‘You Don’t Have Boobs’: Woman Says TSA Made Crude Comment to Her Son After Pat Down

Adrienne Durso of Carlsbad, California is suing the TSA for an overly invasive pat down. That pat down, she says, included a female agent groping her breasts and admitting to her son later that he wasn’t searched because “you don’t have boobs.”

Durso, who has had a mastectomy, says she was humiliated and told KOB-TV, “I felt as though I didn’t have any rights”:

She says she knew her rights had been violated so she asked to speak to a supervisor who she thought would help.

All the while her son stood by her side and couldn’t remain silent anymore

“My son, who I‘m very proud of spoke up and said ’I went through the metal detector and I did not get a pat-down‘ to which the supervisor said ’well you don‘t have boobs’,” she said.

That statement was the last straw for Durso – so she contacted the lawfirm of Drinker, Biddle and Reath. Her attorney, Alex Brodsky, says this whole ordeal violates her 4th Amendment rights which protects Americans from unreasonable search and seizure.

“We think that these searches given the invasiveness and given the extensiveness of these searches are really more akin to something like a strip search and certainly as a result we think we have a strong case,” said Brodsky.

Durso says she isn’t doing this for money or fame but rather for countless other Americans who take to the skies for travel.

    I just shipped a dog we had been watching back to a friend, you should have seen the stuff TSA had done to that poor dog. X-Ray machine, pat down, and body cavity search, and that was just what the ticket agent did, I can’t mention what the TSA agents did, x-rated.

    Using Justice Breyer’s reasoning, this is not unconstitutional, since there was no protection against unreasonable search and seizure in the Constitution, only in the Amendments added to make it possible to gain ratification.

      Using Justice Breyer’s reasoning, this is not unconstitutional to terminate unconstitutional justices since there was no protection against this prior to the Constitution. He should be forcibly removed from the S.C. IMMEADIATELY. The ONLY thing the S.C. gets to rule on, IMO, is whether or NOT the ‘new’ law conforms/adheres to THE CONSTITUTION,…… AS WRITTEN. PERIOD.

    The proper thing to do is rebel against the dimunition and destruction of your God-given Constitutional rights. Hit the airlines in the pocketbook and absolutely refuse to fly until they stop the unconscionable and un-Constituational violation of your rights.

    If I can’t get there by car, boat or train I’m not going and I vow not to go until such time as Constitutional protections are restored to their rightful place. Inconvenience yourself, go ahead; you‘ll survive and you’ll better about yourself for having done something other than being a passive victim and ignorant sheeple.

    My daughter is very beautiful. I just sent her a copy of this email and told her to get to the airport early. Why? After what has been happening I know they will send her through a scanner and/or pat her down. Sad, sad world the new administration has made for us. That a Mother has to warn her daughter that she will be personally violated by the government and to get ready for it.

      Did you hear about the model who was forced to go through a nude body scan and was not given the option to be groped? The TSA/KGB agents singled her out and afterwards were smirking and whispering to each other. I bet she is now on the TSA porn file.

      Please use the little freedom you have left wisely. Refuse the nude scan. Don’t fly if you can drive.

Start serving good food on flights no reason to blow up a plane with good service and food. We have so many socialist in government lets start offering flights to Cuba we will not miss them.

    They are trying to goad us into reacting with violence. This woman was perfectly justified in both her outrage and her response, i.e. to engage the services of a lawyer. Fight them with logic, reason and the law. Not anger, violence or stooping to their level. We can and will prevail, if we don’t allow them to use their “top down, bottom up, inside out” tactics against us.

      Unfortunately the Courts, all the way to the Supreme Court, has proven time and time again that they are currently unable to protect the people has it their charge. Since FDR the courts have shift from being the last line of defense of individual liberty to the front lines of government power grabs. From the Expansion of the Commerce Clause starting in 1945 with Filburn, to the most recent abolishment of all property rights in Kelo the courts have a long long history of standing up for the government at the expense of the individual

      The problem is that in many mid-size to Large cities, the police have gotten a good handle on REAL crime, so in order to justify the continued expansion of the force and the purchase of ever more military style toys they have to find the criminal in all of us.       I disagree with the idea of the ever expandig police force in cities becoming more oppressive, I live in a medium city and work in a large city, and no one bothers me, I do believe that the police has to go more high tech because they can’t conduct traditional police work with their hands tied behind their backs by the ACLU, and let’s not spill this discussions in local municipalities, these TSA agents are federal agents, if they expand to train stations and bus stations, this would be a de facto introduction of federal forces on our streets, with unlimited search powers

      I have to agree this is part of a bigger plan to push our buttons. Women with curves tend to get selected for x-ray inspection that is one of the reasons we made our radiation absorbing privacy garments. I will say however that when our dollars will no longer be the world currency and our oil prices go through the roof to $6-8 per gal, the stores will have limited foods that will cost more than most can afford and the people who have never been without start rioting, then that’s another story all together.       By refusing to fly we are making an impact. Continental and United are now charging a fee to hold the price of the seat you book if you want to book in advance and it is non refundable. Pretty soon, we are going to have to pay to get on the website just to look at the seats to begin the booking process. It only starts with a little nudge….

      There is more to this “screening” than meets the eye. People are told to take a “stance”. Feet are positioned and then hands are held up…it is not just a check for what you may be carrying on board when you go through the body screeners. They are doing these screeners at bus stations and railroad stations…so to the guy who said he isn’t going to fly…guess what..they’ll get you somewhere else. It would seem that by positioning someone in the required “stance” (feet on foot pads) it would create a standardized profile of a body image which then can provide all sorts of data with respect to relationships of size etc. They play down how much the machine captures…but please note this article about what THESE new machines capture. Then image a machine that will capture the entire body image of every single american that is then stored in a central data bank that can then be pulled up and compared to scans of crowds or people gathered together in a house in order to identify those individuals at any given time.

      I disagree. We as Americans under the Bill of Rights – Fourth Amendment do not have to put up with forced molestation and in some cases rape. This invasive search is not for security purposes it is to demoralize each and every person who boards a commercial aircraft. It is making forced immorality acceptable and that is wrong.

      I’m also a mastectomy/breast cancer survivor. I was wondering what they would do about the prosthetic. Is it possible all the rumors about Islamic women having implants of explosives was started by the LEFT, just for such an occasion? This government has made us all into conspiracy theorists because of their outrageous behavior. I know if I ever have occasion to fly (which would take an emergency at this point) and they ask me to go to a private room to show them my prosthetic, I will decline. I’ll warn everyone in a loud voice that they want to see my prosthetic, and then whip it out right there. This has gone way too far.

      I think you choose the wrong phrase when you say GET USED TO IT.
      I shall never get used to my Constitutional rights being violated. I have an abslute, essential, natural right not to have the privacy of my person or my property invaded without probable cause. This is nothing but a search without a warrant and without even reasonable grounds to suspect. (As you can, perhaps, tell I don’t like STOP and FRISK, either.)
      There has never been and there will never be a terrorist caught before boarding a plane because of any sort of pre-boarding search of either the individual or of his baggage. This is simply a training method by Homeland Security to get the American people used to and thus reliant upon the “Federal Government keeping us safe.”
      Like Ben Franklin said: Those who would sacrifice a little freedom for security deserve neither freedom nor security.
