Wounded Military Vet’s Guns Confiscated by D.C. Police — and He Can’t Seem to Get Them Back

Lieutenant Augustine Kim has an understandable desire to preserve his own safety since he was wounded on duty in the Afghanistan war. Moreover, the South Carolina native has always been an avid collector of guns but, when he was deployed overseas, wisely made the decision to move his gun collection from his otherwise vacant home in Charleston (where they could be stolen or otherwise inadvertently accessed) to his parents’ home in New Jersey.
Upon returning home from his tour of duty, Kim wanted to take the highly valuable collection (worth several thousand dollars) back home from New Jersey to South Carolina, and set out back home in his car with the weapons secured in accordance with every relevant federal law. However, on his way, he stopped at Washington, DC‘s Walter Reed Memorial Hospital for a doctor’s appointment. If he’d known what would follow, he probably would have rescheduled at a hospital in a different state.
What followed? Emily Miller at the Washington Times explains.
After his appointment, Kim set out back home. Unfortunately, he got lost on the way, and was pulled over by Washington, DC police, who accused him of driving with a suspended drivers’ license (this wasn’t actually the case — a clerical error was responsible for the mix-up). However, because of the nature of the offense, the police officer involved called for backup, told Kim he’d have to go to the police station to sort it out, and asked permission to search Kim’s vehicle. Kim, apparently unaware of the absurdly restrictive firearms laws in Washington, agreed, assuming that his painstaking attempts to transport the guns correctly would get them passed over in short order.
He was wrong.
Among the guns Kim was carrying was a Colt Carbine AR15 rifle – a weapon the District of Columbia considers to be an “assault weapon” and has banned.

Kim tried to explain that he was only trying to transport the weapon home to his home state of South Carolina, where possession of it is legal. However, the police told him that because he had stopped at Walter Reed, he was guilty of owning the gun at a place other than his home, and was thus in violation of DC law. He was arrested on four felony counts — charges that could conceivably have resulted in as much as 20 years in prison — and was allegedly mistreated during his time in DC jail.
Kim must have figured out he was dealing with an irrational legal system, because he engaged the services of Richard Gardiner, the very attorney who had represented Dick Heller, a firearms owner whose case — District of Columbia v. Heller — made it all the way to the Supreme Court and was the first case in which the Court began to hint that it would acknowledge a fundamental right to bear firearms. Gardiner negotiated the charges against Kim down to one misdemeanor charge, which was summarily dismissed in May 2011 after Kim kept out of legal trouble in the district for 9 months. The entire legal mess essentially went away.
However, for Kim, the story hasn’t ended yet. Why? Because the District of Columbia still hasn’t returned his guns. Rather, the DC legal system has hemmed and hawed and delayed in every way it can to avoid returning the firearms to their rightful owner, who has had all the charges against him dismissed.
“This is legalized theft,” Gardiner told the Times. “The charges were dropped, and they don’t give you your property back?”
Whether this is simply an epic case of bureaucratic oversight or an instance of willful refusal on the part of the district to do its job, the fact of the matter is that it is inexcusable and probably illegal. Hopefully, the public outcry about this incident will make the district take the hint.
And hopefully that will happen before Kim’s upcoming deployment to Kosovo.

Posted on May 15, 2012 at 5:08pmWow, I am kinda shocked at the hate for LEOs here. As an ex-cop myself I know for a fact that most officers are not like the people described above. I have stopped many people in my time and one of the first things I ask is if there are any weapons in the vehicle. If there are, I take possession until the traffic stop is finished, then I hand them back their weapon with a smile (and unloaded of course) and tell them to drive safely. I have never had a problem with anyone carrying a weapon legally. The officers I worked with are really big into 2nd Amendment Rights and would never conduct themselves the way the officer(s) in this article did.
But it is hard trying to keep your job and do that right thing. Sometimes you can’t. When I was working in a small town in Missouri, I was told not to ever stop anyone that was on the City Council, a family member of the City Council, or anyone belonging to the Elks Lodge (yes I’m serious). When the Chief told me this I was dumbfounded. He was scared of losing his job, and I certainly didn’t want to lose mine. But I told him that was unconstitutional and not fair to the other citizens. I was then told my services were no longer required.
I guess my point of all of this is that, there are some bad cops. But there are certainly a lot more cops that will put themselves in harms way both legally and physically for the general public than there are those who will not. Do not say we are all the same. See us individually.

Posted on May 15, 2012 at 5:27pmI once had a 1851 colt cap and ball pistol (replica) stolen from me and when it was recovered days later it was stolen again by the San Diego PD, Right out of the Property room. Someone likely thought it was a an original colt. That was the last I time ever trusted the police. and that was in 1978.

How were these police officers wrong? They arrested him for AN ILLEGAL ACT. However, because you don’t like the law, you believe the officers were wrong for enforcing it.
You say you never had any problems with people who were legally carrying guns. The problem is that under DC’s laws, this guys was not legally carrying this weapons. That is a big f—n difference.
So, it boils down that you were a bad police officer because you would only enforce the laws you thought were just.

Posted on May 15, 2012 at 5:58pmHADES, the authority you were loaned, including carrying your weapon, came from the citizens. That did not result you in having power over the citizen. You had no more rights or authority when you worked as a cop than any citizen has. Too many cops have either forgotten that, or were never taught that fact in their academy.
While it is legitimate and reasonable to want to know about weapons in a vehicle that you stopped, requiring the owner to retrieve that weapon and give it to you caused you and the occupants of the vehicle more risk. Once you know about the weapon and its location, it was more safe to leave it alone. You unloading the owner’s weapon, possibly a weapon you were not familiar with, compounded the danger to all involved.

See thats a large part of where the distrust comes from. From a human rights point of view you as a LEO have no greater right to be carrying a gun than we do. You say “of course unloaded” as if someone besides a cop cant be trusted to be handed a loaded gun.
Your other excuses dont cut it either. If your chief asks you to do something wrong or illegal you dont need to obey. But instead of standing proud you’ld rather preserve your job & abuse the public that is paying you. I’m not really picking on you, its an industry wide thing. Police bend the rules & look the other way to save their jobs every day. Yet they expect us to hold them up like they are doing us some super service by working as a LEO. Nobody said its easy, but if you are just going to follow orders regardless of the legal or moral implications then you really deserve no more praise than a sanitation worker because you are just putting in time to collect a check, a hero most LEO arent.

The only ones that dont are AK, VT, WY and maybe a couple more that no longer have any carry restrictions. If you need a permit to carry your rights are being violated & if LEO enforce those laws they are violating your civil rights.

The only time you’ll see a sympathetic story about cops is if a cop is killed on duty, and even then alot of posters celebrate. I remember when the female park ranger was murdered in Washington state a few months ago and the blaze put the story up, alot of posters were pretty happy about it.
As for this story, hope the guy gets his guns back. I wouldn‘t like being a cop in DC because of laws like that but I’m not going to fault them for enforcing the law where they work.

Posted on May 15, 2012 at 6:50pmDTOM_JERICHO (CREATOR VINDICATOR), I of course do know what has happened to you but one can only assume that you have done something to get arrested a number of times. Actually I hope that I am wrong. Apparently you may have run afoul of one or more of those cops like the one in Cincinnati that The Blaze ran a couple of stories on in the recent past. I hope they have found a way to get rid of that guy now. I am a former cop too, and I have to say that I have met a number of those types myself, but that is not typical for all cops. As far as the states starting police departments it is essentially blessed by the 10th Amendment.
Report Post »As for a standing Army and Navy which were activated by the U.S. Constitution established during the Revolutionary War It seems to have slipped the minds of writers of our current Constitution since the Army and Navy were still standing. This has been debated my centuries now and I believe should have been corrected with an Amendment rather than to just let it stand. Frankly, it is a good thing that the military remained when the British again attacked us in 1810. Anyway, back to the debate. Some defer to the fact that the current Constitution did not state that it superseded the war time Constitution. While others say that once ratified it did supersede the considered former Constitution. Tis a mind fick ain’t it?

Did you read the article? It said that the gun he was carrying is illegal in DC.

Guess what, if a law makes something illegal it is still the law. A court could later strikes it down or repeal the law but cops are still supposed to enforce it whether they agree with it or not. It is not a police officer’s job to decide which laws are constitutional and which laws should be enforced.

Posted on May 15, 2012 at 7:06pmThe police officer tried to say, that just because he stopped his vehicle and got out, it was the same as living in that state, and having that guns then was illegal. So, if you never stopped his car he would have been fine.
If a police officer asks you to allow them to search you vehicle, just say sorry, but no. I never trust the police, they are more trouble most the time then help. What they don’t know about you, won’t hurt you.
Hope this guy gets his guns back. They probably can’t find them. That cop probably took them home, and doesn’t want to give them back.

Those guns can’t be returned to him – they were delved out to his Captian and his squad members. The officers in D.C. probabnly have some of the finest collections in the country. I would love to take my 4 grandsons to see the Capital and the Smithsonian but they won’t recognize my Carry permit and if they did they would find some excuse to steal my gun. My 3 sons would like to take their families there on vacation but can’t for same reasons. Good thing I saw it 35 years ago!

Posted on May 15, 2012 at 7:47pmWhat are you talking about ? Bad cops ?? They enforced the law. The arresting cop doesn’t have much to do with it after the arrest is made – and the arrest was legally made.
What about states rights ? Assault weapons bans have never been found to be unconstitutional. The officers found illegal weapons and they enforced the law.
And it doesn’t matter that the man was a soldier. The same law applies whether the person is a completely legitimate person or a drug dealer.
Likewise, constitutional protections of search and seizure apply. Had the soldier been more alert, he should have refused consent for a search. A recent case before the D.C. District Court a person who was obviously a drug dealer got a free pass even after the police found a loaded gun and used shells in the car because the dealer asserted his rights and did not give consent to search.

It‘s up to EVERY officer to gain back the public’s trust rather than look the other way when one of your own takes a huge dump on an otherwise law abiding citizen. Do you watch the news? A week does not go by when we all see a report of police corruption or their complete disregard for 2nd amendment rights. Here in the People’s Socialist State of Kalifornia, if you are not a cop, you are one of the little people. The police are ignorant of the voluminous gun laws of this state. A common man cannot know the complexity of gun law in this state and it is left to lawyers to argue. In this state, they wait for you to step over the line. It is not a matter if you will step over, it is when. They can then not only seize you legally carried guns, but can then seize all guns in your home (they know exactly where all the guns are due to mandatory registration).
My ex neighbor reported that I had military style grenades (I had grenade crates that I use for storage). The police department then proceeded to check my gun registration records and noticed I owned several guns (most inherited rifles and shotguns). I received a visit from the SWAT team just before 5:00 am and all guns seized during the search for the non-existent grenades. I had to pay a fee to get all of my weapons back (almost $1700). Our LEO leadership in this state hates gun owners and they take every opportunity to express that hate.

The right to defend and preserve our own lives is implicit in the natural right to life. The Founding Fathers understood that and considered the Second Amendment a natural and inalienable right.

Posted on May 15, 2012 at 10:47pmWhere I live, they dont bother to ask because more than half of the population in my county has a PCC and the ones who dont can still legally carry a fully loaded gun in an unlocked glove compartment. Asking someone here if there is a firearem in the vehicle is like asking if they have a motor in the vehicle.
I am guessing half the people here would laugh at you if you asked for their gun for a traffic stop and a lawyer would file a suit against your department the next day for violation of your rights. Here’s a fact you seem to forget, most law abiding citizen legally carrying a gun will say yes they have a firearm in the vehicle and those are not the ones you need to fear! The ones who deny it and you walk away clueless are the ones who will use it on you!
So asking for and taking the gun of law abiding citizens for a traffic stop is not only dangerous as it could go off reaching for it while someone is already nervous for a traffic stop, it is plain stupid!

First off, it is a right that we have as human beings to provide our own safety and security. Personally, I’d have rather shot the pig and spent my life in prison than to have my rights violated by him. But I digress. Furthermore, it is a national LAW that you may transport a weapon through any state regardless of the “legality” of said firearm in the state through which you are passing. This law was passed through Congress and signed by the President some decades ago.
When will ignorant morons like yourself wake up and stop eating the crap cakes that the media is feeding you?

Posted on May 15, 2012 at 11:29pmYou are absolutely correct! Most officers are our best advocates in time of need. I also have a big question for the DCPD. While it is illegal to own some firearms in DC, this man is not a DC resident, & inner-state transportation laws between counties applies. Beyond that, he was provably transporting firearms between states, which requires federal firearms transportation laws to usurp every municipality between point A and point B. For those that do not understand this, imagine being pulled over in a town on your way to a place outside your state, and your insurance company does not do business in that state; this is common by the way. The individual cannot be convicted of having inappropriate or no insurance; they are neither a resident of that state or the municipality.
Not only did this fine young man NOT break the law, DCPD has now committed a federal crime by not returning his property. They have impaired his 2nd amendment rights grievously in the delay tactics alone. DCPD neither followed the letter nor the color of law.
Thank you for the time you devoted in protecting us citizenry. We can be a handful sometimes!

Posted on May 16, 2012 at 12:11amI am a former D.C. police officer. I only know what I’m reading here, but if this is the true story, it seems like the officers were fishing for something. I never had much time to mess with traffic, as I drove from one crime scene to another. When I did make a traffic stop, I never asked about weapons in the vehicle unless I had probable cause. I always looked around inside the vehicle, and asked the driver to put both hands on the steering wheel until I was sure it was reasonably safe. I never asked anyone to let me search their vehicle unless I had reasonable suspecion to believe they had something illegal. If the driver is placed under arrest, then a vehicle must be inventoried. On the other hand, there’s all kinds of officers out there…most are reasonable and professional. A few are not. People have a federal right to transport guns from one place of storage to another, and it seems that that officer was being a little too eager to make something out of it. I can’t believe the soldier appeared to be a threat to anyone, especially after he told them who he was. Common sense seemed to be short, here.

He’s not a resident of even that state (Maryland) but is a resident of South Carolina. He should fall under the laws of South Carolina unless he had it sitting on the seat beside him which could be intent to use.

If you stopped me and asked that entirely personal question and I replied that I was not carrying any illegal contraband and was in compliance with all State and Federal laws, would you just let it go? Would you pester me further? Would you make some excuse to detain me (the ol’ standard “I smelled alcohol/marijuana/etc”)? Would you call for back-up? Call the dog out and have its handler touch the MJ in his pocket then touch my vehicle so the dog “hits” on the trunk?
Why the “hate” for cops? I dunno, could it be that most of you are no longer peace officers and instead are Revenuers for the State? Collecting taxes in the way of speed traps and such? And when crime does strike, you’re too scared to act on it especially if the perp was a city councilman or family member or heaven forbid a member of a protected class (blacks, gays, etc)?
Tell me, did YOU have the integrity to resign when your chickensh*t boss told you to ignore crimes committed by the City Council? If not, you have NO RIGHT to ask why most ordinary folks hate cops. You just answered your own question.

Posted on May 16, 2012 at 8:20amHADES, from what I’ve seen, too many cops don’t appear to be trained in the technique of de-escalating a situation. Because of the perceived authority provided by the badge and gun they carry,many times will antagonize and bully a suspect and therefore create a much larger problem. The Kelly Thomas case in Fullertton! CA is a perfect example. I’m a 21+ years Army Veteran who was brought up to respect LEO’s. I have never been arrested or been in trouble with the law. In the military we were taught that when dealing with civilians in a combat zone you ALWAYS try to de escalate the situation and never provoke. I have to think that LEO’s are taught the same. Sit down and watch a couple of episodes of COPS. You’ll see example after example of cops pushing their weight around and antagonizing citizens.
You may be individuals, but when I look at you, I don’t see Jim, Fred or Susan, I see a cop.

In my 46 years I have never once had a cop help me. I even went so far as to gather all the evidence required, pictures, testimony and invoces of a guy who stole more than 2000 dollars from me BECAUSE the cops didn’t give a crap. Even after I did all the work, handed them the evidence and told them where the guy was right at that minute WITH the stolen property, they still didn’t give a crap and did nothing. The only other encounters with cops were a few 1 mph over speed limit speeding tickets at 4 am and the cop went ballistic on me because I had the “nerve” to ask him why he pulled me over. The problem as I see it is that they are forced by a system that isn‘t decent and good to do things that aren’t in any way to the benefit of the citizen or to society. The unbelievable mountain of ridiculous laws they are tasked with enforcing make it nearly impossible for them to do their jobs from the governments perspective without unduly burdening citizens. It’s a shame really. I remember when cops really were the “good guys”. I don‘t see it that way anymore and haven’t for a long, long time. To do a good job from the government point of view the individual cop must overburden the citizen or they will languish at the lowest ranks or be let go. Peace.

Then it becomes a chargeable offense. Common sense seems uncommonly absent in some jurisdictions [like NYC or DC]. I’m glad for your integrity you no longer work in the little town you referenced. And you don’t have to be worried about being called to federal court to explain unequal application of the law.

I agree there are Cops on the street that thinks their opinion and sense of total power trumps the laws there are sworn to uphold.
However it is my experience that this is not the norm among my local LEO.
(I have not had the courage to open carry in Minneapolis though.)Their Police seem to be totally indoctrinated in PC.
Maybe if D.C would allow lawfully licensed citizens to defend themselves by carrying a weapon, there would be a few less murders in our nation’s capitol.
I have had a Minnesota carry permit (Thank you Tim Pawlenty) for 6 years and have carried canceled almost every day.
I have been open carrying in my home state of for the last couple of months.
I am surprised at the lack of response from people I interact with and the businesses that I visit.

Just one more qustion ser ( do you have any guns with you ) I said Yes I think I do have a gun with me packed away under the seat, then the words came out ( You are under arest ) I had been hunting in December 6 months ago in AZ, and did not think about having a gun with me until they had asked about it, got arested and put in jail, my rig put into inpond, talk to police about the 2nd amendment rights, tell it to the court, about 6 or 8 hours later, I got to see the court first hand, my court appointed guy told me to keep quiet and he will get me out of this for $1000.00 dollars. I did at frist and then I could see where all this is going. My I say something your honor, I told the story everything and got releast to myself if I could send them a statment from my home town showing that I do have a home in Arizona. From a policeman just before we got on the way to jail, he told me the next time you are asked the ???? ( do you have a gun ) ( just say no ) . I had no idea about the trouble

I am a Marine and I have spent years of my life surrounded by teenage men carrying “assault weapons”, or as I refer to them properly, semi-automatic rifles and carbines. Never once in that time (even with some intense infighting between conflicting personalities) did I EVER see a weapon used in anger. The only crime that increases when guns are readily available is possibly suicide and that is even questionable because ever statistic I can find only compares the suicide by gun rates before and after, not all suicide rates to include overdose, hanging, blood letting, etc. The reality is that nearly every man and woman is smart enough to handle the responsibility of handling a weapon properly if they are given the least bit of training and supervision.
I really hope that someone strangles you with shoelaces so that one day we can all have velcro shoes and everyone will be finally safe from shoelace violence.

When you are state side and off the base you are a citizen of the Unites States and a civilian subject to the same laws as every other citizen. I am certainly not going to speak poorly of the young man serving in our military but neither am I going to speak poorly of our civilian law enforcement officers w/o much more information than is given here.
LEOs have to enforce all the laws under their jurisdiction or they should enforce none of them. There should be no picking a choosing. If we don’t like the laws then we vote for legislation and legislators that will change them.

Posted on May 15, 2012 at 4:29pmA friend who lived in Hyattsville, MD within a block of the DC border was an avid hunter. He left home one morning enroute to Ft Meade. Because of a Boy Scout jamboree in a city park he was forced to cross the district border and drive about one block inside the district. He had a Marlin 22 rifle in the gun rack. When he was stopped he was arrestred and the rifle confiscated as a machine gun because it held more than 9 rounds.
Thats how stupid the gun laws in DC are but they have so many shootings that even the cops used to stay out of certain parts o town after dark.
Oh, he never got his gun back and was out money for lawyer fees and bail money. He did eventually get his suburban back but it cost him a big hunk of change.
This is what Sweet Old Barack wants to do to all of us!!!

It is not their job to do so and it will be dismissed as hearsay if the judge or prosecuting attorney has anything to say about the matter. Furthermore, jurors are no longer free to interpret the meaning of a law, the intent of a person, or the criminality of his actions. They are picked to be mindless errand boys who follow the judge’s orders and are never allowed to exercise their rights. By all rights, the jury has more power than the judge in determining guilt or innocence and this was a power meant to keep the judiciary in check and give the Citizen real due process. With the death of real jury trials in America, so goes my faith in the entire system.

The officers are liable, In addition, he WAS in transit and just leaving the vehicle does not change that. You might need gas, food, a restroom break, etc. You MAY even need to stay somewhere over night. The cargo in the vehicle was still packed and transported legally. The fact that police THROUGHOUT the country continue to arrest people, and even get convictions on laws that have been found illegal or sometimes m don’t even exist, just drives me CRAZY with embarrassment for the law enforcement profession. One particular illegal activity is arresting someone who is taping police activity in a public place. THIS IS NOT ILLEGAL! Even the NRA and gun owners don’t get it anymore. The argument has been changed to, “you need to know the laws of wherever you go regarding guns”. No WE DON’T! The 2nd amendment GUARANTEES our right to carry in any state or city in the U.S. Any laws passed by a state or local municipality are in direct violation of the 2nd and 10th amendments. I hate that the NRA believes that any time a pro gun law is passed in a state, it is considered a win. WRONG! How is it a win, when laws are passed to overturn laws that are unconstitutional in the first place? Good Lord it just gives me a headache realizing that people who claim to be for the Constitution, don’t even get it.

That stuff is a myth, and I’ll have to say that what is happening in our country just shows that people are turning away from God more and more everyday. I’ll say this, nowhere in scripture does God say man is supposed to kill one another, commit adultery or hate one another. It’s not in there, though I do believe the 2nd ammendment to the fullest. Big Gov’t will have everyones weapons in due time. Obama said it himself and so I guess if anyone is gonna stand it should be sooner than the next election because there are alot of people all for him including my neighbors. Very scary, but all of this is prophecied as far as Globalization and a one world government. It’s coming fast so open your eyes, if they take the 2nd ammendment right from us they will have all sorts of ways to control the people because no one will be allowed to have any guns. Heck I‘m a one time felon for drinking and driving 4 times and so I can’t own a gun. Be thankful for that right because it can be gone in a second. P.S. I never killed anyone but thank God my eyes are open now and I am over 2yrs sober going on 3. God bless!!
