There are laws that provide a harsher penalty for resisting arrest and striking a police officer … seems to me that, due to numerous civil rights violations, states need to push for harsher penalties for police officers who illegally strike (or threaten to strike) citizens. Maybe if officers knew they were facing more than the pittance this POS received as “punishment,” they would think twice.

You’ve obviously never had a child who had to travel by air before. The parents PAY EXTRA for the airline to watch the child … on the plane, between planes and off the plane until picked up by the designated party. The airline is entirely at fault here. I’m amazed you’d imply otherwise.

I think you’re correct. Obviously, Progressive had doubts as to its insured’s possible role in this accident. It would have been financially irresponsible to pay the claim without resolving this issue. In this case, the insurer did what any other insurer would have done. It’s NOT about avoiding liability, it’s about ensuring it is truly liable under the terms of the policy.

And as an attorney, you should recognize the need to be impartial until you receive ALL information. Do you have a copy of the accident report? Have you read Progressive’s rationale for its uncertainty as to whether or not its insured was completely without fault? No? Well then, isn’t it a bit too soon to be lecturing us on the need for tort reform, etc?

Blaze editors, you need to have an attorney advise you before you take sides like this. Although on its surface it sounds terrible, I can see why Progressive and the Courts had to do it this way. Progressive was not fully convinced its insured wasn’t completely without fault. Therefore, it had an interest in ensuring the jury is adequately informed of the details Progressive felt were questionable. The jury heard these details and decided in the family’s favor. This is how our judiciary system works.
And NO, I don’t work for Progressive.
