  Yelling fire in a theater is a danger to life and limb, It’s not a metaphor for any kind of speech that anyone might deem dangerous on any level, and certainly not comparable to speech intended to hurt someone’s feelings or make them unhappy.

  So let me get this straight, you think that the reason that every Congressman, judge and law school professor in the country is on my side or has remained silent on the issue, and only kooks and crackpots are on your side, is that back in 2008 they all entered into a vast conspiracy to lie about both who Obama’s father is and what the law is, even though many of them didn’t want Obama to be President either because they are Republicans or because they wanted Hillary Clinton to get the Democratic nomination. Even if you really can convince yourself that this makes more sense than to think admit that the conventional opinion among educated people with a knowledge of the law is that I’m right and your wrong, it still wouldn’t explain why no responsible conservative journalist or commentator has ever endorsed any of this not eligible even if he was born here nonsense, not even guys like Glenn Beck and Sean Hannity who obviously hate the President’s guts and will say almost anything to undermine him and make him look bad.

  If the photo is republished without the permission of the copyright holder then he is not responsible. Despite the widespread that this will inevitably be recirculated around the internet, I still have not been able to find an uncensored copy of it online to see whether it really looks convincing enough to be mistaken for the real thing. This indicates to me that Hustler’s lawyers are making some effort to control its dissemination, which makes the probability of a successful lawsuit more remote.

  That‘s why the disclaimer that it wasn’t real was almost as large and prominent as the rest of the copy accompanying the photo instead of the one line of small type they usually use, and that should be sufficient to protect them.

  What the hell are you talking about? Politicians have always been fair game for satire, and I have never heard of the feds showing up to hassle anyone for satirical use of Obama or any other president’s image.
