Man Stands for 7 Hour Flight Because of 400lb Seat Mate

 

As we are entering the busiest travel days of the year, everyone has their own horror stories while flying that come to mind, but few could relate to what Arthur Berkowitz had to endure. Due to a full flight and 400lb neighbor who “spilled over into Mr. Berkowitz’s personal space,” the 57-year-old had to stand for the entire seven hour duration of US Airways Flight 901 from Anchorage to Philadelphia. Berkowitz tells the Daily Mail about the nightmare flight this past July:

“‘He said the obese man was very sorry. ‘The first thing he said to me was: ‘I want to apologize - I‘m your worst nightmare’,’ he told MailOnline.

Mr Berkowitz added that his ordeal in July presented a safety risk because he could not use his seatbelt for take-off and landing.”

A safety risk that apparently has happened before. Consumer advocate Christopher Elliot writes in his blog that “Telling an airline passenger who can’t fit into a seat to stand is pretty unusual. But it happens.”  Elliot notes that the Federal Aviation Administration rules require passengers to be seated with their seat belts fastened during takeoff and landing, but the agency strongly suggests passengers remain seated for their entire flight because of the possibility of turbulence.

The flight from Anchorage to Philadelphia is one of the longest non-stop U.S. domestic flights. Berkowitz claims that flight attendants admitted their gate agent had made an error in allowing the obese passenger to board without having bought two seats. The Daily Mail reports that US Airways has since apologized for the ‘regrettable incident.’

“Our intention is to offer the best travel experience possible,” the airline wrote in a statement. The details you have provided indicate that we have failed to meet our intentions.”

US Airways offered Berkowitz a $200 voucher in compensation which Berkowitz says is “inappropriate” considering he paid more than $800 for the ticket. Berkowitz says though that he is primary concerned that the airline has done nothing to fix the safety issue.

“It did not allow me to use my seatbelt during takeoff and landing as well as required me to stand in the aisle and galley area for most of the seven-hour plus flight,” says Berkowitz. Elliot agrees with Berkowitz’s safety concerns and compensation frustration:

“I reviewed his case and agreed with him that US Airways might want to take another look at his complaint. I mean, leaving a passenger with no alternative but to stand for almost seven hours — if that’s true, then this might be one of those rare cases when a full refund is in order.”

A representative for the airline told Berkowitz that US Airways has made its last, best offer.

    this could have been easily fixed before takeoff… they could do either of 2 things when they seen seating was done, and he was left standing.

    1. offer the slim guy a latter flight and a bit of compensation for the delay, AND make the fat one pay for 2 seats.

    2. If the the fat one could not pay for 2 seats, toss him off the plane and let the slim man sit. offer the fat man a latter flight, but still paying for 2 seats, reduced charge maybe.

    I’m sorry, if I was a flight attendant or captain on that flight.. i would have not allowed the plane to take off till this matter was cleared.
    and on a side note.. the fat one should not have been let on the plane without paying for 2 seats.. should be a disclaimer on the tickets, if you weigh over x amount for x height, you can’t fly unless you get 2 tickets.

      Why not allow the guy to sit in one of the seats that the flight attendants use? I’m sure there is almost always a spare seat or a seat unused in the cockpit. I‘d much rather spend the 7 hour flight bs’ing with the pilots than having to stand up in the aisles. And don’t anyone give me that BS about it not being safe to let a man in the cockpit with the pilots on a commercial flight after 9/11. They used to allow children to enter the cockpit and snoop around all the time. Also, one look at a guy (not PC, but it is an accurate way to make a decision about a person as the way a person concerns themself with their own appearance says alot) and you can tell whether he is a real threat or not.

      Just remembered. Where was the air marshall on that flight?

      It‘s BULL he could’ve sat in an attendants seat while they stood.. Usually they are walking around after take off passing out food and such ,anyway.. Just another lawsuit.. Oh well what can you do when people can’t think ?

      The FAA has to approve the seat design before it is installed in the craft. It has to be able to support and average weight person, I forgot the number in high gforce situation. The 400 pounder is probably out of spec. The airline should be able or the FAA to stop this fat thing

      We are becoming a fatter country. Perhaps the airlines could install a couple of larger seats for fat passengers, or others who might need a larger seat, but, of course, that wouldn’t be profitable. The airlines don’t give a dam about your comfort, they just want your money. Buy a ticket, set down, shut up, and don’t make trouble. That’s what they want.

      I always had to buy three seats for my little butt….now I have a whole row for myself when I use the AF1 for vacation trips with all my friends, family, hairstylist, etc. It doesn’t make me proud of my country, but it feels good when is free!!!!!!

      While I believe evryones rights should be respected I also believe this is a black and white issue. If a persons fat ass spills into the next seat they should be made to purchase both seats. Airlines should be able to figure this out before the flight departs. I am a business flyer and this is my biggest complaint. That and the short person in front of me that pushes their seat back onto my knees. Bottom line if a person cannot control how much food the shove into their mouths then they should have to pay the price so as not to make the rest of us suffer because of their problem.

      There is a disclaimer. The airline screwed up! And the thin fella has an obligation to press charges for risking his welfare! I have a buddy who works for an airline company and he tells me stories about how fat people get pissed off at him all the time because he has to do his job to protect the welfare of the other passengers on the plane. His responsiblity is this… If a person looks to be larger than 250lbs they are to be charged for 2 seats. I‘m not a scientist or anything but wouldn’t it be a smart idea when your buying your ticket that you had to enter your weight and height so that the airline could properly find you a seat?… just a thought FAA… isn’t this your job to think of things like this?

      Or if the fat man couldn’t handle half of the flight, then others could stand for 15-30 minutes. Spread around the “labor” — and THEN the airline should spread around a LOT of cash (and then “flag” the big man — not for being fat, but for taking up 2 seats — and require that he purchase 2 seats the next time (and share the info with other airlines)).

      The man who was forced to stand during the flight should be offered a FULL REFUND with no questions asked. If not, if I was him I would seek out a law firm that handles law suits against airlines. The offer of US AIRWAYS to give the man a $200.00 voucher was a second slap in the face and completely unacceptable. US AIRWAYS broke several FFA rules and should be held accountable.

    7 Hours standing! I‘m glad I don’t fly! Between dealing with the perverts/thieves at TSA before boarding ,the poor service from US Airways(the flight attendants could’ve found him SOMEWHERE to sit for a while),and the other passengers who could’ve at least understood the situation and offered Berkowitz their seat for a time.
    Fatboy caused it all.But some compassion and the Golden Rule by EVERYONE involved would’ve helped this man and this situation.

      I’m with you. I quit flying after I got out of the Navy in 1974 under the Nixon administration started their metal detectors and pat-downs looking for drugs and hijackers. I figure if I can’t drive or take a train, then I won’t go. I don’t see any reason to change my mind; it certainly hasn’t gotten any better. At least no one loses my luggage anymore….

    There should be a gate that you have to walk through that is no wider than the seats. If you can’t get through without touching both sides, then you don’t get through. From there, you get measured and get to choose to pay for 2, 3, 4, seats, whatever it takes.

    The fat guy, at the very least, should have had to buy a first class ticket, or gotten a grade a prime beef registration with the faa.

    What a coincidence that it was a US Air flight. My mum was schedule to leave on a 3pm US Air flight from Montreal to Philadelphia yesterday. At around 11am she got an automated phone call telling her that the flight was canceled because of some cancellation in Philly. She called the airline & was told that the flight was scheduled for 6pm. From that point on, the flight was rescheduled 5 times. It FINALLY took off at 8:45pm, after she had waited 4 and a half hours at the airport. At least she got to sit down…

    On a flight from DC to Seattle, direct, I had to be mashed into the left window I occupied by the middle seat obesity next me. I spent the entire flight trying to relax my claustrophobic leanings and remember to breathe, breathe, breathe. What made it worse was I could not use my right arm due the man’s immense weight crushing me. So I did everything with my off-hand, from listening to my music to flipping pages in a magazine. I tried to remain calm the entire 5+ hour flight.

    Absolutely the worse flight I had ever experienced. I know the feeling.

    Why didn’t they let him sit in one of the flight attendants seats? I know they have them. If it were my business, I’d have an employee give up their seat for a customer. It’s just the right thing to do.

    and PLEASE people, stop with the fat people attacks. Yes, the man should have paid for two seats, but that’s the responsibility of the airline to enforce. The person apologized and that’s between him and the gentlemen who had to give up his seat. But attacking him here in these forums shows no class at all.

      I’m not going to attack the obese fellow, but I would encourage him to lose weight before it kills him. As for Berkowitz, he should receive a FULL refund, plus extra for having gone through the trouble of standing and risking his safety. If US Airways doesn’t offer, he should consider filing suit.

      @ Nomark- Agreed, airline is at fault here. However since the obese passenger was entering the space of his seatmate he is the one who should have been forced to stand . There is no way I would have allowed a perfect stranger to suffer due to my issues. His failure to do so is a n abject violation of our social contract as a civil society.

      It was the gate agent who should have stopped him at the gate. By law only a flight attendant is allowed to sit in the seats but they should have made an exception and placed him in one that wasn’t in the way! My daughter just flew in on a 4 hour flight and she had the same problem. No room in her seat because the person next to her took up too much space. Her leg is now killing her because of how she had to sit – just isn’t right!

      Maybe he should stop apologizing for being fat and show some moderation in his daily diet and do some moderate exercising to help.

      The guy KNEW he was too fat for the seat when he pre-apologized to the guy by saying, “I’m your worst nightmare.” They should have kicked the fat guy off the plane.

      Companies make mistakes and if they let him on the plane by accident, despite him not having purchased two tickets, the easiest move is to kick him off the plane, refund him the money from his one ticket and force him to buy two tickets on a later flight. It’s not like this issue happened mid-flight and they couldn’t easily remove him. This happened during boarding, so much so that the guy couldn’t buckle his seat belt. Fact is, the fat guy got two seats while only playing for one while the other guy who paid for a seat, didn’t get one.

      I disagree. If you’re fat you know it and need to deal with it. Making airlines have rules just adds costs and hassles for everybody. Don’t make it my problem. Lack of courtesy and a common moral fiber is killing us one slice at a time.

      Lose weight, buy two seats, stay home, whatever. I’ve got my own problems without having to ADA accommodate some fat guy. And if we do have to evac the plan Darwin is going to kick in. You can try to be PC but nature knows only natural selection. Once again your choice, your consequences.

      Glad to know that name calling and attacking someone for being obese is all good. You know, I flew once and there was a big old NFL lineman sitting next to me (can’t remember his name, but he wasn’t a starter yet). I think he was easily 300 pounds or more and he spilled over into the middle seat where I was. Thankfully, the flight wasn’t too long, but it was uncomfortable for me to say the least and no one called this guy an “obese pig.”

      As to the airline, yeah, the obese guy should have had to buy two seats. One of my good friends is 350 pounds and though he doesn’t fly, he has said that if he did, he’d be flying first class since that was the price of his love of cheeseburgers.

    plus, this guy should get more than a free ticket. He should get several free flights.
    what if he was unable to stand for that long? where would he sit?

    I guess spilling a glass of water on the other guy’s seat so he has to sit in a soaked seat would be totally inappropriate, won’t it. Whose nightmare then?

      The fat guy would have hurt more people had there been turbulance….the regular sized guy makes a smaller missle. But I agree, if he truly felt “bad” and apologized, he should have shared the discomfort. As for myself, I think I would have made him squeeze instead of giving up my seat.

      I just don’t fly, period. I don’t want to be groped by anyone but my husband, especially some big black woman who enjoys it. And being a breast cancer survivor with a prosthetic, they’d make me strip and prove there was nothing in it, so I’m not flying ever again. If I can’t get there by driving, it ain’t worth going to.

    Actually that’s a very valid concern. If he’d even so much as tripped and bumped his head, the airline would be on the hook for millions.

    Either widen the seats or, hey, charge fat people who cannot fit into one seat for double steerage and do not sit anybody beside them to begin with. You have a right to a seat if you and the airline agree to it, yes, but you don’t have a right to force somebody to potentially break his neck because he was forced to stand during takeoff and landing, nor should any good business put you in that situation if they had a shred of ethics.

    That said, given the “Ima-vic-tiiiim” laws in this nation, I suspect that the airlines had its hands tied. Imagine if they’d told the fat guy to stand? OMG, the lawsuits.

    I know it’s heartless to say, but I‘m really getting tired of being put upon because I’m not a victim of something or other. Whether it’s taxes, or laws, or parking spaces or just simply because I was born able to work. I don’t mind being polite and considerate, but damned if I’m going to risk injury or death so some guy with no self control at the buffet can sit down.

      Amen GOJ I am sure some lawyers will be contacting the normal guy for a law suit. The days of norm is slowly slipping away from the American hands. What ever happened to working for a living, do your damn job right. Treat others as you want to be treated. Get up and do it all over again without complaining about it.       The article did mention that the flight attendants did say the ticket agent made a mistake not requiring this man to purchase two seats. As nice as the overweight person was he apparently did not offer to share the ordeal of standing in the aisle on occasion. He was the victim’s worst nightmare. I thought most of these aircraft have one or two excess folding jump seats for the crew. You would think that a crew member would have offered to let him use one for at least part of the time. I’m sure his presence was a nuisance when the service cart was dragged up and down the aisle.

      Weight and balance are a concern on some of the puddle jumper flights in the midwest, St. Louis to Peoria for example but an aircraft capable of non-stop flight from Anchorage, AK. to Philly. PA. would be big enough to overcome such a relatively small amount of weight.

      what a horrible person you are…..nobody could sit next to me when I used to fly a lot… even though my butt never spilled into their seat… my shoulders are so wide that there was nothing I could do to not invade the upper part of their space….but I suppose that is my fault… hell that is probably what makes me white, and a republican…according to your stupid ass, I should just run for congress!!! you cannot make a blanket statement like that… these friggen planes were designed back when the Average American MALE was 5′7 and weighed 155…..what do they do for people like me who scrapes the ceiling with my back when I get on the dad gummed thing?? first class isn’t that much better….
