YouTube Prankster Talks About 2-Month Jail Sentence: Scary to Know People Think ‘You’re a Sick Person’

21-year-old Michigan man Evan Emory did something for a few giggles. But because it was a vulgar something that involved kids, he’s now been sentenced to two months in jail, two years probation, 200 hours of community service, mandatory counseling, and fines and costs. What did he do? He made a fake video that made it look like he was singing a very inappropriate song to some young school children.
It’s a sentence that has sparked a lot of controversy. Some say its ridiculous he‘s getting jail time for an event that didn’t even occur. Others say he’s getting off too easy. Amid the arguments and the impending jail time, Emory says the idea of the nation thinking he’s a “sick person” is the scariest thing. He sat down with FOX 17 and apologized before going to jail:
“I was really afraid of being on the sex offender list, but from the letters I was receiving from people I was more afraid of getting raped in prison because I know they don’t treat sex offenders too kindly in prison,” Emory told Fox 17.
He won’t be going to prison, but rather county jail. He can also leave during the day for work. And he won’t be put on the sex offender list.
Still, “There are people out there who think of me as some child molester and so that’s terrifying,” he said.
Mediaite explains exactly what Emory did — details that have caused much disagreement:
21-year-old Evan Emory of Michigan has been sentenced to two months jail time after filming and posting a video featuring him singing a sexually explicit song to elementary school students. The only thing is, Emory never did that. He actually sang an appropriate (and apparently well-received) song to the kids and edited in the other song (which the kids never heard) later for a comedy video.
Hyper Vocal adds more:
“The footage of the children was recorded in January when Emory performed a clean song for the class. It was only later that Emory returned to the empty classroom to record a vulgar song, which he edited with clips of the children and posted to YouTube in mid-February.
On Tuesday, Judge William C. Marietti of the Muskegon County 14th Circuit Court sentenced Emory under a previously arranged plea deal to 60 days in jail, two years probation, 200 hours of community service, mandatory counseling and fines and costs. And when he emerges from jail, Emory can’t be within 500 feet of children under the age of 17. All for a comedy attempt gone awry.”

It was the prosecutor’s discretion to prosecute this bogus case, and the judge’s responsibility to sentence. First of all, the prosecutor should have refused to prosecute the case, second, the case should have been thrown out of court when it got to the judge’s bench. What a couple of totalitarian, elitist, crooks!

Michigan is a hopeless, backward, state that should probably be used as a national landfill. It appears there‘s more concern with fattening Union leeches than protecting people’s civil rights in that state.

What this young man did, was not even original, similar skits have been done before by the likes of David Letterman, The Whitest Kids You Know, Conan O’Brian, etc. So movie actors/actresses who portray criminal acts in film can be prosecuted for those crimes (that never actually occurred) in Michigan? Yet another reason why no one should live in that landfill of a state.
What in the h e l l is this country coming to, when in Vermont actual pedophiles get less severe sentences? Wow, Michigan, perhaps instead of making out with the Unions, you ought to reform your legal system.
That is a miscarriage of justice.

Almost every comedy released in the past few years has worse content and is actually exposing children to vulgarity or allowing the children, themselves, to be the vulgar ones.

There is nothing illegal or wrong about the video OTHER THAN possibly showing faces of children without the parents consent.

Posted on April 15, 2011 at 11:53amI agree, but something must be done about the sick jokes that are made to just shock. we r becoming desenstized as a class of people to sexualizing our children and vulgarity and disrespect of anything but for self is becoming the norm and something “funny” I am raising a 17 month old and I am scared to death of the things my innocent little sweet angel is going to be exposed to on MTV Teen Mom, jersey shore, etc.
This is wrong unfortunately, it used to be “enough” that we had social mores and we knew if we did something ridiculously against the unwritten standards of our society that we would be ostracized from our immediate circle of influence. However, that circle has become the world with the INternet and it’s making this behavior well simply a shrug of the shoulder and forget it. . Now, this is acceptable behavior even on a conservative/libertarian website the blaze the people thinking his punishment wrong is in the monority. Personally, I hope his sentence sends a message to people that this is not acceptable behavior. Our children deseve a chance at innocense.
I watched the movie BIG the other night..made in the 80‘s and Josh’s (Tom Hanks) character was 13 years old. He still played like a kid. If that movie was made today his character would have to be 8 or younger to be beleivable. It’s sad. Today, 13 YO movies are about boys and makeup, mean girls, conniving manipulative, should I have sex trash heaps on the bottom of a trash bin.
The real question should be “why have our social mores become so perverted that our society should give this guy a pass and just arrest someone on the border?” Once we get our social mores back in check many many things will right themselves. It starts at home.

He played a crackhead that comes in to lecture middle school kids about drug use. In the uncut version I saw, his character used plenty of offensive language about things he would do for drugs. Better send the Thought Police to his house!
