  This is and has always been a decision for the Pentagon and the President. If Obama was so upset with the Republicans for blocking the repeal of DADT, he could issue an EO as Commander-in-Chief and end DADT right now.

  Besides, where in the Constitution is Congress even given authority to dictate military policies? Someone point it out to me cause I can’t find it. Mr. President, you could solve all this overnight if you actually wanted to.

  Speaking of the crowded theater analogy, is that even valid still? What would happen if someone ran into a dark, crowded theater shouting there was a fire in the lobby? Let me think. Most theaters I know of have emergency exits down near the screen that lead outside. Most theaters I know of are also built of materials (metal, concrete, etc.) that would prevent a fire in the lobby from spreading to each theater quickly. Therefore I can conclude that – were someone to shout fire in a crowded theater – people would simply get up and start walking out the emergency exits.

  I reject the very notion that shouting fire in a theater – crowded or not – is against my 1st Amendment right.
