Worst Defense Ever? 50-Year-Old Man Claims He Only Had Sex With Unconscious Neighbor to 'Save Her Life

A 50-year-old Utah man was arrested and charged with first-degree felony rape on Monday after he allegedly had sex with his neighbor while she was unconscious.

It was revealed this week that the suspect, identified as Rodger William Kelly, reportedly told police he only had sex with the 29-year-old on May 19 in order to keep her warm as he was "trying to save her life."

"He said he did place it inside of her to try and get her temperature up," court documents said, according to the Daily Mail.

The alleged rapist in a statement to police said he came home and found the woman passed out on her porch and brought her into his apartment to change her clothes.

He then claims he put her on his bed and laid down next to her and started hugging her to increase her body temperature. No satisfied with the effects, Kelly then had sex with the unconscious woman to "warm her," according to the Salt Lake Tribune.

Paramedics arrived to find Kelly giving the woman CPR. However, police didn't know about the alleged rape until the woman claimed she might have been sexually assaulted.

Police then launched an investigation and found bruising on her pelvis and upper thighs, court documents said. Results from a rape kit were inconclusive because her vaginal area was reportedly cleaned while she was unconscious.

"Kelly told police that the two previously were intimate, but admitted the woman had told him before the incident that she didn’t want to have sex with him again," the Daily Mail reports.
