2011 Legislature, bans abortions once a fetus has reached 20 weeks on the belief that fetuses begin to feel pain at that stage. Idaho was one of five states – along with Kansas, Alabama, Indiana and Oklahoma – that enacted bans modeled after a fetal pain bill passed in Nebraska in 2010.
The situation may be more complicated as time progresses. Arthus Caplan, a professor of medical ethics at the University of Pennsylvania School of Medicine, claims that an overall change in abortion methods may also add intrigue to the fetal pain debate. He says:
“It’s headed in an interesting, fascinating and important direction because the future of abortion is pharmaceuticals, not surgical procedures.”
Thus one wonders: Will pills that induce abortion, as they develop, be considered mechanisms that cause fetal pain?
McCormack says the new law violates the Constitution because it doesn‘t contain an exception allowing for abortions if necessary to preserve the mother’s health, and because it prohibits some abortions even before a fetus has reached viability. Roe v. Wade barred states from prohibiting abortions done before the age of viability, and other legal rulings have since determined viability occurs at 22 to 23 weeks gestation.
That contention echoes an opinion written by Idaho Attorney General Lawrence Wasden’s office, which advised state lawmakers that the fetal pain bill could be found unconstitutional under the 14th Amendment.
It’s not the first time Idaho lawmakers have passed abortion laws that they were warned likely would be found unconstitutional. In the past decade, Idaho has spent more than $730,000 to defend restrictive abortion laws that ended up being struck down by courts. Those costly rulings prompted legislative leaders in recent years to require that abortion-related legislation be reviewed by the Idaho attorney general’s office.
Republican state Sen. Chuck Winder, who sponsored Idaho’s fetal pain legislation, didn’t immediately return a phone call seeking comment.
The National Right to Life Committee said Wednesday it believes the law will be upheld.
“Unborn children recoil from painful stimuli, their stress hormones increase when they are subjected to any painful stimuli, and they require anesthesia for fetal surgery,” the group’s legislative director, Mary Spaulding Balch, said in a statement. “We are confident that the Supreme Court will ultimately agree and will recognize the right of the state to protect these children from the excruciatingly painful death of abortion.”
Janet Crepps, director of the U.S. legal program for the Center for Reproductive Rights, said laws like fetal pain bills are both unconstitutional and bad policy. They also are “demeaning to women and their doctors” because they don‘t take into account how each woman’s situation is different, she said.
“When you think about all the regulations that are piled onto abortion, it just clearly becomes impossible for doctors to provide them and women to receive them in a situation like McCormack’s,” Crepps said. “It’s a really sad situation.”

Then she should have kept her legs together. They did a study when my now 21 year old was 15 months old and having heart surgery to see if he felt pain as they took the breathing tube out. they asked for permission to take a blood sample out of his A-line to prove that he felt pain. I granted permission, because I know he felt pain. Poor thing tried to cry, but couldn’t make any noise because the breathing tube temporarily made him lose his voice. It was like a whispered cry. A 5-6 month old child is capable of life outside the womb. I know, my nephew was born at 6 months, 3 months premature. He’s now active duty Navy.

It blows my mind at just how much a lib supports the murder of unborn babies. If the headline was switched around, and it was puppy, it would be a completely different story. The libs would come out in droves and go crazy over a puppy, and the thought of it feeling pain. A human on the other hand means nothing to them.

Lots of anti abortion folks on the blaze. Many with religious/Biblical convictions. This post is for you (especially ladies that attend church).
If you are ever sitting comfortably in your church pew with your Sunday best, and in walks that sixteen year old girl who has on the short skirt, over done make-up, tight fitting top, visible tatoo….. When she sits down, if you are not the lady that will walk up with a warm smile, and put your arm around her shoulder, and make her feel welcome, and be kind and loving, then you have no place ever writing or speaking so much as a word against abortion.

Thus the reason so many people are turned away from church. You might find that it works better to let God convict hearts, and keep your standards to your self. You might want to set an example and not declare one. When people change on the inside, it will show on the outside. To many christians wanting to change someone on the outside, and leave the inside as it was.
That young sixteen year old girl (who may be pregnant) will hit the door running and not come back when you start preaching about how she is dressed. Show her some warmth, kindness, and share the gospel with her. If she gets right on the inside, she will feel out of place real quick wearing non appropriate clothes. Once again, let God do the changing, just throw out some seed.

He says that what happens within the church walls for an hour every Sunday is not nearly as important as what we do as Christians the rest of the week. We are taught to sow the seeds, just like you said, because you never know when that seed might finally take root. We are to hate the sin but to love the sinner. We may not understand why some people do the things they do (such as killing their unborn babies) nor wish to tolerate those actions, but we are still to love them just the same.

Hired a wonderful youth pastor that reached out to kids and the church started growing. One Sunday morning one of the young adults invited her parents to church. They came on Harleys and were wearing very nice clean leathers. One of the Old ushers actually went to them when they sat down and told them they were dressed inappropriatly for church. They left. This was their first time in a church. I pray it was not their last. Made my heart sad.

On the topic of abortion, my opinion is, it’s never ok. Keep your damn legs closed or your **** in your pants if you don’t want a child.

My baby brother was born disabled and my parents were told he wouldn’t live long. We were blessed with 19 years with him, he touched many lives more then I realised until his standing room only funeral. Life is a blessing, a gift that has more value then anything, my brother taught me so much & I miss him dearly.
There has already been so much loss of life and unrecognized potential as a result of abortion. For all we know the baby who had the brain power to cure cancer or develop clean fuel alternatives has been aborted, murdered and lost for ever… How dare us commit such atrocity, it’s disgusting. But thats just what I think.

And what form would those “seeds” take if not helpful advice about what form of behavior is most appropriate and prodcutive for a decent young woman. People are dying for lack of proper guidance while the world is too busy giving all the wrong advice. Anyone who turns and runs by helpful criticism doesn’t yet have the proper attitude to take it the message that should be coming out of the pulpit and from the altar. God offers salvation to those who seek it. If people aren’t ready to acknowledge that they need it they have come to church too early. Imagine a drunk with an open bottle coming to an AA meeting and being offended by someone telling him that he shouldn’t be drinking. If he wasn’t ready to admit that he was just waisting his (and everyone else’s) time.
Any “pastor” that thinks Christians shouldn‘t be calling each other to account within the church hasn’t read 1 Corinthians

Even though I agree that some people could use a lesson in sensitivity, not all people respond to confrontations in the same way.
Personally, I have always been up for a good debate. God has placed Christians in my life since I was young (first one was my babysitter). But it wasn’t until I met my future sister in law that she got in my face and challenged me on the things I believed. In my attempt to prove her wrong, I started researching and found that what I believe was incorrect. Most people would have been turned off by her approach. But that is how I was led to Christ.
I do appreciate most of your posts. On this I must say that one size does not fit all. For each individual you need a counter individual to meet them where they are at.

Posted on September 1, 2011 at 3:58pmRANGERRP~ It‘s been my observation that people who walk into church dressed inappropriately are either ignorant of the ’rules’ (My church expects men to wear ties, women to wear dresses or skirts, and all to be dressed modestly, which includes covering the shoulders and cleavage; but I have a cousin who went to her church in hot pants and a halter top.), haven’t anything else available right then, or they purposefully dressed inappropriately as a way of daring some judgmental twit to say something thus giving them an excuse to not come back.
Anyone who takes the bait is a fool.
In either case, the act of telling anyone they are dressed inappropriately for church is a waste of time at best. Unless they are blind, they know.

Posted on September 1, 2011 at 7:16pmGood comments on here. I think a few missed the point. Believe me, I am for high standards, and especially at Church. Biblically, older women in church should teach the young ladies.
Perhaps my scenario was not the best (even bored some). The point I was trying to make, is that I think some fundamental churches get a bit upity and rule oriented when the unsaved show up. If they get saved and their heart gets changed, their attire will change also.
Not sure if this is applicable, but when Jesus showed up and dealt with the maniac of Gadera, he did not preach about his clothing (he was not wearing any, and chains could not hold him). Jesus first delt with his spiritual condition. We see in follow on verses, that man was clothed and in his right mind.

How many folks responded to your post?
As for you question about “what does this have to do with murder?” I will break it down Barney style for you. Take copious notes, and try to hang on.
Many of us believe that abortion is murder
Many of us get our belief from the Bible
Many of us would like to see abortion rates go down, or go away
Many of us attend church
Some girls that are in a bad situation, may end up pregnant, may not be part of a church or have good upbringing, may never have gone to church, but because of their current situation, may go to one looking for help. She may be dressed like the world, but may be ripe for the picking (like wheat)
My suggestion of being on the lookout for such a person, would advise that the young girl who looks out of place may be more receptive to kindness than an upturned nose.
WIth kindness, and salvation, we might keep one more baby from getting murdered (via abortion) and may see one more soul go to heaven .

How creepy, being too poor to have another baby and then having sex anyway, knowing full-well that you will be killing that poor defenseless child. This chick must have incredibly hot and intense sex, screaming to her partner “kill a baby, kill a baby!”. Like some type of wiccan ritual, it must be, offering a sacrifice to one’s god…
Lady, if you are too poor to have a baby, you are too poor to have sex of any kind. You shouldn’t even go in a public swimming pool or jacuzzi, lol.

This twit killed her baby when she was a little further along than I am. After already having had children, she had to have felt that baby moving around. That’s a feeling a mother never forgets. How in the world this breeder could choose to kill her child is beyond me.

I’m a mother of two little ones, one a little boy of 6 months, and I cannot fathom ever inflicting any pain on them, especially death. Satan has a real hold on this world. It’s 100% affective every time. If you don’t want children, don’t have sex. Abstain. And don‘t tell me you can’t, it’s an animal instinct. Our ability to reason and make a choice is what makes us a bit different then any animal. God created us from the womb and each and every child as well. I feel for the women who have bought into the idea they have a right to sacrifice their children to the god of convenience, but that’s what the Destroyer does–sacrifice God’s children.

These are baby human beings being killed! It’s not an unwanted appendage an appendix or an extra toe!!
Why oh why do liberals fight tooth and nail to preserve the murder of unborn children and then mock and condemn those who wish to save them? Is it wrong to want to prevent abortion from being used as a form of birth control?? Is it THAT BAD to protect children? Is asking people to have some sense of personal accountability really too much to ask? In the mind of a liberal, YES.

A child that is only a few weeks old has everything that an adult has, except they are only about 3 inches long. I mean everything too. Everyone that believes in partial birth abortion, like Ocommunist, should have to sit in a tiny little room, and watch one on a big screen. Abortion is murder, plain and simple.

Posted on September 1, 2011 at 9:34amIf she was that poor then what about surrogacy? They pay ALL the mother’s expenses and even buy healthy food! Sometimes they even pay a stipend to the mom. I’ve heard of this for moms who are not being surrogates but simply putting the child up for adoption. There are childless couples out there VERY willing to do this and can afford it. Her story is crap. She probably did all this to push an agenda to begin with. Why keep the baby’s body in a box anyway? Seriously, WTH???

Posted on September 1, 2011 at 1:31pmThou Shalt not Kill. Murder comes pretty close to being an Unforgivable sin, but still requires a type of forgiveness on our part. To forgive one of murder is one of the most difficult thing for anyone of us to do. Especially when it comes to children. God will answer upon the head of those who commit these heinous crimes an hundred fold if they repent not. Forgiveness still requires repentance and recompense for ones actions and the turning of ones heart to god or the atonement can have no effect on that persons soul.
Someone once said,”Forgiveness is a sweet and noble quality of the godly soul.” Someone also has said, “that forgiveness is the fragrance that the violet sheds on the heal that has crushed it.”
I pray for the strength to be able to forgive every day, because I would not be able to do it with out Gods help.

You enjoyed your Pursuit of Happiness, the consequences are the creation of a life which now takes precidence over your liberty and further pursuit of happiness until you give birth to that life. Ending that unique life(not a part of a part of a woman’s body, a different, unique and distinct DNA) is very clear, the taking of an innocent life is murder. Pretty straight forward.

Report Post »They make it intentionally hard to adopt or to give your child up for adoption that women… (and guess were the largest percentage of abortions come from…that’s right black women)… take the easy, lazy road and head straight to planned parenthood to murder their child!

One would think she would have MUCH more careful. $200-$250/month? I would bet she is on welfare and every other social program. I know women who have 3 kids, work, and STILL have time to raise their children. Good men aren’t that hard to find, either. And…..where was the father in all this?
