‘You Fu** With Me!’: Cop Threatens to Kill Concealed Carry Gun Owner During Traffic Stop

A police officer’s dash cam in Canton, OH caught a disturbing exchange last month between a cop and a driver during a traffic stop. In it, the cop can be heard (and seen) berating a man for not telling the officer immediately that he had a concealed carry permit and thus a concealed weapon, even saying at one point he should have killed the gun owner. But there’s just one problem: the man tried several times but the officer cut him off.
That is a problem. In Ohio (as in many states), the law requires concealed carry gun owners to immediately inform law enforcement if they have a weapon when they are pulled over. So when the man, named William, was not allowed to do so immediately, and the cop eventually found out, that created an issue.
“I could blast you in the mouth right now!” the officer says in the video after finding out about the man’s gun. “I’m so close to caving in your Godda**ed head,” he adds. “You fu** with me! You’re just a stupid human being!”
He continues: “Fu**ing talking to me with a Godd***ed gun! You want me to pull mine and stick it to your head? … I tell you what I should have done. As soon as I saw your gun I should have taken two steps back, pulled my Glock 40 and put ten bullets in your ass and let you drop.”
“And I wouldn’t have lost any sleep!” he screams.
The officer can also be heard threatening to “put lumps” on a woman also involved in the traffic stop.
William, luckily, didn’t get his mouth blasted or his head caved in. But now, he is being charged with failure to notify — even though he tried.
Ohioans For Concealed Carry (OFCC) obtained the video and explains what happened on June 8, 2011:
Early that Wednesday morning, William pulled his car to the side of the road to let out two passengers, but only the female occupant managed to exit before the police pulled up and began screaming at all three parties. “Stay in that car, I’m not going to mess around,” screamed one of the officers at the two people attempting to exit the vehicle. The driver and concealed handgun licensee, William, remained seated in his vehicle when an officer entered the rear of the vehicle.
William stated, “I have a concealed carry, and…” when he was abruptly told to shut up. Dash camera video footage shows the driver turning his head, and his voice can be heard, but the words are inaudible. A few minutes passed while the officer continued to berate the two passengers. He proceeded to the driver’s side and tries to open the door but is delayed by a seat belt. William states “I have a conceal…” and the officer demands that he better tell the truth or else! This interruption causes William to “tell the truth” and his attempt to notify is interrupted. William exited the vehicle with his driver’s license in the same hand as his concealed handgun license. He held it up for the officer to see, and the officer said, “Why are you having that?” This gave William the opportunity to say, “I have a CCW, and…” The officer then said, “Do you have a gun?” William answered yes, causing the officer to grab it from William’s waist.
At this point, William was handcuffed and put into the police cruiser. The officer then started to berate William, stating: “I [could] blast you in the mouth right now … I’m close to caving in your head.“ and ”you’re just a stupid human being!”

OFCC says the local police are investigating the issue and the officer’s conduct.
Police officers do have the right to take their own security seriously. But as Ed Morrissey over at Hot Air explains, this seems different:
In this case, though, a fair viewing of the videotape shows that the driver did attempt to notify the officers on more than one occasion before stepping out of the car, and tried to do so when the officer approached his window several minutes into the stop. He may not have done it very well, but it certainly doesn’t appear that the driver intended to keep the information from the police. The officer told him repeatedly to keep his mouth shut while they checked out the other two people involved in the stop. Threatening death and/or a beating to a man who tried repeatedly and finally succeeded in fulfilling his legal obligation to inform them is irrational and should be illegal.
OFCC is now trying to raise funds for Williams defense.

Posted on July 21, 2011 at 1:23pmIf the video shows the driver trying to tell the officer that he has a CCW, then the officer should be fired for unprofessional conduct. If the driver did not then he should be charged. Either way I think the officer overreacted when he started with the “blast you in the mouth,“ and ”pull mine and stick it to your head,” I am sure that some lawdogs will now attack me and tell me how stressful the job is. First, I have the utmost respect for law enforcement officers, when they act professionally. When they act like this, thats another thing. I dont think that the “I’ll blow your brains out,” attitude is the right character for the job. When I have been pulled over by law enforcement, I have had nothing but good experiences, even when they give me a ticket. And yes I carry.

The officer was so far out of line that he SHOULD be tried for making terroristic threats-seriously. He literally broke the law. Cop built and escalated the problem. If the citizen had defended himself at that point,,,he would have been vindicated (I don’t support that anyone should do that, however)

Unfortunately, after watching this my level of trust for law enforcement has lowered just a bit. First of all, it is not the officer’s job to be judge, jury, and executioner. I believe the guy did try and inform the officer that he had a permit to carry, but the officer was so set on calling the guy a liar and not believing him that it became the MOST important step in the process while he should have been securing the vehicle and driver. HE, not the driver, put his life in harm. The officer should be fired and should have to apologize to the driver.

Posted on July 21, 2011 at 2:04pmI have personal experience with the lawyer who released this, as I live in Ohio and am on many CCW boards and have been following this long before it was posted on the Blaze. The video referenced exists, and shows what is described. The transcript is accurate. I was wondering how long it would be before the story was released to the general public.
There are still a few cops here who feel like God Almighty and despise the fact that we can conceal (and open) carry in this state. Most are more subtle than this jerk.
The cop needs not only fired (or better, forced to resign so the police union can’t get him his job back), but to have charges pressed against him and have his ability to carry a deadly weapon revoked permanently. He is mentally unstable and unfit to roam civilized society in his current condition. His partner who allowed this to happen also needs fired (or forced to resign).
There is no room in America for rogue cops and their contemptuous disdain for law abiding citizens peacefully exercising their God given rights. These cops need an example made out of them in no unclear way, in the harshest of “maximum penalty under law” possible.

Posted on July 21, 2011 at 2:06pmBy the way, this is a problem with the “Notification” laws in Ohio. Corrupt cops do this kind of thing, although a bit less severely, in order to nail CCW carriers. CCW carriers are, as a group, far more law abiding and upstanding than even most cops, for the record. We strongly need to do away with the crap “Notification” law and have it replaced by “Notification if requested” as many other states have. Cops have abused this too long.

I do believe, however, that many police agencies are seriously forgetting their communication skills when dealing with the public. I have observed on NUMEROUS occasions where the police act as tho every citizen is a potential enemy. I disagree with that outlook. He should be fired immediately and the departments legal team might want to figure out a way to defend a lawsuit against the police department. Even had he not on numerous occasions tried to inform of the gun the officer was unprofessional and threatening to the woman and the man with the gun. He obviously can‘t handle the stress of the job and shouldn’t be allowed to carry a gun himself.

The first words to the driver should have been “License and Registration please” not “open up that door”.
He had an attitude on from the moment he got out of the vehicle and engaged the female.
An officer needs to have his head in the game for EVERY traffic stop and needs to follow proper procedures to ensure their safety as well as ours.
Add to this his conduct after the fact….he needs to be reprimanded, suspended and then sent back for some proper training on how to handle a traffic stop.

He immediately told the officer that he was carrying a concealed weapon and that he had a permit on him that allowed him to. The inexperienced police officer stepped back, took his gun out and pointed it at him for no reason at all. He had not even checked my son’s driving record which was good. The very fact that my son had a gun on him, for some strange reason caused this rookie cop to fear for his life. I chalk it up to poor training and/or incompetence.

If they had a reason to search, shouldn’t they have first apprehended the occupants and made sure they had nothing that could hurt them, then search the car. That’s the first thing you always see in the police dash cam videos: Officer approaches car ready to draw if they need to, have occupant step out of the car and ask them “do you have any weapons or anything that can hurt or poke me?”. Looks like lazy cops that realized their mistakes a little too late and took it out on the occupants.

Threatening the female, then threatening the driver over and over–up to and including that every time he sees him on the road in the future, he’s going to tow him and take him to jail. What?? I understand FULLY where officers come from–but I too have been fortunate enough to most of the time have nothing but professionalism. I have only had one bad experience recently—and it wasn’t me that was pulled over. I was in my sister-in-law’s vehicle, she didn’t pay attention to the speed limit sign and was going 8 mph over. When the cop pulled over, he was almost as crazy as this one. My 2 year old niece was in the back and sobbing uncontrollably because this strange man was yelling so loudly at her mommy. His exact words…..”What the HELL are you doing driving this fast through MY roads?” My sister in law is cooperative, and says she didn’t realize she was going that fast, apologizes. He continues “What were you THINKING???? Do you know if you were going just 3 more miles more over the speed limit, I could take you to jail and there’s not a damn thing you could do about it? You’d have a FELONY on your record!” He did this for a straight ten minutes and every thing he said he yelled and he put his head IN the window and got in her face several times. If they are not thinking they are a danger to themselves and others. This officer is clearly not thinking or listening. He appears to be right on the edge of making a big mistake. The officer appears to be over his head in his job or in some kind of upset emotional state. I wonder if the driver kept his hands on the steering wheel until the officer talked to him but I did not hear the officer tell him to do so or make an issue of that. The officer needs to be fired.

Although I do believe the officer did in fact do just that. This video should go viral and show normal people just how much of a first class punk this officer is being.I would be embarrassed to have this officer for a beat partner or in my agency. There is ZERO need to blatantly over react in this manner with a licensed concealed carry member of the public. They are on OUR side, dumb ass! Sounds like this officer was playing, “Now,I’ve got YOU,you SOB!” to retaliate for a previous bad experience, spat with the wife/girlfriend/boyfriend/Sgt. There is simply no excuse for this kind of reaction. He needs some days off with no pay. Hope this comes back to haunt him later on, methinks it will.

I am no officer and am only a school teacher and stay at home mom, but the cop should have talked to the driver first. He put his own life in danger. When the officer tells the gentleman to step out of the car, the gentleman is holding his CCP in his hand. I’d also like to know why the officer took the man out of camera view to frisk him while his partner remained??? I‘m just glad I don’t live in that town with tools like that for police officers! Being an officer of the law doesn’t give you license to commit murder. Initiating lethal force in an otherwise calm scenario is not within the bounds of what an officer is allowed to do.

Twice I have been stopped and asked if I had any weapons in the car, and twice my answer has been yes. One one occasion it was 4 am and I was coming back from a 900 mile drive. I had a shotgun and handgun in the car, told the officer I had them and he said ok. Thats it. OK. End of story. The other time the officer asked me if they were loaded, I told him they were not, and he asked if I was sure, I said yes and he left it at that. Thats how you handle that situation. Not be threatening to shoot someone. Threatening to shoot someone and give the woman ‘lumps’ is probably going to have these individuals FEARING the police if they are ever stopped again. The cop in this video shouldnt be a cop, thats just a bad way to handle any situation. I mean, who the hell goes off saying he should have put 10 rounds in someone… even if the driver was in the wrong here (which I dont feel he was) its the wrong way to handle the situation. The guy shouldnt have a badge.

There was no arrest at the point they were searching so search incident is out the window. Did they not ask him for permission before they searched? Did Ofc Mark talk to the driver off camera and get his permission before he conducted the search? If Ofc Mark did speak to the driver did the driver have an opportunity to tell him he was CC. Several things are not quite right here, I hope that the PD does an honest IAI. I can tell you one thing though. That primary officer would not make it in a real city where there is no “responsibility to notify”. If that little presentation made him almost go postal imagine what he would do if he was patting someone down search incident to arrest and found a gun. He needs to go on the Charlie Sheen hospital for anger management.

This video should become THE all-time police training video for other officers to watch.
The lesson to be learned is that when you’re talking too much, you’re not listening.
Another lesson is that sowing fear does not gain control – it destabilizes the situation.
This officer was lucky he wasn‘t dealing with an unstable perp because the officer was obviously distracted by something else that wasn’t happening in this arrest. He needed to stay focused on the situation in front of him but he showed up already pissed off.
The officer is lucky that no one died. I’m not gonna jump on the bandwagon of saying he should be fired, but clearly he was in the wrong here and needs mental help and anger management training.
He’s clearly confused. He thinks that intimidating others is the same thing as being in control. It clearly was not. He was operating out of fear, not out of being in control… and that confusion could have gotten someone killed including him.

To be heard the “perp” would have had to shout to the cop – thus escalating the situation. Then the report would have stated “the perp began shouting maniacally at me and I feared for my life…” He announced the best he could. Then he should have shut up and let the cop bury himself. I would have calmly pointed out (from that totally innocent position) that the cop’s attitude is what gets them shot – not “un-announced” CCW’s. ( In Michigan its a “CPL”. CCW is the charge for not having a permit.) I would hope this cop loses his job, he’s not stable enough to perform in a stressful job such as that. Criminal charges against him would be a wet dream.

Those are the old rules. Now police departments are being *aggressively* sued by various local 2A groups, and losing in case after case. Better, they’re forced to pay the court fees of the 2A/victim’s under Ohio law. ORC 9.68 has been a savior for gun rights in Ohio. This clown and his department have already offered to settle and walk away as long as the guy doesn’t file charges. The lawyer and his client turned down the offer and, with the help of some 2A groups I belong to, are going to sue the living crap out of these bozos. But once in a while, you come across these power-drunk little jerks who take pleasure in roughing people up and showing everyone around who’s boss. This little creep in uniform was probably bullied mercilessly in junior high and now wants to take revenge on the rest of the world.
He should be fired and put up on charges.
Yes, the driver of the car was – admittedly – not the sharpest tool in the drawer. And he could have been quicker to yell out that he had a CWP. But, given the situation, he seemed to be very passive and was perhaps too timid. No, he wasn’t perfect. Nor did he deserve to be roughed up and sent to jail for it.
The important thing here is that the officer escalated the situation needlessly from the first minute of the tape. It’s as if he was buzzing from steroid use and just looking for trouble. We don’t want to have cops like this out there. In fact, cops like this are not only a danger to themselves, but to everyone around them. These sorts of interactions actually encourage some to hate the police. No, fire him and charge him.
Guaranteed that if the driver of the car was black, that would have happened already.

Posted on July 21, 2011 at 3:13pmIt appeared to me that several laws had been broken and not by the citizens. It isn’t up to a policeman to judge anyones lifestyle unless they are breaking the law. A car pulled to the side of the road letting passengers out is hardly grounds for a traffic stop. Secondly, I noticed the car was searched without permission or a warrant, and then the man was arrested and who knows what he went through because this cop was angry at the prostitute. He obviously was going to make this guy pay, even though no laws had been broken, just to prove some point. Now just imagine all the hassles with courts, attorneys, bail, getting his weapons permit back, plus the mental anguish, this guy will go through, while the cop at most will receive paid administrative leave. He definitely is administering his own justice and probably laughing about it. Cops like this give the rest a very bad name.

I see this all to often with todays younger officers. After watching the fits over collecting bargaining I just can’t support them anymore. I recently asked a retired officer of 20 years if he deserves a pension and benefits much higher than the private sector employee. His answer was of course I could have been shot. I then Informed him I have a nephew third tour Afghanastan special forces who gets shot at every day. Before I could continue this guy went nuts. Kinda like a good little liberal.

Just last weekend he spoke to me about his growing alarm over the excessive use of SWAT. When he was on the force, SWAT was used for terrorist and hostage situations…PERIOD. You now have almost every force from the smallest towns to metropolitan areas using SWAT for situations that should be routine and would only require two uniformed officers. He has trained countless forces domestically and around the world in CQB, including FBI’s Hostage Rescue Team. He pointed out that several years back, it was noted that not ONCE has the HRT rescued a hostage, or been sent to a hostage situation and in order to save their jobs, they began offering to serve warrants for ANY federal crime. If this trend continues we will find ourselves in a gestapo state.

It’s just one more incident indicating the police forces around the country are so underworked they have to create crime in order to justify their positions. They need a cut-back in personnel, so they’re forced to concentrate on real crime and not frivolous pursuits.
Also, this Gestapo is over reacting. He’s an abuse-freak that’s into intimidation and control. He’s blown the entire situation way out of proportion. There was NEVER a point where he wasn’t in a position to shoot the guy if he pulled a gun. He’s supposed to conduct these stops assuming the occupants are armed. Also he and his partner are supposed to position themselves so any possible perps can’t get the drop on them.
It is the non-concealed carriers who pose a threat during a traffic stop, but even they rarely open fire. If they do, they’re certainly not legally armed with a license. During a survey a couple of years ago, it was revealed that the jobs that were the most dangerous were convenience store clerk, cab driver, etc. Law enforcement was down the list a bit.
This screwball is a mental case that’s obviously scared out of his skin in addition to being an abuser and control freak. He’s yelling and acting tough to give himself false courage.

No he said, people like me are their least problem. we have been vetted by our neighors, and friends, the FBI has run a background check, and the local judge has reviewed all the information. and approved it. We are least likely to be the one when stopped apt to be a problem. And i agree, but if that cop is a loose cannon he should be reviewed, and removed quickly.

There is no excuse for acting like that when someone is trying to be cooperative. This should be grounds for an immediate firing on the part of this Gestapo. And I do not say that light heartedly, I have much respect and understanding for officers and their job but that is exactly how this officer acted.
Is it a tough job? It sure is and you are under much stress and constant scrutiny, but this kind of behavior is unacceptable.

However, I don’t believe it should be a requirement to reveal his weapon unless he is being arrested. The officer should assume everyone that he stops has a weapon. We all have the right to protect ourselves, not just concealed carry license holders. In my state you don’t need a license to have a gun in your car.

Ohio just passed two more CCW laws that permit a carrier to enter liquor establishments, but not consume. Also, to straighten out how to carry in your car. People who were ticketed for how they carried in their car can go back and get the ticket removed from their record.

If you are required to notify the officer if your carrying legally, why don’t they just ask when taking the drivers license and registration? The ask before they pat you down if you have anything that could cause them injury. Just saying. Also, why wasn’t dispatch on the ball notifying the officer that the guy was a legal CCW? I would think this information would be tied to the cars plate (if he’s the owner). Officer would have known before he even approached the car.

However, it’s been pounded in my head that you never draw your weapon unless you feel like your life is threatened. If I, as a CCW holder were to act this way if someone cut me off in traffic, got my fast food order wrong, etc., I would probably be arrested and/or sued. Shouldn’t our police officers be held to the same or even higher standard?

CCWs are tied to name/identity, as are license plates. Run the plate, the registered name pops up with the attached CCW notification. Same with DL#, or even just full name.

Not only was the officer unprofessional, he violated the procedures for a stop that are there for his protection as well as the public’s safety. He endangered himself, his partner, and the stop‘s subjects and the general public’s safety. This out-of-control “public servant” also committed multiple felonies.
This should be included in police academy training films as a prime example of what you DON‘T do and the attitude you DON’T have when conducting a stop & question. This sort of behavior reinforces the “cops are enemies” attitude among citizens and may indirectly cost another cops’ life and the lives of innocent civilians.
I showed this video to my nephew, an army vet and retired police detective with 24 yrs. He was extremely angry with this “officer’s” conduct and unprofessional behavior. His comment? “That’s the kind of stupid cop that get themselves, their partners, and innocent people killed. If a cop I’d rode with had behaved in that manner, I’d have pulled on him myself, disarmed and cuffed his a$$, and locked him up and charged him with multiple felon

They did not ask permission to search the car, nor from what I saw, had probable cause. They did not even do the search correctly. You don’t search with someone still in the car. If anyone is a dummy, idiot, numbskull, it’s these two cops. I know they face danger everyday, it’s their job, but that doesn’t mean they have to make life miserable for everyone else. I do not want these so-called police officers to go to some other city and be hired in the same capacity… They are a clear and present danger to citizens with or without CCW permits… They need a serious lesson which only time behind bars will give them.
This was not a traffic stop… It was in fact a clear violation of the most important Constitution rights of these citizens… Illegal search, illegal seizure, not to mention unwarranted threats of great bodily harm and even death.
It starts off poorly by the police, who obviously had little to do except terrorize people they felt were inferior…
Advice to the policeman Mark, “the male passenger’s name is not “Hoss,“ it is ”Sir” until he tells you his correct name.
This would have had a completely different outcome in Texas believe me… And probably with other Americans, who like Texans do not take kindly to being pushed around by heavy-handed police who probably should never have been hired to act in the capacity to as a police officer.

The question here is whether failing to notify allows an officer to threaten you with pulling his gun and sticking it to your head, blasting you in the mouth, caving your head in, or putting the lumps to a woman.
This officer overreacted. Be it failure to train, failing to STFU and let a person talk, or failure to take anger management.
I would first demand an explaination from the officer with a mandatory urine test to see if this officer perhaps suffers roid rage. After that investigation, officer should be suspended without pay or fired.

I would have done anything in my power to get this guy fired ASAP. Take out the gun completely, and you still have total disrespect and verbal abuse of the citizens. Jerks like this will forever overshadow those who try their best to do the impossible job of policeing in this country in a professional manner. Fire this @$$hole now!

Posted on July 21, 2011 at 4:29pmI agree; my 2nd CHL instructor was a police officer, and he warned us about COPS like this. The officer was TOTALLY wrong and should be fired immediately for ‘conduct unbecoming’; deriliction of duty and abuse of a citizen.
Join IDPA or IPSC and you’ll be 10 times better than 95% of law officers. They are all betting they will get thru their careers and never have to pull, let alone use their weapon.

Posted on July 21, 2011 at 2:20pmSure you can do that. I routinely open carry in Ohio (I live in Delaware county, just north of Columbus). The only encounters I’ve had because of it, civilian or cop, have been friendly and were pleasant exchanges. And I don’t carry a small pocket gun either when I open carry, I carry a full sized 1991A1 Series 80 .45 (yes, I said 1991A1, not 1911A1).
In fact, in about two weeks there a huge open carry even up on Powell, the park in the middle of the city. It’s yearly and most folks there open carry and the cops do nothing but smile, wave and talk to us about the food or exchange words on what kind of guns we’re carrying and how they shoot.

Posted on July 21, 2011 at 3:34pmWe don’t have “a state wide open carry law”. What we have is absence of law, and Article 1 Section 4 of the Ohio constitution. ORC 9.68 removes local pre-emption, which was the big impediment to open carry (and concealed carry actually).
Cleveland is a cess poll. They just lost a big gun case recently regarding local pre-emption and guns and are now feeling some financial burden for covering the expenses of the victim(s). :) Your folks will come around, even if we have to drag them kicking and screaming to it (which we’re doing).
Get outside of Cleveland and OC is not a huge deal, properly conducted.

Ohio is a traditional open carry state. Recently, the Ohio legislature passed HB-12 over Governor Taft’s veto, thus preempting all local open carry bans even in Ohio’s “home rule” localities.
HB-12 is the case law and pecedent, hence common law.
If you open carry in Cleveland, you’re taking your chances of being stopped by the cops, because they simply don’t care.

I’ve heard some friends say that they were even told “We don’t worry about you folks at all” in regards to CCW. The only places with an attitude these days are Cleveland, Toledo and Cincinnati, and by that I don’t mean every cop, just rogue buttheads like in this video.

Like anyone that works well under pressure, officers need to be smart, cool and level headed… A rare thing among today’s police force. Even Dirty Harry didn’t scream like a girl when he was mad; he just stayed cool and got the job done.

Why is this bullying attitude rampant amongst nearly every department?
This is systemic, and coming from the top.
They are being TRAINED to openly violate our rights. They are HANDPICKING the most bullying brutal psychopaths and promoting them.
They know that the overwhleming majority of the public are decent folks, and are not going to be violent and resist them. They take that for granted when violating our rights first, knowing that there isn’t a great deal we can do to stop them from their abuse right on the spot. They know that we the public must legally allow them to violate our rights and then try to seek justice in a corrupt court of law after the fact.
They don’t even want to be videotaped, so they can violate with total indiscretion and abandonment.
They don’t even want a burden of proof or probable cause. They want to do what they want, when they want, and YOUS JUST SHUTS UP AND TAKE DAT, YOU PATHETIC HUMAN!
