There is a fundamental reason why the legislation in unconstitutional; it violates the separation or division of power between the States and their federal government.
James Madison explained this principle in Federalist Essay No. 45:
“The powers delegated by the proposed Constitution to the federal government are few and defined. Those which are to remain in the State governments are numerous and indefinite. The former will be exercised principally on external objects, as war, peace, negotiation, and foreign commerce; with which last the power of taxation will, for the most part, be connected. The powers reserved to the several States will extend to all the objects which in the ordinary course of affairs, concern the lives, liberties, and properties of the people; and the internal order, improvement, and prosperity of the State.
The operations of the federal government will be most extensive and important in times of war and danger; those of the State governments in times of peace and security.”
The limited powers delegated to the federal government, as stated by Madison, are concerned, for the most part, with external or foreign affairs while the numerous and indefinite powers reserved to the several States pertain to the lives, liberties and properties of the people. Based on this division of power health care falls under the powers reserved to the States.

Unless this happened on federal land or land where the federal government has acquired jurisdiction like a post office, the feds have absolutely no constitutional authority to be involved.
Is the Congressman siding with the Constitution or is his comment about a federal investigation political?

His action did not meet the standard for shoplifting. He did not attempt to leave the store without paying for the item. If he had made it to the check out counter and took the item out of his pants and paid for it would that still be shoplifting?
He should sue the store, the police department and every individual involved!

The birth certificate issue is a distraction to divert attention from the real issue. It does not matter whether Obama was born in Hawaii, Illinois, or the basement of the White House, he is NOT a natural born citizen within the meaning of the Constitution.
In 1862, Congressman John Bingham from Ohio, who is recognized as the father of the citizenship clause of the 14th Amendment, made the following statement during debate on the floor of the House:
“All from other lands, who by the terms of laws and a compliance with their provisions become naturalized, are adopted citizens of the United States; all other persons born within the Republic, of parents owing allegiance to no other sovereignty, are natural born citizens.Gentleman can find no exception to this statement touching natural-born citizens except what is said in the Constitution relating to Indians.”
Four years later, Bingham stated:
“Every human being born within the jurisdiction of the United States of parents not owing allegiance to any foreign sovereignty is, in the language of your Constitution itself, a natural born citizen.”
During the 2008 campaign, Obama’s website stated:
“As a Kenyan native, Barack Obama Sr. was a British subject whose citizenship status was governed by The British Nationality Act of 1948. That same act governed the status of Obama Sr.‘s children.”
Assuming Obama was born in Hawaii as he claims, and there are not facts on the table to disprove that, then he passed the first test of being born within the jurisdiction of the United States.
By his own admission, however, he failed the second test. He was born to only one parent not owing allegiance to a foreign sovereignty. Thus, he is not a natural born citizen and is unconstitutionally occupying the office of the President of these United States. An individual whose citizenship was governed by The British Nationality Act of 1948 cannot be a natural born citizen.
Beck can attack Trump and the so-called birthers until hell freezes over but it will not change these facts.
Question to Beck—if you hold the Constitution in high regard as you claim, then why have you failed to invest the same amount of research into the constitutional definition of a natural born citizen as you have in Soros and presented that information to your radio and TV audience?

On the 6pm radio news here in the SF Bay Area they finally reported the story but omitted the fact that the threat was against a Tea Party member. In fact, they made no mention of a specific threat. They said he mumbled something and people were not certain what he said…disgusting!
