Women Arrested for Recording Police from Front Yard Plans to Sue Rochester P.D.Emily Good, the woman arrested for filming police conduct a routine traffic stop from her own front yard won a victory in court Monday when charges against her were dropped. The judge, district attorney’s office, mayor, and local police chief all felt there was no legal basis to pursue the case.

Good, whose stated reason for filming the traffic stop was that “three white officers were stopping a young black male,” is not giving up her fight against what she considers police misconduct and might even sue the Rochester police department.

YNN reports on the details of Good’s courtroom victory:

It took less than a minute for a judge to dismiss an obstructing governmental administration charge against Good, saying there was no legal basis to move forward.

Good was arrested last month while videotaping a traffic stop outside her Rochester home. She was taken into custody after Good failed to go inside her home when ordered to by Rochester police officer Mario Masic.

Good says even though the charge has been dropped, her fight against police injustice is just beginning.

“I’m part of a community center, the Flying Squirrel Community Space,” said Good. “We’re having conversations on a regular basis right now about police accountability. We want to hear people’s stories of racial profiling. We’re working on sort of a place to document stories and maybe look at patterns.”

Engaging in conversations about racial profiling at the Flying Squirrel Community Space aren’t all Good plans to do, however. Good’s attorney Donald Thompson reportedly told WHEC she may sue officer Masic and the Rochester Police Department for violating her civil rights.

Thompson says says the lawsuit will claim a violation of Good’s civil rights under the guarantees of the First Amendment. He said they will either file it in state or federal court.

“There was no crime that she committed here,” says Thompson. “There was no basis to arrest her. There was no reason to forcibly take her from her property. It’s a violation of her civil rights.”

“It was pretty far over the line,” says Thompson. “That’s why it went national. It didn’t go national because this is something that happens every day, or it’s kind of run of the mill. It’s not. This is a pretty cut and dried violation. “

The Blaze recently reported on Emily Good’s history of confrontation and her affiliation with a controversial movement called Take Back the Land. Given her track record with law enforcement, one wonders if this will be the last time Good ruffles the feathers of police.

      She was not in any way, shape or form interfering with the police doing their job. Standing peaceably on your front lawn using a video camera is not “threatening” to anyone, and it harms no one.

      It is not our “duty” to blindly follow orders in America. It is, however, our solemn responsibility to defend liberty.

      The woman was arrested– she lost her liberty– for standing on her own property with a video recorder. If you are OK with that, I am not OK with you. Go live in another country where you will fit right in.

    More to the story or not doe’s not really matter she was acting in a legal matter their is no law against Taping Police especially from your own propery this is a fast open and closed case

    if nothing else we should take her example and get money as well if we are aressted on our property for the same actions take the money from each case and build it into a fund for fighting against abuse of power untill they wise up and stop over-stepping their boundries

    you will keep them in check, and give our society what it need‘s cop’s going after true criminals who deserveit and not bystander’s struck with curiousity

    I agree we have a police department here where i live that is out of control it takes 5 of them to write a speeding ticket in a small 20,000 population town. we had a city councilman videotaping them the other day and one of the officers chased him to his house and anted to know why he was video recording them. if it had been a regular citizen I bet that they would have went to jail.

    The story is wrong about this does not happen often. This happens more and more everyday and in more and more states. The police can run wild beat who ever they want to and if you tape it. Then you go to jail for wiretapping. Look on youtube many many videos of police arresting people.

    I’m normally 100% for cops. But even a cop friend of mine reviewing this video said it was very clear the cop was in the wrong. The other two leaning on their car did not seem the least interested in her. She should have said when he approached her property, ‘please do not trespass on my property’.
    This woman does seem to be a malcontent, police instigator belonging to a socialist wealth-distributing, anti-capitalist group, but in this case, the cop brought national attention to her because he screwed up. No matter what she said before she started filming, nothing justifies the cop’s actions. He did not like being filmed and did not like the idea that a citizen would not obey his illegal command to her get into her house.

    They dismissed charges for lack of a legal basis for her being arrested in the first place? Not suprised at all. I do not agree with that woman political but I know when cops abuse their power and would NEVER wish for another citizen to have to go through what that woman and many other americans have to go through with cops who think they can do anything they want to us.

    How many americans have to go through what she did but never gets media attention to shine a light on the truth of how many cops act like when they think no one is looking?

    I normally support all police, but I have noticed a tendacy for some officers nationwide to react to being filmed with hostility. It’s definately frowned upon anyways. Most officers do what they are supposed to do though, so I’m not sure why they react this way.

      I can’t explain this, but as a limousine driver, I was recently put in a position of having to drive through a line of protesters. They were stopping my vehicle, and basically harassing me. I didn’t have a problem with any of that, but as soon as somebody started taking my picture through the windshield of my car, I got angry and told them that they have no legal right to harass me. There’s just something about having a camera stuck in your face against your will…..

      You have no idea what was said or not said before she started video taping… it’s completely hearsay and it may in fact be ALL bull. And based on the way the cops acted DURING the video, I’m not tending to believe what they say happened before the video was an accurate description.

      The point is, whatever happened before the video is moot. If she broke a law, she would have been apprehended for it, but she obviously did not. THEN she started recording and still, no law breaking went on. You can’t base your argument on speculation especially since the cops had nothing to back it up with (in terms of an arrest prior to the video).

      I don’t agree with her politics, but there is a big difference between being an activist and being an anarchist. And her past is not relevant to this case, since she has no history of harming a police officer– or even attempting to harm one.

      The cops were out of line. Regardless of her politics, I support her 100% in this case. Citizen watchdogs are not a threat to liberty– they are defending liberty. Her actions in this case were peaceful, and no reasonable person would or should feel threatened by anything she did from her front lawn that night.

      That’s a great way to get the cops to quit doing their job. Threaten them with a lawsuit every time they stop a female or a minority, and pretty soon you’ll see they quit making the stops.       The officers stated there was more that was not filmed before she began recording.

      I don’t EVER think it is wise to try to interfere with a police officer in the discharge of his duties.

      If he is busy trying to arrest someone, and people behind him are shouting at him (which is a threatening act), the officer is trained always to control the scene and the people, THEN sort things out. Should he be worried whether she is going to turn violent just feet away, while he is trying to arrest someone? Or, should he arrest her too, and sort it out later?

      Devil’s advocate here.

      NO way to know the facts from a PARTIAL video. Wait to see the FULL video, etc.

      Partial videos do not tell the whole truth. That is why squad car videos are ‘always-on’.

      I say, “wait” on this one.

      actually she probably cant sue them indivually, almost always they are protected by immunity to break laws.
      It may be nice if law enforcement personel were capable of being held to the same standards the public they protect is, but this is not the case legally most of the time.
      If they were able to be sued indivually it would be even worse though, can you imagine the endless number of BS lawsuits they’ve have all the time.
      As inane as it seems in cases like this, over all its probably the best way, just unfortunate

      She was on her own property, and the property is in the USA. She was not interfering with anything by taking a video– video cameras don’t cause interference with human activity…they just record it.

      No cop has a right to order people off their own property when there is no event taking place on that property that is threatening anyone.

      She was on her own property. Nothing she was doing is putting anyone in danger. Nothing she was doing prevented cops from doing any part of their job– except that it messed with their teeny little brains (like yours) . The cops do not have authority to make up law on the spot.

      Now, she needs to take the her case against the Police and City to court.
      Remember, she was handcuffed , removed from her own property, then arrested, mug shot, spent time in jail and more than a day/night away from her home, and had to get bonded. Then had to show up in court.
      For what?
      This isn’t funny and the cops deserve whatever they get from this.

Emily Good made NO inference towards the police officers by simply recording their actions while civilly standing on her front lawn. Yes, she has Marxist-themed viewpoints, but that in no way justifies the arresting of her by that irate police officer.

      There will be fewer police in the coming months to pursue frivolous arrests. Layoffs are occurring all over the nation right now. Pensions in some areas are being challenged too, which, in my view will be reneged upon by the ruling authority, because they won’t be able to pay for them.

      It’s an absolute fact that society cannot and will not run efficiently without proper laws and law enforcement; however, what we’re up against today is a society where politicians and police are becoming a power all unto themselves. Misconduct occurs repeatedly.

      History clearly shows us that this is the point where societies begin to crumble. Add that to that the leftist totalitarianism of the media, the tribalism caused by “diversity,” a plummeting economy, and a recipe for disaster is in the making.

      Bye, bye Miss American Pie. Went to the levee , but the levee was…………….blown up by whitey, which means paranoia can be added to the list of reasons tribalism is a disaster.

      Wow you are really off base on this one! You realize that just being arrested follows you for life and must disclose on many job applications, just an arrest no conviction. Try to work in a nuclear plant, school or hospital without disclosing that, And to go to court there needs to be a crime, is that so hard to understand? no crime and its just using the courts and the cost of it to punish you without recourse. please don’t sacrifice intelligence to get a comment in every post most of the time your not where I am but at least not off the reservation.

      To those saying “she had a history of confrontation w/ police” as justification for the LEOs’ actions:

      It doesn’t matter. TEA Party protesters have a history of confronting authority also, so would it be OK for LEOs to come onto a TEA Party member’s property and arrest them for recording their actions?

      Saying that it‘s OK to violate an individuals’ Constitutional Rights based on their history of political dissent is exactly the kind of thing that I thought we hated about corrupt Progressive actions and policies. I personally don’t support her political views, but she has the same rights that every citizen has. It could just as easily have been a TEA Party member recording police arresting/assaulting a peaceful TEA Party protester.

      Unlike Progressives, I believe in Equal protection under law regardless of political views. I may disagree with what someone says, but I will defend to the death their right to say it without Government retaliation.

      Some of my fellow Blazers need to stop and think through their positions on this matter, and what the Founders would have to say on it.

      There is no law against filming the police. They have no right to tell her to stop filming nor do they have a right to tell her to go in her house. This hero worship of anyone in uniform has gotten out of hand. Most cops I’ve met are arrogant, condescending pigs on a power trip with an ego the size of a bloated whale. Screw them. They all need to be taken down a few notches and reminded what their job description is. To protect and to SERVE. They are not our masters. We are theirs. Government on ALL levels needs to be crushed.
