    I. Historical Evolution of the NICS
    A. The Gun Control Act of 1968
    The Gun Control Act of 1968 (GCA), which established categories of persons who are prohibited from receiving a firearm, was enacted by Congress as part of an effort to control gun violence in the United States. As amended, the GCA prohibits the transfer of a firearm to any of the following:
    1. Persons who are convicted of a crime punishable by imprisonment for a term exceeding one year, even if the person received a shorter sentence.
    2. Persons who are fugitives from justice.
    3. Persons who are unlawful users of and/or addicted to any controlled substance.
    4. Persons who are adjudicated mental defective or involuntarily committed to a mental institution.
    5. Persons who are aliens illegally/unlawfully in the United States and nonimmigrant aliens (with certain limited exceptions).
    6. Persons who have been dishonorably discharged from the United States Armed Forces.
    7. Persons who have renounced their United States citizenship.
    8. Persons who are the subject of certain protection orders.
    9. Persons who have been convicted of a misdemeanor crime of domestic violence.
    10. Persons who are under indictment (information) for a crime punishable by imprisonment for a term exceeding one year.

  • I have been saying this for awhile now. With him and the arrogance of the left they have managed to push people to the limit. When it becomes commonplace for the media to callously speak of killing political opponents and also publish names and addresses of those they don’t agree with it worrisome. They constantly ridicule and look down on our thoughts as if we should have no say in policy. Now, while the gov’t is purchasing billions of bullets, they want to take away our rights to own guns many, many popular guns. Guns that would be effective weapons for our defense or defense of the country against tyrannical dictators. This country will not be united for a very, very long time, if ever.

  • I wouldn’t argue with it. But then again, I like ice cream. However, as a general rule I wouldn’t use 7-8 year old’s opinions on regulatory policy concerning the 2nd amendment to the Constitution. I also wouldn’t use children as a prop like previous tyrannical dictators. This guy is just pathetic and the left cover for him on everything. Don’t talk about his kids. All the while he’s using someone else’s.
    This country is on a VERY slippery slope with the way the left is vilifying the right, joking of killing/arresting political opponents, exposing our families and property to danger all with the cover of a very powerful propaganda machine. Anyone with any historical knowledge has seen this before and knows how steep the slope gets once disarmed.

  • It is exactly this type of thing that worries me with what the gov’t has enacted in the NDAA. Yes, he lost it. Yes, he should’ve known better than to post it on the internet. Yes, he should’ve chosen his words better. But, with the indefinite detention clause, things like these can get you locked up with no lawyer and deemed a terrorist. With the warrantless wire tapping they can listen and read what you say without permission. IT IS the elites that make the rules and IT IS the elites that garner our anger. All they have to do is label you. Both acts violate constitutional writings

  • Yep, it’s jacked up. The mental health issue is a big deal concerning these shootings. And I agree, they will narrow it down to the point that any medication that can be construed as problematic will bar an individual from owning guns. There are safeguards in place for mental health in NICS but you can’t stop someone from stealing a gun. They are essentially accusing everyone of being a mass murderer unless you can prove otherwise. That’s impossible to do until you die without having committed murder. You can’t predict what a sane person will do or what a person with mental issues will do. Congress can’t see the future of people or determine their intentions. The focus should be on education concerning bullying, gun safety and the desensitizing of our kids to murder via movies and games. No amount of laws will prevent someone from committing a crime. It will prevent a law abiding citizen, but by definition, criminals break laws. Obviously they don’t care. My advice to the king and his court jester is to work on the desensitizing of our youth to killing, go after the gang bangers and their guns and leave law abiding citizen’s rights alone.
