‘There Is the Law, and There Is Reality’: Blaze Readers Weigh in on Decorated Vet Arrested After ‘Rudely Displaying’ His Rifle
April 22, 2013 at 8:27pm
@ rangerskippy
“When the police show up because they were called, they have the legal right to question people. If the people being questioned give them reason to be alarmed, they can disarm you for you safety, their own safety, and for the safety of the public at large.”
.Well that may be your opinion however that is not the law or in line with the decisions the us supreme court have handed down. the ONLY legal thing an officer can do in the situation you describe-MWAG call where no crime is being committed- is LOOK to see if a crime is being committed he may even strike up a consensual conversation, assuming the person chooses to converse with the officer. however doing anything more absent a crime to investigate is a civil rights violation specifically a violation of the 4th amendment.
.Also as I pointed out before in order to get to the point of disarming a citizen an officer must FIRST have a crime to investigate to even make contact, and further the person must be both armed AND PRESENTLY DANGEROUS. note that a holstered or slung weapon is not a valid reason according to the courts.
.I open carry often as I live in a state that protects the right and I have had some contact with law enforcement while OC and none of them have ever reached this level of criminal misconduct on the part of the officer.
.It’s great you have an opinion but it would really be great if you knew what you were talking about first.

I love the people in the article who responded with the attitude of “you should have just did what the officer wanted, they are nice people, just trying to do their job etc”….NONE OF THIS MATTERS.
Officers are not above the law, they are sworn to uphold the law and the constitution, qualified immunity only goes so far.
You do not just give in to the officer when he is wrong because it re-enforces bad and illegal behavior, the police are NOT your friends. Do not relinquish your rights like sheeple. they are public servants there to perform a public duty. if you did not request their help or you are not breaking any laws you should have ZERO contact.
The law is very clear and it appears that Texas may in fact have some laws on the books that are illegal and need to be challenged-
1.stop and ID as well as weapons check is illegal as per the US supreme court. see also- Deberry V US-the carry of a firearm where lawful to do so cannot be used as grounds for a lawful terry stop
2.terry stop-Terry V Ohio Us supreme court 1968-absent reasonable articulable suspicion of a crime. an officer MAY NOT-detain, demand identification, seize property or even do a weapons check, disarming the citizen may only be done if the person is presently armed AND DANGEROUS (being armed alone is not justification)
the best responses -
Why am I being detained?
What crime are you investigating?
Am I free to leave?
I do not consent to any searches or seizures of my person or property
‘I’m Furious’: Gabrielle Giffords Lambastes Senators Who Voted Against New Gun Control Laws in Fiery Op-Ed
April 19, 2013 at 4:25am
Listen you socialist maxist loving nutjob Giffords, I am the NRA, the people of the USA are the NRA, if amercian citizens are now a “special interest group” like those who care about the constitution then count me in. your brush with a liberal gun toting mad man is NOT more important than the constitution, the dead children of newtown which you have exploited are NOT more important than the constitution, and the lives our nations young men and women have sacrificed willingly to protect those freedoms are not sacrifices made in vain.
US civil war-~625,000
world war 1-116,516
World war II-405,399
Korean war-36,516
Obviously there is a long list of smaller wars/larger conflicts from the revolutionary war to Iraq/Afghanistan…however the end total in the last 237 years is 1,326,612 AMERICAN LIVES given to protect our constitution that you so eagerly want to throw away.
“The liberties of our country, the freedoms of our civil Constitution are worth defending at all hazards; it is our duty to defend them against all attacks. We have received them as a fair inheritance from our worthy ancestors. They purchased them for us with toil and danger and expense of treasure and blood. It will bring a mark of everlasting infamy on the present generation – enlightened as it is – if we should suffer them to be wrested from us by violence without a struggle, or to be cheated out of them by the artifices of designing men.”

April 19, 2013 at 4:07am
An overwhelming anti-gun control response is what the senators heard at these anti-gun, anti-second
ammendmant voices are going to get quite a surprise when the NO vote translates into a GOP takeover like it did in 94′
What You Need to Know About Filming, Photographing Police in Public
April 19, 2013 at 4:02am
The ACLU need to update their guidelines to reflect on the more recent federal case of Glick V commonwealth-
which states in part-”The First Amendment issue here is, as the parties frame
it, fairly narrow: is there a constitutionally protected right to
videotape police carrying out their duties in public? Basic First
Amendment principles, along with case law from this and other
circuits, answer that question unambiguously in the affirmative.”
Reid Shelves Gun Control Bill…For Now
April 19, 2013 at 3:42am
“We’re going to come back to this bill,” Reid said.
Don’t worry harry we will be here to stop you again. the constitution is non-negotiable. I see 2 US senators getting their NRA ratings lowered.
N.Y.’s Mandatory ‘Assault Weapon’ Registration, Magazine Limit Begins Today (But Is There Hope for a Stay?)
April 15, 2013 at 8:57am
“We are lawful and legal citizens of New York state and we always obey the law,” association President Tom King said. “It’s as simple as that.”
Hey Tom news flash for ya, when a law is unconstitutional it has no weight of law and you have no obligation to follow it. the last thing i would do is comply with something like this. mass non-compliance is the best first step.

Do You Know the Problem With This Piece of Russian Propaganda?
March 8, 2013 at 9:25pm
The problem with comnparing WWII tanks is that the roles are very different. today we all have main battle tanks (MBTs) but back then they had light tanks, infantry support tanks, tank destroyers, etc.. while the T34/85 was a good tank saying it is the best of the war is a stretch because of the variables and catagories. the german 75mm high velocity gun(as well as the 88 of course) was much better at killing russian armor at longer ranges, the T34 just could not effectively respond at those ranges. it took the heavier IS/KV series like the stalin to even those odds.
Gun Control Laws Advance in Colo. — Here’s Everything You Need to Know About Proposed Bans and Background Checks
March 5, 2013 at 10:34am
skeeterhawk some things are more important than life. men have died by the thousands to protect a right their are actively seeking to take away in colorado. i would in that case tell the officer that he is executing an unlawful order in violtion of his oath of office and the state as well as federal consititution as such i am under no obligation to obey or cooperate. ANY attempt to enter my residence will be met with force up to and including leathal force as is my right under law….i would also organize with my neighbors so that if they came to my home they would be facing the entire neighborhood in arms.
