Ok, by that logic they also don’t make other same sex wedding cakes. So, therefore, it would not be discrimination to refuse to start doing so? You just proved my original point. Thank you.

You just proved my legal premise. They asked for a wedding cake, not a gay cake. Same sex weddings are not protected under the law. I guarantee you that if they came in there and asked for a birthday cake he would have made one for them. So, to prove discrimination based solely on the fact that they were a gay male couple will be difficult to prosecute at best. I will give you a good example…Let’s say the baker is white and the customer is black. The black customer wants the baker to bake a cake with the image of someone glorifying or smoking pot and the baker refused, would that be racial discrimination? No, because he refused based on his beliefs that smoking pot is wrong even though it’s legal, not because the customer was black.

I don’t know…do they? I’m pretty sure they do, but that is not the point I was making that you are responding to. My point was to not make cakes for same sex unions regardless of the couples sexual orientation as the legal way of not having to make the cake for two men(or two women for that matter) that wanted to get married. Since homosexuality or heterosexuality is not a legal requirement for civil unions then the baker can decline simply on the basis of not wanting to bake a cake with two men on top of it. Same sex civil unions are not a protected class under the law, period. They are legally same sex civil unions, not homosexual civil unions.

Well then, there is a really simple fix for that in the baker’s case. All he has to do is testify that he declines baking cakes for any same sex couples regardless of sexual orientation. Homosexuality is not a legal prerequisite for same sex unions.

Regardless of the dictionary definition of discrimination, in the eyes of the law discrimination is treating similar things dissimilar. In other words if he did it for one gay couple but not another gay couple that would be discrimination. Since he has refused all gay couples service that would not be discrimination. That being said, the owners should prevail. However, with the population being mostly low information sheeple, unfortunately a jury will probably rule against them.
