Real News From The Blaze': Rules for Cyber War

In front of the U.S. Cyber Command Inter-Agency Legal Conference Tuesday, the State Department’s top lawyer Harold Koh laid out the legal justification – the rules of engagement--for how an act of aggression sparked in the virtual realm can be seen as an act of war and responded to in a conventional way by the U.S..

"Cyber activities that proximately result in death, injury, or significant destruction would likely be viewed as a use of force,” Koh this week.

“A State’s national right of self-defense, recognized in Article 51 of the UN Charter, may be triggered by computer network activities that amount to an armed attack or imminent threat thereof."

Secretary of Defense Leon Panetta has also made strong statements this week regarding cyber warfare as the battleground of the future, raising the issue of China’s growing cyber warfare capabilities during “candid” discussions he had with Chinese military leaders in Beijing.
