  • They need to get a lawyer. I would bet University Interscholastic League (UIL) is funded by tax dollars
    which means it’s conduct equals “government action” and thus, the First
    Amendment limitations apply against these religious restriction rules.

    ‘(ii) shall include a provision requiring a record of transaction of any transfer that occurred between an unlicensed transferor and unlicensed transferee accordance with paragraph (1).’.

    ‘(D) a temporary transfer of possession without transfer of title made in connection with lawful hunting or sporting purposes if the transfer occurs–
    ‘(i) at a shooting range located in or on premises owned or occupied by a duly incorporated organization organized for conservation purposes or to foster proficiency in firearms and the firearm is, at all times, kept within the premises of the shooting range;
    ‘(ii) at a target firearm shooting competition under the auspices of or approved by a State agency or nonprofit organization and the firearm is, at all times, kept within the premises of the shooting competition; and
    ‘(iii) while hunting or trapping, if–
    ‘(I) the activity is legal in all places where the unlicensed transferee possesses the firearm;
    ‘(II) the temporary transfer of possession occurs during the designated hunting season; and
    ‘(III) the unlicensed transferee holds any required license or permit.

    You are going to need legal advice just to comply with this Law if you want to loan a gun to a friend. If you do not fall within these specific requirements, you can NOT loan a gun to someone (other than immediate family) because that is considered a “transfer.”

    Additionally, Section 203 deals with requirements to report “stolen” guns including reporting it to the “US Attorney General and local law enforcement within 24 hours of discovery” of the theft or face criminal charges. Yes, report the theft to the US Attorney

  • Here is the Fix Gun Check Act of 2013 (universal background checks) and it has a lot more than just background checks for private to private sales. This is the Bill Harry Reid thinks will pass through the Senate and will be voted on April 8, 2013.

    First, this act uses the wording “transfer” and that you have to do a background check if you “transfer” a firearm, but then defines transfer as…

    Section 202:
    (3) For purposes of this subsection, the term ‘transfer’–
    ‘(A) shall include a sale, gift, loan, return from pawn or consignment, or other disposition; and
    ‘(B) shall not include temporary possession of the firearm for purposes of examination or evaluation by a prospective transferee while in the presence of the prospective transferee.

    That’s right, no more “loaning” your gun to a friend just to go shooting, because that is a transfer unless you can meet ALL of these very specific and detailed conditions…

    ‘(2) Paragraph (1) shall not apply to (paragraph 1 is what requires a background check if a firearm is transferred)–
    (C) a temporary transfer of possession that occurs between an unlicensed transferor (meaning your are not an FFL dealer) and an unlicensed transferee, if –
    ‘(i) the temporary transfer of possession occurs in the home or curtilage of the unlicensed transferor; and
    ‘(ii) the firearm is not removed from that home or curtilage during the temporary transfer; and
    ‘(iii) the transfer has a duration of less than 7 day
