FBI: ‘Somehow’ Anthony Weiner had classified info; but no charges

Testifying before Congress Wednesday, FBI Director James Comey revealed that emails from Hillary Clinton’s private email server – emails containing classified information – were “somehow” being forwarded to (disgraced former congressman) Anthony Weiner by his wife (and Clinton confidant) Huma Abedin.

Answering questions from Sen. Dianne Feinstein, D-Calif., Director Comey explained that the discovery of classified material from Clinton’s private email server on Weiner’s laptop prompted the FBI to reopen the investigation into the emails.

"Somehow, [Clinton’s] emails were being forwarded to Anthony Weiner, including classified information by her assistant, Huma Abedin," Comey said.

Yet no charges were filed. According to Comey, there was no evidence that Abedin “had a sense that what she was doing was in violation of the law."

"We did not find anything that changes our view of her intent," Comey said. But as others have pointed out, criminal intent is not the standard.

National Review’s Kevin McCarthy wrote in 2016:

There is no way of getting around this: According to Director James Comey (disclosure: a former colleague and longtime friend of mine), Hillary Clinton checked every box required for a felony violation of Section 793(f) of the federal penal code (Title 18): With lawful access to highly classified information she acted with gross negligence in removing and causing it to be removed it from its proper place of custody, and she transmitted it and caused it to be transmitted to others not authorized to have it, in patent violation of her trust. Director Comey even conceded that former Secretary Clinton was “extremely careless” and strongly suggested that her recklessness very likely led to communications (her own and those she corresponded with) being intercepted by foreign intelligence services.

If Wednesday’s Senate hearing on oversight of the FBI had to be derailed to revisit the 2016 presidential election, why couldn’t any of the senators in the hearing ask why the FBI rewrote a federal statute to give Hillary Clinton and her aides a free pass?
