Continue Part 5… Final So this Holmes should have at the very least been held for evaluation and possibly get the help he needed. So I know this was long, but the problem with what is being proposed by some politicians will not only do nothing to stop the cases that supposedly triggered this outcry, nor will it stop the thousands upon thousands of daily shootings in places like Chicago, LA, Baltimore, DC, etc, but it will also be unconstitutional. And in closing since the Constitution is the law of the land and we are supposed to be a nation of laws not men…we must follow it.

So instead of going all UNCONSTITUTIONAL why don’t we go address the underlining cause or symptom that was in the recent cases. Mental Illness and irresponsible gun ownership. If Adam Lanza’s mom had properly secured the weapons so that he could not get access even if she was not there, then he would not have gotten access to the guns. The laws on the books right now stopped him from buying guns, so that worked. He could have kept trying and found an illegal way of getting them from say a criminal, but there lies the point…illegal from criminal…breaking from my argument of responsible law-abiding citizens. The other recent case involving shooting of firefighters answering a fire call, well the shooter was a CON and should not have had weapons. So once again he did so illegally. The guy in the Theater in Aurora, CO. He was mentally unstable and due to HIPAA laws and Doctor Patient confidentiality the doctor is limited in what he can provide about his patient. Dr. Fenton did fail to “use responsible care” when she rejected a law enforcement offer to “involuntarily confine Homes for 72 hours after he told her six weeks before the shooting that he fantasized about killing “a lot of people”, as reported in the 1/15/2013 Huffington Post article by Keith Coffman. Going back to the Heller case the term “regulated” means “disciplined or trained”…Would you not agree then that members of our Armed Forces in general are “disciplined or trained”?
Also in the Heller case decision it was stated, “Nowhere else in the Constitution does a “right” attributed to “the people” refer to anything other than an individual right. What is more, in all six other provisions of the Constitution that mention “the people,” the term unambiguously refers to all members of the political community, not an unspecified subset. This contrasts markedly with the phrase “the militia” in the prefatory clause. As we will describe below, the “militia” in colonial America consisted of a subset of “the people”— those who were male, able bodied, and within a certain age range. Reading the Second Amendment as protecting only the right to “keep and bear Arms” in an organized militia therefore fits poorly with the operative clause’s description of the holder of that right as “the people””-Justice Scalia. GUN DEBATE: Please read, discuss, share. Here’s my take :
Ok here it goes. I’m sure you can agree that the SCOTUS has ruled recently in 2008 and 2010 (DC-vs-Heller and McDonald-vs-Chicago), that it is an “individual right to possess and carry firearms” and specifically in the Heller case that this right is “unconnected to service in a militia”. In the McDonald case the court ruled that both the state AND FEDERAL level of government are limited by the 2nd Amendment. That sets the distinction. The “well regulated militia” is I contend the Armed Forces (Army, Navy, Air Force, Marines, NG, etc). The Armed Services are very regulated. They are regulated as to what they can and can’t do on the battlefield, during war and peace, rank structure, traditions, etc. The regulations also limit the ways the Armed Services can be used in the United States or more directly “against” the “We The People” of the United States. This is to protect radical governments from using the military against us like say oh China, Iran, North Korea, Russia, Cuba, etc. So as I read it the 2nd Amendment states clearly that the militia should be well regulated and SEPARATELY ensures that the right to bear arms of the individual “WE THE PEOPLE” shall not be infringed on law abiding citizens by ANY government that would do so for political ease or gain, thus leaving “WE THE PEOPLE” unable to provide f

Correct it is a states issue, but to the person who replied before me stating the government doesn’t have any right to get involved in personal relationships…well you are correct and since Marriage is a historically and traditionally a religious event, it is up to the church to decide and thus a church should be free without persecution to openly observe their religion. Government is involved because WE THE PEOPLE have said this is what we believe, through votes, on what they want to accept. Even California, one of the most liberal states, voted against it. If you choose the gay lifestyle/relationship and are happy…I’m happy for you…doesn’t mean I have to accept it as a marriage because God (in most religions) says it is wrong.
