Zimmerman Has First Court Appearance, Will Remain in Jail for Now

SANFORD, Fla. (The Blaze/AP) — Neighborhood watch volunteer George Zimmerman made his first court appearance Thursday on a second-degree murder charge in the shooting death of Trayvon Martin, as a court document provided new details on the prosecution’s case.
During the brief appearance, Zimmerman stood up straight, looked straight ahead and wore a gray prison jumpsuit. He spoke only to answer “Yes, sir,” twice after he was asked basic questions about the charge against him and his attorney.
His hair was shaved down to stubble and he had a thin goatee, which appeared consistent with his booking photo from the day before. He had resurfaced Wednesday to turn himself in after weeks in hiding.
Judge Mark E. Herr said he found probable cause to move ahead with the case and that an arraignment would be held on May 29 before another judge.
The affidavit of probable cause prepared by prosecutors shed some light on why they chose to charge Zimmerman. The Orlando Sentinel said it had obtained a copy before it was expected to be filed with the courthouse.
The newspaper says that Martin‘s mother identified screams heard in the background of a 911 call as her son’s. There had been some question as to whether Martin or Zimmerman was the one calling for help.
Prosecutors also interviewed a friend of Martin’s who was talking to him just before the shooting. The affidavit says Martin told the witness he was being followed and was scared.

Martin tried to run home, the affidavit says, but was followed by Zimmerman: “Zimmerman got out of his vehicle and followed Martin.”
The affidavit says that “Zimmerman disregarded the police dispatcher” who told him to stop, and “continued to follow Martin who was trying to return to his home.”
Speaking to reporters after the hearing, attorney Mark O’Mara said he was concerned that the case up to now has been handled in the public eye, with details coming out in piecemeal fashion.
“It’s really supposed to happen in the courtroom,” O’Mara said, deflecting questions about evidence in the case and his client’s mental state.
ABC News reported O‘Mara said after the hearing he had decided not to ask for bail and suggested it was at least in part out of concern for Zimmerman’s safety.
“I hope to have him released on bond and by that time have a safe place for him,” O’Mara said, adding that could take “several weeks.”
Speaking earlier Thursday on NBC’s “Today” show, O’Mara said Zimmerman is stressed and very tired and hoping to get bail.
Meanwhile, Martin’s raised eyebrows with comments on “Today” about the accidental nature of the case, but she clarified what she meant in another interview later in the day. Sybrina Fulton told The Associated Press that she was referring to the chance encounter between Zimmerman and her son.
“Their meeting was the accident,” Fulton said. “That was the accident. Not the actual act of him shooting him. That was murder … They were never supposed to meet.”
Zimmerman was charged after a public campaign to make an arrest in the Feb. 26 shooting, which has galvanized the nation for weeks. Some legal experts had expected Zimmerman to face a lesser count of manslaughter and say a prosecutor will face steep hurdles to win a murder conviction.
The prosecutor and her team will have to prove that the 28-year-old Zimmerman intentionally went after Martin instead of shooting him in self-defense, to refute arguments that a Florida law empowered him to use deadly force.
Legal experts said Corey chose a tough route with the murder charge, which could send Zimmerman to prison for life if he’s convicted, over manslaughter, which usually carries 15-year prison terms and covers reckless or negligent killings.
The prosecutors must prove Zimmerman’s shooting of Martin was rooted in hatred or ill will and counter his claims that he shot Martin to protect himself while patrolling his gated community in the Orlando suburb of Sanford. Zimmerman’s lawyers would only have to prove by a preponderance of evidence – a relatively low legal standard – that he acted in self-defense at a pretrial hearing to prevent the case from going to trial.
There’s a “high likelihood it could be dismissed by the judge even before the jury gets to hear the case,” Florida defense attorney Richard Hornsby said.
Corey announced the charges Wednesday after an extraordinary 45-day campaign for Zimmerman’s arrest, led by Martin’s parents and civil rights activists, including the Rev. Al Sharpton and the Rev. Jesse Jackson. Protesters wore hooded sweatshirts like the one Martin had on the night of the shooting. The debate reached all the way to the White House, where President Barack Obama observed last month: “If I had a son, he’d look like Trayvon.”
Corey would not discuss how she reconciled conflicting accounts of the shooting by Zimmerman, witnesses and phone recordings that indicated Martin thought Zimmerman was following him.
“We do not prosecute by public pressure or by petition. We prosecute based on the facts on any given case as well as the laws of the state of Florida,” Corey said Wednesday. She was also present at Thursday’s hearing.
Martin’s parents expressed relief over the decision to prosecute the person who shot their son.
“The question I would really like to ask him is, if he could look into Trayvon’s eyes and see how innocent he was, would he have then pulled the trigger? Or would he have just let him go on home?” said his father, Tracy Martin.
Many attorneys said they had expected the prosecutor to opt for the lesser charge of manslaughter. The most severe homicide charge, first-degree murder, is subject to the death penalty in Florida and requires premeditation – something all sides agreed was not present in this case.
“I predicted manslaughter, so I’m a little surprised,” said Michael Seigel, a former federal prosecutor who now teaches law at the University of Florida. “But she has more facts than I do.”
O’Mara, Zimmerman’s attorney, said his client would plead not guilty and invoke Florida’s so-called “stand your ground” law, which gives people wide latitude to use deadly force rather than retreat during a fight.
The confrontation took place in a gated community where Martin was staying with his father and his father’s fiancée. Martin was walking back in the rain from a convenience store when Zimmerman spotted him and called 911. He followed the teenager despite being told not to by a police dispatcher and the two got into a struggle.
Zimmerman told police Martin punched him in the nose, knocking him down, and then began banging the volunteer’s head on the sidewalk. Zimmerman said he shot Martin in fear for his life. Sanford police took Zimmerman, whose father is white and whose mother is Hispanic, into custody the night of the shooting but released him without charging him.

Your son was SUPPOSED to just case the street and get home quickly, but like so many idiots, he was talking on a cell phone instead of doing what he was supposed to. He lost focus, and that eventually got him killed.
Imagine who might have died when Trayvon or one of his buddies came back in a few days for the second half of the job? Perhaps an innocent home owner?

If you look at the cop standing next to him, there appears to be no difference in complexion between the two and it looks to me as if the cop is an Afro American. Thus the question, why have we been only presented with that one picture of Zimmerman since the incident, the one where he looks white? Conspiracy in the media ignited by the Party on the left? You bet!

That’s right call me a hateaphobe but I have a free speech right to point it out. It’s either that or only BET is allowed to show the video which shows beyond a shadow of a doubt that this miscreant half-breed is guilty. Since Obama is half Caucasian (doesn’t that mean he is part oriental does it? Caucasian) and many hate filled folks voted for him I must conclude that the reason for their sentiment towards this guy must be his Latino half. (or is it he 1/3 Latino, I must admit I am not up on parsing people along racial divides)
Here I thought we were past racism, how naïve of me. The trial will be interesting. I want to see how all 500 eyewitnesses have the same exact story.

Hmmm…I’m wondering if Eric Holders office has informed Corey of just what the facts are? Maybe something along the lines of “This guy has to be found guilty and sentenced, otherwise the president would stand to loose a majority of the black vote in November.”?
BTW: I can‘t remember the last time the DOJ got involved and conducted it’s own investigation in something like this.

Zimmerman defended himself with a weapon in self defense and fear for his own life. As a grown man over six feet tall was beating him in a rage.
The DOJ will not have an easy time convicting Zimmerman. They may get him on a harrassment conviction as he did apparently overly exercise his community watch duties.

That is a non sequitur, specifically, denying the antecedent. The apparent absence of blood on Zimmerman’s clothes does not mean that he was not bleeding.

No blood (or at least a minimum of blood) and no displacement in the break…..even a doctor would need an x-ray to confirm the presence of a break! Without the x-ray…..there is no break! The presence of pain, or sensitivity to touch does not even confirm that George was not malingering the symptoms.

The police and the medical examiner have all that information in their report. All of your opinions and the doctored tapes by NBC aren’t what prosecutors will look at to get their evidence. Even the pictures ABC, CBS, NBC and CNN have been showing of Treyvon are from when he was 12 and younger. Now look at this picture of Zimmerman in court and tell us how he is a white man, as the news is referring to him. Nothing we’ve seen on television has been accurate. It’s all been hyped, starting with the man in the Oval Office. The Black Panther Party is going to do what now? Kill Zimmerman while the cameras are rolling and the President and Holder watch and applaud??? You would think so by the way they have been behaving. Eric Holder is on tape praising Al Sharpton for his race baiting. Where is this all going to end? It’s like the inmates are running the asylum.

Kobe went on to finish the game and had no idea it was broken until after when they examined it. I believe I would catch up on medical facts and actually know the science before you open your mouth again. You are doing yourself a disservice.

“Bryant was bloodied by a hard foul from Miami’s Dwyane Wade and stayed in the game, but he left to be evaluated afterward. A CT scan revealed a broken nose.”
Notice how Bryant was bloodied AND they needed a CT Scan to reveal the broken nose….those were my exact points. Thanks for helping prove my point!

I, for one, think we should wait for all the evidence before declaring him guilty. The real tragedy here is that a young man is dead and cannot be brought back to life. I have sorry for his family and friends. Some of that may change as the evidence comes out.
As for the 2 race pimps, Jackson & Sharpton, don’t they ever get tired of stirring up the hornets nest. These two should be jailed for trying to instigate race riots. I was raised to treat everyone the same, regardless of race, or color and I aim to continue that course.

Posted on April 12, 2012 at 4:08pmI’ve not chosen sides at all. One thing that bothers me most about this case relates to the “friend” he was talking to. She says Martin was “scared” and that he was “running”…accepted. Based on the map, the location of the shooting and where GZ’s vehicle was located upon sighting, TM did not “run” anywhere. If he was scared, he could have been at his doorstep in less than 30 seconds, but the shooting appeared to be at or near where TM was first sighted. Based on the map, it is very likely where he would have “stopped” pursuing when the dispatcher said he did not need to follow. The incident happened a full 6 minutes after the first call to 911. In light of everything else, I’d like more info on that and where the gun shot wound is located. This all that matters really.
Depending on that information, I don’t think this looks good at all for the prosecution or anyone claiming GZ chased him down and shot him. If the facts come out in GZ’s favor, the prosecution stands to face a lawsuit for wrongful incarceration.

I believe jail is the safest place for him right now. I’m thinking about sending him a few bucks to help give him a safe place to stay if he bails out. He must be relieved a little. The New Black Panther‘s hate group can’t get to him now. I trust the jailers to keep him safe.

The hilarious part is these people don’t even realize they have no chance – in the grand scheme of things – to succeed. Losers are lazy, unmotivated, worthless – not a particularly lethal combination in terms of a winning battle strategy.
It never ends up being much of a fight between people that care for absolutely nothing and those that care about everything.

It was hard to see his eyes while he was bashing his skull into the ground. This is going to be thrown out if half of what I heard about his case is true. The prosecuter knows it. He should have been released on bail. The man turned himself in and has done nothing but cooperate with the police. Then, he should sue Sharpton, and Jackson for slander. Finally, the dispatcher never told him to stop following Treyvon. He said “we don’t need you to do that.” Plus, alot of dispatchers aren‘t cops and aren’t qualified to give anyone legal advise. Zimmerman claims when the dispatcher said this, he stopped and was returning to his car. The media reports this crap as fact.

The same goes with our elections. I don’t know if he is innocent or guilty but in America, it is INNOCENT until PROVEN GUILTY, not the other way around.

You know the data is there, and if he was going back toward his car, he should be released, charges dropped, and at least 10 hours of air given on BET, VH1, CNN, etc so all the blacks in the nation are forced to at least see the truth.

This guy’s best hope is a hung jury. After 2 hung juries the prosecution may drop it. Then he gets to go into hiding for the rest of his life.

No proof at all…just the word of two people with an interest in seeing Zimmerman found guilty. Unlike the eyewitness who saw Martin beating Zimmerman‘s head into the ground which corroborates Zimmerman’s account…just the word of people with an interest in seeing Zimmerman found guilty. Nice huh?
