  As a Federal Firearms Dealer, I can say this is a very serious matter. Anyone who completes and signs a BATF form 4473 (5300.9) with the intention of providing the firearm to someone else is committing a straw purchase. By definition, Mark Kelly has committed a federal crime punishable by 10 years in federal prison and a $250,000 fine. The dealer was correct to cancel the transaction when they became aware of the crime. In addition the dealer is obligated to make the Department of Justice’s Bureau of Tobacco, Firearms and Explosive aware of this infraction.

  The current back ground check performed on new gun sales records everything about the gun and its owner on the BATF Form 4473. A universal background check will collect this information on all gun transactions. At present only the detailed information about the gun buyer is provided to the BATFE during a new gun sale. Add a simple BATFE policy letter sent to the dealers requiring they provide the model and serial number of the guns sold and you have gun registration. The progressive agenda is to collect this information on all guns and gun owners. They are only one step from having this information at their fingertips. That step is UNIVERSAL BACKGORUND CHECKS.
