    The district court erred in denying the applicant’s motion for summary
    judgment on the Second Amendment claim because San Diego County’s “good cause” permitting requirement impermissibly infringes on the Second Amendment right to bear arms in lawful self-defense.
    REVERSED and REMANDED.

    Even if this makes it to the supreme court on appeal, and I do not think it will, a citizen has the right to keep and bear arms. To out law open carry of unloaded firearms as California has done, and to restrict the ability to obtain a concealed carry permit for lawful reasons is a clear violation of the second amendment. The local controls cannot enact policy that eliminates all possible avenues for safely, lawfully carrying a firearm on one’s person in the public space. The application process already includes training, psychological exams and background checks. It was the need to show the local sheriff or police chief that you had actual “cause” in the form of police reports, etc. “proving” you were in some sort of danger (applying after the fact) that was struck down. This will stand up to the supremes. It is a great day for lawful citizens like myself who must live in California.

    Being from California, I am not surprized by this decision. When Brown made open carry illegal, we the people did not complain as much because we knew this day would come. You see the liberals made an error. They thought they could take away all of our rights to bear arms for self defense. Open carry of an unloaded firearm was all we had for the longest time and we used to have open carry get togethers where we openly carried. This scared the liberals and they passed legislation forbidding it. By doing so they removed all avenues for a free and fair means to bear arms in the state. Therefore, concealed carry permits as they stood were challenged in court for their wording “for what reason” you need or want to carry a firearm, and they rejected self defense as a legitimate cause.

    The elected a statist (communist) to the senate and continue to support and push the Obama (statist, communist) agenda. The Constitution state is just another failed liberal welfare state with high taxes and more regulations that grow like weeds. Connecticut’s conservative roots have been drowned in the cesspool of liberalism (no thanks to its proximity to the madness that is NY).

    California would first make all firearms illegal and confiscate ammunition before admitting that any terrorist acts could possibly occur in their state. It has to be the fault of the guns. Thus the stepped up confiscations we see in progress in California. California will burn the US constitution before it detains or questions anyone with brown skin or fitting the profile of illegal alien or middle eastern terrorist. The state will be attacked because it is the softest of soft targets.

    This is exactly why the progressives enacted the seventeenth amendment. By allowing for the popular vote (democracy as it is defined) to determine who shall represent the states in the Senate, rather than the state legislatures, morons like these are able to inevitably destroy the country and hand it over to the ruling elites. Since the Executive branch and one half of the congress is elected by popular vote, true checks and balances by the states is lost to wandering pedestrian human waste. Progressives knew this and were forward thinking in this regard. Thus, the representative republic is no more and what we have is a socialist democracy, one step from socialist dictatorship.

    Whats the difference between the several Free and Separate States picking and choosing the federal laws they enforce vs the federal government picking and choosing what federal statutes they enforce (for instance Colorado’s blatant violation of the controlled substance act of 1970). Examples of this have been around for ever. Many cities offer up “sanctuary” to illegal aliens knowing full well that it violates federal law. This is nothing new.

    Since the late 50′s, Americans began to embrace as idols the figures brought to them through the eye of the new media television. John F. Kennedy, a democrat, was elected president, much like Obama, and was idolized because of his massive media appeal. This loss of faith in God and turning away from religion, helped to strengthen the progressive movement and its foothold in American life despite strong anti-communist sentiment. By slowly chipping away at the spiritual foundations of our nation we find what we have today, a Godless society that worships government and idolizes the rich and famous leftist statist elitists to whom we give power and control over us today.
